Ref: Exit from North Harland Drive onto Miles Street.
I'm writing in regards to the exit of the above location and
the inconvenience it is to drive all the way around to
Washington to go to Walmart and Albertson grocery.
My neighbors said they go on Miles past Seeley and make a
u-turn and that to me is very dangerous compared to making a
left hand turn on No. Harland on to Miles.
Last year our families from Nebraska were visiting us and our
son is a constructional engineer in Omaha and we asked him
why we had to drive all the way around instead on turning
left on Miles. He advised us that when a traffic survey was
made it was ignored or wasn't turned in because the traffic
on Miles is considered light traffic and there is no reason
we couldn't have a left turn arrow on No. Harland.
Also, when giving directions to anyone, it is hard for them
to understand why they have to turn on Miles and Seeley and
go around the block to get to Nolan Circle. It has been very
confusing.
Now, the police are setting on Miles and stopping people who
do turn left going out of Harland, I'm sure they have much
more important things to be done and also realizing the law
is being broken by turning on the double yellow lines.
Please check into this situation and hopefully you will see
that this should be changed before accidents occur from the
u-turns on Miles past Seeley.
Would really appreciate your concern over this and the white
paint will be put on very soon.

Mayor Holt and Council Members:
The La Quinta Chamber of Commerce Business Development and Retention Committee meets
monthly to address issues of concern to existing businesses, as well as the development of new
programs for both business retention and economic development. At one of our recent
meetings the idea was broached again of the city and chamber partnering to have
representatives meet with existing businesses.
This is a program which we have casually mentioned in a number of meetings with the city. We
would like to now ask for formal consideration. The parameters and details can be worked out
by respective staffs, should the council approve the concept.
The premise is simply to provide an effective outlet of management representatives from both
the city and chamber to allow existing businesses an opportunity to express face to face what
we may be able to do better or more effectively for them. This program has been used in other
cities with great results. We feel, at the very least it would open lines of communication
between businesses and the two key city agencies who can assist them. Hopefully, if one of
our businesses was in need of assistance, this would provide the appropriate venue to address
their issues.
We would like to implement this program as soon as possible, using the chamber president(ceo
and the board of directors as our representatives. We would like to recommend that the city
consider using appropriate department heads, assistant & city managers and city council as
their representatives. As we envision the program, perhaps once a week an appointment can be
set up for the representatives to meet with the owner/operator of a La Quinta business. We feel
this would not be too time invasive for either entity, but certainly demonstrates our willingness to
begin hands on" communication with our businesses.
We appreciate your consideration of this program and hope that you, too, see an inherent value
in undertaking it on a continued basis. We will look forward to partnering with you in this
important business retention program.

Dear City Council Members:
The enclosed memorandum and documentation, I believe, raises some serious
questions as to the high telephone rates" here in the Coachella Valley. This situation
significantly affects all citizens, particularly senior citizens and low-income families.
Local telephone rates have gone up 291% since the break-up of the Bell System
and 48% in the past 3 years. This has happened while long distance rates have been
reduced substantially which has had little effect on the elderly" and low income
people who are required to pay exorbitant rates for basic telephone service" while
subsidizing low long distance rates" enjoyed by high L.D. users and, in particular,
businesses who are heavy users of long distance.
Since the Coachella Valley has a substantial number of senior citizens on fixed
incomes and low income families, high and unfair telephone rates should be
thoroughly examined and perhaps petition the California P.U.C. to show cause" why
telephone rates should not be substantially reduced here in the Coachella Valley.
I have sent this letter to all the various City Councils in the Coachella Valley and
C.V.A.G. Should your Council and the others, as well as C.V.A.G. feel this matter be
investigated, it could be coordinated so as to eliminate any duplication of effort.
Since I have had considerable experience in telephone rate making" and rate
of return", I would be happy to assist you on a volunteer basis.

