Request: Approve the Final Record Maps and Accept the Letters of Credit Guaranteeing the Completion of Improvements Applicant: Landmark Land Company Tentative Tract Map No. 18765, Revised No. 1, consists of 72 statutory condominium units of 19.1 acres. The final map for Tract 18765-2 contains one lot with 25 condominium units on 2.56 acres. The City Engineer has determined that the final record map and improve- ment plans are consistent with Tentative Tract Map No. 18765, Revised No. 1, which was approved by the City Council on November 2, 1982, and are also in compliance with the state and municipal requirements. The City Engineer has also approved the amounts of the required Letters of Credit guaranteeing installation of improvements. STAFF RECOMMENDATION The Community Development Department recommends that the City Council approve Final Tract Map No. 18765-2 and accept the Letters of Credit guaranteeing the construction of sewer, water, street and drainage improvements. PLOT PLAN NO. 84-088 2. STREET VACATION NO. 84-055 Location: 1. Southeast Corner of Calle Tampico and Avenida Obregon 2. Portions of Calle Tampico and Avenida Obregon Applicant: Landmark Land Company Request: 1. To construct a one-story, 8000-square-foot, golf course maintenance building. 2. To abandon portions of Avenida Obregon and Calle Tampico. On January 23, 1985, the Applicant appealed the Planning Commission decision to deny the above-referenced matters. The appeal letter is attached. On January 8, 1985, the Planning Commission conducted public hearing on the Plot Plan and Street Vacation requests and unanimously denied both applications. The attached Staff Reports provide background information reviewed by the Planning Commission when it considered these matters. The Planning Commission discussion on this project focused on the following issues: o Premature nature of vacation request as it relates to coordination with flood improvements. o Piecemeal nature of vacation request with only two small segments being part of Applicant's request. o Compatibility of proposed maintenance building with surrounding residential area. Concerns relating to the type and amount of traffic generated by the proposed use, especially in light of existing circulation pattern in the surrounding area and relating to the main point of access. o Concerns regarding appropriateness of building d including its orientation towards the mountain. 7. Th.(l) BIB] 05-12-1998-U01 03:27:29PM-U01 ADMIN-U01 CC-U02 02-U02 19-U02 1985-U02 $p+` a * STAFF REPORT CITY COUNCIL February 19, 1985 Page 2. o Concerns regarding adequacy of parking. o Concerns about the Applicant's ability to comply with Fire Department requirements for access and fire flow. o Concerns regarding perimeter fencing and landscaping, as well as the Eisenhower/Tampico landscaping situation. a Concerns regarding noise and other operational factors associated with the maintenance facility. In general, it was the consensus of the Commission that there were problems with the project as currently proposed. However, since both the Applicant and surrounding property owners pushed for a decision and there appeared little indication of substantive changes, the Commission deemed it necessary to deny the requests. The following persons appeared for the Applicant requesting approval of the requests: o Andy Vossler, Landmark Vice-President, noted the Applicant's willingness to change the entry to Tampico, review fencing and on-site landscaping and make certain other modifications. He stated that the facility was a necessity, not a luxury, and that it would be an asset to the neighborhood. o Brian Curley, Planner for Landmark, described the proposed metal building and its design advantages. o Peter Sherman, Counsel for Landmark, stated that the City could not require Eisenhower/Tampico landscaping as part of this project because it was not reasonably related to the proposed use. The following persons appeared in opposition to the request: o Bruce Robinson, Obregon resident and property owner, acting as spokesman for the neighbors, objected to the improper maintenance facility location, noise level increases, detri- mental impacts to residences, storage of potentially hazardous fuel and pesticides, possible undesirable effects of workers in the neighborhood, and other features of the project. He stated that another location would be more appropriate. o Maurice Bridler, Alvarado resident and property owner, agreed with Mr. Robinson1 5 objections and stated that the building should be within the project so that the users of the golf course would be the ones putting up with any detrimental impacts occurring frojn its own maintenance fac ility. o Frank Murphy, area property owner 36 lots), stated that this use should not be allowed in an R-l Zone. o Other neighbors to the proposed project were in attendance, but did not speak. Subsequent to the Planning Commission decision on the project, there has been considerable activity by the Applicant to modify the proposal to overcome the opposition evident at the hearings. a Applicant has revised the site plans calling for a two-phase development scheme. Principal changes in the plan include change the main entrance to Tampico from Obregon; changing the golf course access point in Phase 2); providing berm, block wall, new landscaping along east