RESOLUTION NO. RA 93-12
RESOLUTION OF THE LA QUINTA REDEVELOPMENT AGENCY BOARD
REVISING THE AGENCY'S POLICIES TO ENCOURAGE CONTRACTS
EMPLOYING FIRMS AND INDIVIDUALS RESIDING IN THE PROJECT
AREAS
WHEREAS, the La *uinta Redev*opment Agency the Agency") desires to
encourage economic revitalization and job growth in the Agency project areas; and
WHEREAS, pursuant to California Health and Safety Code Section 33422.1, the
Agency may give a preference to business concerns which are located in or owned
by persons residing in the project areas; and
WHEREAS, pursuant to California Public Contract Code Sections 20688.2 and
20688.3 and Health and Safety Code Section 33422.3, the Agency may encourage and
provide opportunities for training and employment to lower income residents of the
project areas; and
WHEREAS, the Agency Board approved by Resolution 93-10 an initial policy
to encourage contracts employing firms and individuals residing i*he project area;
and
WHEREAS, the Agency wishes to revise and clarify its original policy.
NOW, THEREFORE, the Board of the La Quinta Redevelopment Agency does
hereby find, determine, order and resolve as follows:
Section 1. Resolution 93-10 is hereby amended and replaced as
provided below.
Section 2. Ml contracts awarded by the Agency pursuant to Section
20688.1 of the California Public Contract Code shall give a preference to business
concerns located in or owned in substantial part by persons residing in the project
area in an amount that would award the contracts to such firms whose total quotation
or bid exceeds the lowest quotation or bid by not more than two percent 2%).
Section 3. In the event that a contractor does not qualify under
Section 1 above, but specifies subcontracting entities or individuals that meet the
location of the business or ownership residency criteria set out above, then the
Agency shall give a preference in the consideration of the award of the contract in
an amount equal to five percent 5%) of the v*ue of the applicable subcontractors
estimated portion of the contract.

Section 4. Separate and apart from the app ilcability of Sections 1 or
2 above, all contractors under contract pursuant to Public Contract Code Section
20688.1 with the Agency shall receive a rebate credit for the documented employment
of lower-income project area residents as defined in Health and Safety Code Section
33422.3. The rebate credit shall equal thirty-three percent 33%) of the wages
inclusive of benefits for the qualified lower income project area residents based on
the certified payroll documentation up to a maximum amount of two percent 2%) of
the overall estimated labor cost for each project