Much has been said and written lately about electricity rates" charged by
Southern California Edison, but little or nothing about the spiraling telephone
rates".
For example:
In 1983, a basic residence one party line $ 6.46
In 1996, the same telephone service $18.60
For 291% in?ease!
while, at the same time, the consumer price index" has increased only 52%.
In addition, the basic service taxes and surcharges have increased from
1993 1997

These basic" surcharges have increased 533% in only four years 36 to 1.92).
This is in addition to an increase in basic charges of 48% 12.56 to 18.65).
All of these increases have occurred during the period from 1993 to 1997, a time
that the F.C.C. has claimed that the public will enjoy significantly lower cost of
telephone service. The only rate reductions have been in long distance calls but
that rate reduction has been immediately passed on by local telephone rate
increases. The telephone user who does not use much long distance has been
taken for a ride" by subsidizing high long distance users.

While telephone user's rates have increased 291% since the break up of the Beli
System", G.T.E. has passed on to the user" the costs of:
Providing their own telephone equipment.
Maintaining their telephone equipment.
Providing their own house" wiring.
* No local business office service.
New charges for local calls within the Coachelia Valley.
* A service or billing question is answered by a center" anywhere from
Whittier, California to a center" in Florida, who is not aware of
California telephone rates or service offerings.
When calling to talk with a service representative??, the customer must
listen to a whole litany" of instructions punch this, punch that;
placed on hold" until they are ready to serve you at their
convenience, not the customer's. This process takes an average of 6
minutes. Prior to the break-up", the service representative was
required to answer a call in seconds. Whatever happened to good
customer service? Again, the customer is getting less for there times
more expense.
The California P.U.C
* The February 28, 1997 telephone bill has a new charge on the
telephone bill noted: C.H.C.F.-A, which stands for California High
Cost Fund, a charge which provides subsidy to the smaller serving
area by increasing rates to medium" and high area customers.
Consequently, the larger areas will subsidize small serving area
customers.
Such action is nothing more than robbing Peter to pay Paul".
* If it coats more to serve airline customers at Palm Springs, should a
Los Angeles customer pay higher rates to lower f?fares for Palm Sprinu?
customers. The answer is NO I
* An additional charge on G.T.E. January 28, 1997 bill is for the
California Teleconnect Fund" which is for discounting services to
Internet services to schools, libraries and hospitals.
Telephone customers could reasonably ask:
* Does book manufacturers, by law, provide hooks and
journals to schools?
Does Con-Edison or Southern California Gas provide free
service to schools?
* Do hospitals get subsidized medical equipment?

Why single?e out telephone subscribers to subsidize these institutions
which actually distorts the actual true cost. of:
* Education
* Hospital services
* Library operations
Has G.T.E. increased their investment and operating costs which will
be reflected in promoting the following:
* Fax lines
* P.C. lines
* Data lines
* Cell phone terminals
Which cause: changes in area codes.
Should the cost of capital and maintenance be borne by all telephone
customers or should a separate company be created to support
themselves?
The above types of decisions and questions, by and to the California P.U.C. are, in
my judgment, beyond the scope and authority of the P.U.C., both legally and
morally.

is taking the steps necessary to allow competition in the
local telephone market. This means that you soon may
ha?? a choice of several telephone companies who can
provide you with local telephone service.

Beginning with this bill, you will see two new surcharges,
one for the new California High Cost Fund-B CHCP-B)
and one for the new California Teleconnect Fund.
The CHCF-B is a new surcharge designed to ensure the
availability of basic local exchange service at affordable
rates to all Californians. Similar to the CHCF-A, the
CHCF-B helps support basic residential telephone service
in areas served by medium and larger-sized telephone
companies where costs exceed the statewide average.
The CPUC established the California Teleconnect Fund to
encourage the development of a state-of-the-art telecom-
munications network in California. This fund will provide
discounted phone service, including high speed services
which can be used to access the Internet, to qualifying
schools, libraries, hospitals, and other non-profit
community-based organizations. This fund will help Ii
provide access to advanced telecommunications services to
as many people as possible.