property line in Phase 2); relocating chain link fence along dike in Phase 2). a Applicant has revised exterior building elevations changing from a metal building to a stucco exterior, including several vertical and horizontal offsets elements with a tile mansard roof. a Applicant has submitted a letter copy attached) proposing to immediately install as part of conditions for approval) land- scaping and walkway per a plan submitted See Exhibit D New)]. The letter requests the City to maintain the area. The letter also proposes to contribute to the cost of a signal at Eisenhower and Avenue 50. Landmark further requests the City to require La Quinta Country Club to improve its maintenance facility across from the Hotel entrance. a Applicant has met with Bruce Robinson in an effort to respond to neighbors' concerns and, according to Mr. Robinson, there will be little or no objection to the project as a result of the above referenced changes and other agreements" made with the Applicant. a Applicant has submitted a letter from Coachella Valley Water District requesting vacation to CVWD of pertinent right-of-way adjacent to project site. A revised exhibit shows the revised request. In considering this appeal, the City Council has the following alternatives available: 1) Deny the Plot Plan and Street Vacation, as currently recommended by the Planning Commission. It would be necessary for Staff to prepare findings to support such an action.) 2) Refer the matter back to the Planning Commission for additional consideration, including possible conditions for approval. This can be done based primarily on the modifications which have been made since previous Commission review which may be substantial and which nay change the Commission recommendation. If this is done, the appeal hearing should be continued probably to March 19 to allow Commission consideration on March 12.) This does not, however, mean that other general circulation standards could be considered in making the determination of General Plan consistency. public Benefit: Ultimately, the abandonment of public rights-of-way in this area will be necessary to facilitate anticipated changes to the flood control syst*; however, final plans for the flood * in this area are not yet CcOplete. As a result, it is difficult to fully and adequately assess the irr*acts to roads in the area. Principal concerns related to public benefit should be local circulation needs, particularly those related to emergency vehicles. It would appear that, based on a preliminary understanding of the ultimate road configuration in the area, abandon- ments of these roads would not significantly affect local circulation or emergency vehicle access provided that provision is made for adequate cul*e-sac turna** for any cul*e-sacs that would occur as a result of road changes. Future Use: The future use of these portions of Calle T&pico and Avenida Obregon seem sariwhat limited. They principally provide local circulation to a limited number of lots. It does, howver, appear that the anticipated, ultimate road configuration would provide aduuuate access for residential type develope*ts. The nature of the area m*icates that the volume of traffic generated by residential uses would not be large enough to reguire Avenida obregon and Calle Ta*ico to connect with each other. E*ironmental *iew: The road vacation has been reviewed for environmental concerns and pertinent coments are included under the heading Environmental Assessment" with the Backgrcxind section of this report. Briefly, the only a*parent mitigation necessary for the vacations appears to be provision for adequate cul-de-sacs and associated turnarounds. Additienal R*: It se*ns evident that the ultimate road configuration in the area will be adjusted primarily to acc*rdate future flood irrproveeents. Nevertheless, there is significant concern that the pi**l abandonment of these rights-of-way is not advantageous to the City's needs, nor to those of surrounding residents. Traffic and Circulation: Concerns related to traffic and circulation *ere discussed to some degree in the associated report on the road vacation re*uest. of particular concern here is the type of traffic *Alich **ould be generated by the proposed golf cousse main*nce facility and its difference from typical residential devel*irent. There is concern that the proposed access from Avenida Cbregon will result in traffic of a more * nature o*niflg to this site. That traffic could inclix]e larger vehicles delivering landscaping supplies, fertilizer, sand and related materials and tanker trucks delivering gasoline to the underground storage tanks. It does not appear it woiild be appropriate to bring such traffic along *ntezuma and *regon into the subject site. In addition, eaployee traffic *ould not be typical of that traffic flaw occrrs in the area. As a result, it appears to us that if the use is to be alloeed, traffic *)0uld be encouraged to OoOe in from Calle Tartpico rather than Avenida *regon. Although, emergency vehicle type access and a gate for that access appears to be necessary on Avenida *regon. As noted in the report prepared for the road vacation re*iest, there are concerns ab*t the timing of cul*e-sac and related i't*roveeents *hich are part of the future flood irrproveeents to the area. Parking: s*en parking spaces are proposed as part