FISCAL IMPLICATIONS: Refer to Attachment 1. BACKGROUND AND OVERVIEW: This matter was continued from the February 18,1997, City Council Meeting. As of this date, the actions taken by other cities in the Valley are as follows: Rancho Mirage The City of Rancho Mirage approved the JPA on February 6,1997. The Council appointed Council Member Glassman as representative and Council Member Christine Murphy as the alternate to the JPA Board. The City Council also provided direction that Council Member Glassman ask the JPA to calendar the following item as an action item: Discussion and action regarding amendment of Section 5.2, Withdrawal," of the Agreement, specifically shortening the time period of one year to give written notice of withdrawal to a more suitable time period 30 to 90 days). Indian Wells The City of Indian Wells approved the JPA on February 6,1997. The Council appointed Council Member Artie Henderson as representative and Council Member Percy Byrd as Alternate to the JPA Board. The Council approved the JPA with the condition that the City can withdraw in a reasonable time period of 90 days or less. FISCAL IMPLICATIONS: During the December 17, 1996 City Council Meeting, the City Council directed staff to set aside $518,000 for the proposed Fritz Burns Park Public Pool project. The maintenance and operation costs to the City is dependant upon the result of the election and negotiations with an outside agency. BACKGROUND AND OVERVIEW: During the December 1 7, 1996 City Council Meeting, the City Council considered a recommended prioritized list of park improvements forwarded through the Parks & Recreation Commission. One of the projects on that list was the proposed public pool at the Fritz Burns Park for an estimated amount of $518,000. FISCAL IMPLICATIONS: The estimated cost for the Preliminary and Final Design is $600,000. The cost allocation is as follows: Preliminary Design $130,000 Final Design $391,740 City of La Quinta Administrative Costs $78.260 TOTAL COST FOR PHASE I $600,000 Under this Agreement, CVAG will provide 100% of the funding. The Reimbursement from the jurisdictions will take place prior to completion of project construction. The jurisdiction reimbursement will be further clarified as part of the construction reimbursement agreement and MOLJ that will be developed in the future. CVAG is utilizing Measure A" funding for half of the total cost of the project. The other half will be calculated based on the percentage of improvements within each agency jurisdiction. The exact percentage of participation will be calculated by the successful consultant as part of the design contract. According to the Reimbursement Agreement and Memorandum of Understanding, each jurisdiction must identify and budget its share of funding prior to commencement of construction. Authorize staff to initiate the selection process to contract for professional services, and appoint two Council Members to participate in the selection process. FISCAL IMPLICATIONS: None at this time. BACKGROUND AND OVERVIEW: The contract would include professional auditing services and preparation of the financial statements of the City, Redevelopment Agency, and Financing Authority. Also, it would include a compliance audit of the Redevelopment Agency in accordance with guidelines issued by the State Controller's Office, a single audit on federal financial assistance, and a review on the internal controls of the City. In addition, the contract would include 40 hours of consulting services to assist in accounting and cash flow issues. FINDINGS AND ALTERNATIVES 1. FISCAL IMPLICATIONS: None BACKGROUND AND OVERVIEW: The California Political Reform Act of 1 996 passed by the voters as Proposition 208 on November 5, 1996, permits cities to establish voluntary expenditure ceilings for candidates for elective office and the controlled committees of such candidates. As of January 1, 1 997, candidates to elective offices are limited to accepting no more than $100 from a person during a calendar year. However, that limit can be changed to $250 if the City adopts a voluntary expenditure ceiling and the candidate agrees to that expenditure ceiling. The expenditure ceiling is based upon the City's population as determined annually by the California Department of Finance. The City Council may establish an expenditure ceiling up to $1 per resident. The City currently has a population of 18,046. If a voluntary expenditure ceiling is established, a candidate may either accept it or reject it--it's completely vol/untary. If he/she accepts the ceiling, then their contributions limit is increased to $250. If he/she rejects the ceiling, then their contributions limit remains at $100. If the Council chooses to adopt the ordinance submitted, there is a related resolution which sets forth the City's population. If an ordinance is adopted, the resolution will be submitted to the City Council