RECOMMENDATION:
Do not amend Section 12.32.120 and maintain the current restrictions on the parking
of commercial vehicles in the City.
FISCAL IMPLICATIONS:
None
BACKGROUND AND OVERVIEW:
At the March 18,1997 City Council meeting, written correspondence was received
regarding the current restrictions on height limitations for commercial vehicles
Attachment 1). The author of the letter, Mr. Donlin), had been contacted by a code
compliance officer and had been informed that the commercial vehicle which he parks
at his home, exceeds the allowable height limit, and cannot be parked in the City.
Pictures of that vehicle are included as Attachment 2.
Section 12.32.120 Attachment 3) allows commercial vehicles that are under twenty
feet in length and shorter than eight feet in height to be parked in the City. Mr.
Donlin would like to see this Section amended to allow his vehicle, which is 1 911
long and 8'6" high, to be considered exempt from the parking restrictions. Included
as Attachment 4 are examples of other commercial vehicles that are all within 1 2?' of
the height and width of Mr Donlin's, which are also currently restricted from parking
in the City.
Staff has discussed other options available to Mr. Donlin which include parking the
vehicle at a location outside the City, parking the vehicle in the maintenance area of
a gated community, altering the vehicle to within height limitations, or utilizing a
smaller vehicle that would be exempt from the restrictions.

BACKGROUND AND OVERVIEW:
In order to better serve the business community and provide more ease in the
administration of the business licenses, Staff is proposing that the business license
renewal year be changed from a calendar year end date to the one year anniversary
date from the license issuance date.
Under our current policy, all licenses expire on December 31 regardless of when a
license was issued during the calendar year. Under the proposed amendment, all
licenses will expire one year after the issuance date. For example, under the
proposed policy a contractor pays for a license on December 1 0th making the
renewal date December 10th of the following year. Under the current policy the
renewal date for this contractor would be January forcing him to renew and
make a second payment in 20 days.

THE CITY COUNCIL OF THE CITY OF LA QUINTA DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. The California Political Reform Act of 1 996' passed by
the voters as Proposition 208 on November 5, 1 996, permits cities to establish
voluntary expenditure ceilings for candidates for elective office and the controlled
committees of such candidates. Pursuant to California Government Code Section
85400(c), effective January 1, 1 997, such a local voluntary expenditure ceiling
maybe established in any amount not to exceed one dollar $1) per resident of the
jurisdiction.
Section 2. Section 2.05.010 is hereby added to Chapter 2 of the La
Quinta Municipal Code, to read as follows:
Section 2.05.010. Election campaigns. Voluntary Expenditure
Ceiling.
a) Pursuant to Government Code Section 85400(c), a voluntary
expenditure ceiling is hereby established for each election to City elective office in
an amount equal to one dollar $1) per resident of the City. As used in this
Section, the term City elective office" shall mean the offices of Mayor and
Members of the City Council.
b) The City Council shall determine the number of residents in the
City for the purposes of this Section by resolution adopted not less than seven 7)
months prior to each regular City election. The time frame specified in this sub-
section b) shall not apply to any special election called for the purpose of filling
vacancies.
c) Prior to accepting any contributions, each candidate for City
elective office shall file with the City Clerk a statement of acceptance or rejection
of the voluntary expenditure ceiling established herein.

BACKGROUND AND OVERVIEW:
On March 18, 1997, the City Council introduced Ordinance No.300 and conducted
second reading on this date. This ordinance established a voluntary expenditure ceiling
for candidates for elective office as allowed by The California Political Reform Act of
1 996" which was passed by the voters as Proposition 208 on November 5, 1 996.
That ordinance provides for the population of the City to be established seven months
prior to the election, which is determined annually by the California Department of
Finance. As of the last certification from the State, the City's population is 1 8,046.

1. Adopt the attached resolution establishing the number of residents of the City for

RECOMMENDATION:
Approve auditing services with Conrad & Associates for a period of five 5) years.
FISCAL IMPLICATIONS:
The audit fee would remain at the FY 1 995/96 amount of $26,307 for FY 1 996/97
and FY 1 997/98. For the subsequent three years, the rate would increase by 2 1/2
percent to $27,000 for FY 1998/99, $27,700 for FY 1 999/2000 and $28,400 for
FY 2000/01.
BACKGROUND AND OVERVIEW:
At the March 11, 1 997 Council Meeting, Staff was directed to negotiate an audit
contract with Conrad & Associates Attachment No.1). This contract has been
prepared in accordance with the City Standard Contract format.
FINDINGS AND ALTERNATIVES:
The options available to the City Council are:
1. Approve auditing services with Conrad & Associates for a period of five 5)
years;
2. Approve auditing services with Conrad & Associates, as amended;
3. Submit the request for proposal for auditing services;
4. Provide further direction to staff.