of the project. There is no definitive basis upon which to base parking reguir*r*ts for this type of facility. Staff has visited a number of similar uses in the area over the last six to eight * *st of the* facilities provide a similar nubeer of parking spaces and it appears the nubeer proposed is reasonable. However, concern dces exist relative to the continued use of these parking *paces for their designated purpose. cbservation of other facilities indicates that over tin* the parking spaces end i*p being used for activities associated with the maintenance facility and that parking typically occrs outside of the fen*d-off maintenance facilities. This WOuld be particularly undesirable if the Avenida Cl,regon entrance is the only one provided because the parking *uld then be Ocurring alci*g a typical residential street. If the access is moved to *rtpico, the concern would be lesser based on existing developeent, but should be a considera- tion in light of future development in that area. Building Design: The proposed building is of netal construction with a l* height of approximately 14'6". This building is typical of others observed during staff visits to sooe more facilities in the valley. However, all of those structures i*re located within the projects to *hich they were accessory. There is concern that the use of this type of building along the perTh*ter of a project where the principal exposure is to residential uses, whidi are not part of the project being served by the mainte- nacce facility needs to be considered in the building design. Oonsiderations to different types of building exteriors and to reorienting the building are appropriate. *ilile it is possible that some upgrade to the building materials, particularly the roof, could be considered, it should be noted that there are substantive concerns related to building design and orientation that need to be resolved. Building Use and Pelated Activities: There are a number of activities typically associated with a maintenance operation, especially one of this size and soope, *ich can be detrimental to the surrounding residential area. *ile sate of these have been discussed as part of other issues, it is ipportant to note that noise, outside storage and the tiu* of proposed operations se*n particularly ino*tpatile with the area. With the orientation of overhead doors facing to the west dirtctly towards large * it can be anticipated that some deflection of noise to the surrounding area will occur. There does not apaear to be any reasonable way to mitigate this incea** noise as long as the proposed building orientation is retained. There are several areas currently proposed for outside storage of certain materials; prapably sand, some landscaping and associated materials. However, observation of other maintenance activities indicates that these storage activities are, from time to time, likely to spill over into other areas of the site and these can be particularly unattractive to surrounding residential areas if proposed buffering of fencing and landscaping is inade*uate. The proposed hours of operation *uld likely generate significant noise early in the mornurg'. This noise is not typical of residential areas; particularly as early as 6:00 to 6:30 in the morning. It a*ears that the plao*r*nt of hours restriction on the use, while enforceable, *ld be counter productive to typical operations of this sort. In general, it appears that there are a number of activities associated with the proposed use *hich *ould be inopatible with the surrounding area. *lile conditions of approval could mitigate these to some *ct*t, it is nevertheless apparent that all of them canaot be c*rpletely mitigated. Timing Problems: The proposed design is to some extent dictated by flood improvetents, both existing and proposed, for the area. The existing channel, *A*ich must be main- tained for the present, is in effect the east *dary of the project. *en new inprovetents are installed estimated to be at least a year in the future) to the west of the proposed building, the existing ittprovetents will be abandoned. It seems that the approval of this building without kna*ing the full extent of future flood inprove- ments is premature. The Applicant's apparent need for the golf course maintenance facility can probably not be adeguately coordinated with flood in*rovetents in the area. *d Vacation: There is an associated road vacation application with this project and that would have to be approved in order to aoccitxodate the preposed project. As noted in the separate report, there are problems with tuning and the pieo*nal nature of the road vacations which need to be considered. Lalliscaping at Eisenhower and Tatpico: There have previously been discussions with the Applicant *ceriing the need to i!r*rove the road right-of-way, including associated l*caping, along Eisenhower and Tampico frontages for the existing golf course facility. *ile it is difficult to directly associate such an inprovetent condition with this facility, it is nevertheless a concern that needs to be evaluated. The fire marshal would provide plan checking in a timely manner for developers. He would greatly benefit all departments as he would be available for advice and guidance on all fire related matters that come before the city. Attached for your review is a salary schedule.