at the time of second reading. BACKGROUND AND OVERVIEW: The City Council, at its February 18, 1 997 meeting, approved under Resolution 97-1 3, an application for the 1996 Bicycle Lane Account Grant Attachment 1). The application asks for $35,063 with a City match of 10% for a total project cost of $38,959 to provide on-street striping and signs Class II Bikelane) from the existing Bear Creek path east/west along Calle Tecate to Avenida Bermudas and follow that street to Fritz B. Burns Park. To be eligible for this State grant, the City must have an approved Bicycle Transportation Plan. The Bike Route Plan" was reviewed by the Planning Commission and Parks and Recreation Commission The Plan was approved by the City Council in 1 996. CALTRANS requested terminology changes to reflect current Streets and Highways Code for nonmotorized vehicles. No changes have been made to bikeway locations, design, or standards. During the December 19, 1995 City Council meeting, the City Council awarded Contract No.95-04, Adams Street Extensionl4- Signals, to Paul Gardner Corporation of Ontario, California. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: The Riverside County Transportation Commission RCTC) has requested that the City approve a resolution authorizing approval of the RCTC's amendment to Ordinance No. 88-1 Attachment No.1). This action has no effect on the funding or distribution of any Measure A funds it is a map change only to show the newly" incorporated cities of Canyon Lake, Calimesa, and Murrieta. Those cities are already in the funding formula; however, they have not been on the map exhibit since it was originally created. The Public Works Director/City Engineer has reviewed the request by RCTC and recommends approval of the request. Further background information is included within the attachment. As of March 7th, cities and the County have approved resolutions in support of the map change. RCTC staff believe that many will be considered by City Councils during March and April 1 997. Locally, Palm Desert and Indian Wells have each approved the resolution. Pursuant to that authorization, staff met with RSG representatives, reviewed the existing contract and discussed an extension to contract terms. The Contract Services Agreement represents the results of that discussion. The implementation of this Agreement was necessitated by the Resignation of Contract submitted by Apollo Sweeping Co., Inc. on November 18, 1996. Based on the level of service rendered by Apollo Sweeping at that time, the City accepted the Resignation. Staff is in the process of generating a report addressing in-house street sweeping vs. contract street sweeping. Motion to introduce Ordinance on first reading. FISCAL IMPLICATIONS: There is no fiscal impact to amend the Ordinance. If desired by the City Council, temporary personnel could be hired for a six month period to enforce the ordinance at a cost of $18,560. Monies are available in the Special Enforcement Fund Account #101-301-609- 575. BACKGROUND AND OVERVIEW: The Recreational Vehicle RV) regulation issue was first raised by residents during the public comment portion of the October 1,1996, City Council meeting. After listening to the comments that were expressed, the City Council agendized the issue for their Study Session on October 15, 1996, at which time they referred the RV regulations to the Planning Commission for review and recommendation. The Planning Commission conducted a Public Hearing on November 26,1996, at which time public comment was taken. The public comment portion was then closed and the item continued to December 10,1996, for Commission discussion and recommendation. Planning Commission Recommendation At their meeting of December 10, 1996, the Planning Commission on a 3-2 vote Commissioners Abels and Gardner were absent) recommended approval of the regulations permitting the storage of an RV within the garage, if the RV cannot fit within the garage, it can be parked within the side/front setback area if the sideyard is eight feet or less. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: Site Background The site is located on the north side of Fred Waring Drive, approximately 1,615-feet east of Washington Street Attachment 1). The 28.8-acre parcel is vacant and covered with native vegetation. No major landforms exist other than sand dunes which have been driven on by off-road vehicles. This site, a portion of Parcel 2, was created under Parcel Map 27131 and has been zoned for residential purposes RL Zone) since 1991 when it was annexed into the City. On December 19, 1996, the Conditions of Approval for Parcel Map 27131 were amended by the Community Development Director to permit phased development of each parcel of the map. The 33-acre parcel is vacant and covered with native vegetation. No major landforms exist other than sand dunes which have been driven on by off-road vehicles.