RECOMMENDATION:
Adopt Council Resolution approving the temporary closure of Avenida Bermudas
between Calle Arroba and Calle Nogales and those interconnecting streets to the west
approximately 200-feet on April 5, 1 997, from 6:00 A.M. to 7:00 P.M. for the Greater
Coachella Valley Soap Box Derby event.
FISCAL IMPLICATIONS:
On February 1 8, 1 997, the City of La Quinta became a co-sponsor of the event by
contributing $3,650 for this event in the form of money and in-kind services. Funds
were approved to be expended from the Special Projects Contingency Account #101-
101-663-000).
BACKGROUND AND OVERVIEW:
The Greater Coachella Valley Soap Box Derby organization has applied to close
portions of Avenida Bermudas between Calle Arroba and Calle Nogales and those
interconnecting streets to the west approximately 200-feet during their third annual
race scheduled for April 5? 1997, during the hours of 6:00A.M. to 7:00 P.M. with
racing beginning at approximately 9:00 A.M. The temporary closure of these public
streets during this annual event will permit areas for racing, vendor parking and other
necessary functions. The race participants are between the ages of 9 and 1 6, and
build their cars from kits they purchase from the Soap Box Derby organization.
On March 25, 1 997, the Planning Commission approved the temporary outdoor event
on Avenida Bermudas, subject to Conditions being met. The applicant is required to
obtain approval from the City Council to close portions of Avenida Bermudas and
abutting streets pursuant to Chapter 1 2.32 Parking) of the Municipal Code.

Re: Update regarding the City of Lomita's request concerning flying the
POWIMIA flag at all City facilities and encouraging the local Post Office
to do the same.
The City Council referred the correspondence dated February 5,1997 from the City of
Lomita to the City Manager and City Attorney for comment at its regular meeting of
February 18,1997. Accordingly, staff reviewed the attached correspondence Attachment
1) and considered the ramifications of accommodating the City of Lomita's request.
The La Quinta Civic Center was designed with three flag poles. These poles are home to
the U.S., State of California and City of La Quinta flags-each flag with its own pole. A
fourth flag could be flown with one of the existing flags or a fourth pole could be erected.
The City of La Quinta has no policy that would preclude flying the POWIMIA flag over its
facilities. There would be a small cost for acquisition, maintenance and operations
associated with a decision to fly an extra flag.
The City Attorney has advised that, in addition to the aforementioned cost factors, the City
should consider precedent and possible criteria for selecting and/or rejecting future
requests of this nature. In effect, the concern would be that opening the door for one flag
might lead to similar requests from others, possibly leading to first amendment issues
should certain applications be accepted while others are rejected.
Given the above concerns, staff has drafted a response for the Mayor's signature,

This memorandum addresses the three major issues raised by the City Council at
its March 18,1997 meeting.
The design and location of the wall along Avenida Bermudas A perimeter
wall is proposed along the west, north, and east boundaries of the project.
Specifically, the perimeter wall will go along the east side of Avenida
Bermudas. The wall is designed to be six 6) feet in height, and in two places
will be constructed upon a two-foot berm. The design and location of the
wall along Avenida Bermudas will have meandering segments within a 10 to
32 foot wide parkway. At the extreme southwest corner of the project the
mountain will only allow for a five foot landscape/wall parkway for a short
distance. The existing sidewalk ranges from five feet wide to eight feet wide
as it proceeds north. The applicant proposes to utilize the existing sidewalk.
The City Council requested the inclusion of vertical elements, wrought iron
segments, and a better understanding of how the wall will meander.
To clarify the nature of the proposed/required wall, the applicant has
prepared an exhibit depicting the entire length of the Avenida Bermudas wall
and parkway.
2 Better clarification of the pad heights along Avenida Bermudas as they relate
to the existing pad elevations along the west side of Avenida Bermudas
The residential lots proposed along Avenida Bermudas are already graded
and comply with Condition #78 as currently written. These lots fit into three
categories:
a. Lots 84-89: These lots occupy the west embankment of the large
detention basin. They range from one to four feet higher than Avenida
Bermudas; however, they can not be lowered because it would
destroy the detention basin geometrics that are needed for flood
control purposes.
