BE IT RESOLVED by the City Council of the City of La Quinta, Cali- fornia, as follows: SECTION 1. Resolution No. 82-14, which established rules of pro- cedure for Council meetings and related functions and activities, hereby is amended by amending the second paragraph of Section 3.1 thereof PRESIDING OFFICER) to read as follows: In accordance with Government Code Section 36801, the Council shall meet, after each general municipal election, on the Tuesday at which the resolution declaring the election S results is adopted, and choose one of its number as mayor and one as mayor pro tern. If such Tuesday is on a date other than that of a regular Council meeting, then the meeting shall be scheduled for 6:00 p.m. Each selection shall be by three or more affirmative votes, and a failure to achieve such total of affirma- tive votes, shall be deemed a selection of the incumbent(s) to remain in office. LANDAU 3 City Council City of La Quinta 49-499 Eisenhower Drive La Quinta, California 92253 E: Change of Zone Case No. 83-001, Landscaping Gentlemen You have requested Landmark Land Company, the applicant in the above Case, to consider the planting and maintenance of landscaping on property adjacent to the parcel of property involved in the above change of zone, which change was from R-2 to R-5. The property upon which the landscaping is requested to be installed is not owned by Landmark Land Company. It is not proper and illegal to condition a zone change unless the same condition is included in your R-5 zone and applies all other R-5 zones. Even then a condition should only be imposed when it is on the property subject to the zone change. We, therefore, decline to install and maintain this landscaping under the current addition of the same as a condition to the zone change. There are at least two alternatives available to the City of La Quinta, however, as follows. 1. The City to pay for and install the same out of tax revenues to the City. 2. At some point in the future, Landmark may be willing to bear the cost of installation and maintenance of this landscaping, provided the City is willing to reduce in an equal dollar amount the cost of both the installation and the maintenance from some other condition or commitment to be imposed upon Landmark in their overall development. The principle purpose of the proJect would be for the construction of flood control measures to protect the City of La Quinta in an area generally south from Avenue 50. The exact amount of funds necessary for the flood control project are not known at this time, but a general estimate of costs would be approximately $10 million. As the Council is aware, construction of flood control infrastructure is critically necessary to protect the community from the significant potential for major disaster. It seems that doing this through the redevelopment process is likely to be the most feasible means. The firm of Katz Hollis Coren & Associates, Inc., has an excellent record in the area of financial analysis relative to redevelopment and the quoted fee of $2,500 and a maximum of $500 for out-of- pocket expenses is a reasonable fee. I have received commitments from Landmark Land Company and Ridgeway, Ltd., to fund an amount not to exceed $1,500 each for this purpose. This advance of funds shall be considered a loan to the City of La Quinta and/or the La Quinta Redevelopment Agency, which shall be repaid at such time as the flow of tax increment funds may be sufficient to make repayment. If a redevelopment project does not seem to be feasible, and tax increment funds are not developed, no repayment shall be required or made. Adoption of a motion authorizing retention of Katz Hollis Coren & Associates, Inc., for the above purpose, is respectfully recommended. Usher, City Manager Date: April 1, 1983 Subject: Printing of Municipal Code It is necessary to have our Municipal Code printed so that it will also have an index and table of contents which will make it a more usable document, and so that we will have multiple copies for the City Council, staff and public use. Because of the significant similarities between our Municipal Code and the municipal code for Cathedral City, substantial savings may be achieved through oint printing with Cathedral City. In most cases, only the name of the city needs to be changed, except in the relatively few instances where the two cities will have adopted varying regulations. The Administrative Services Director in Cathedral City has obtained comparative figures from two muni- cipal code publishing firms, both of which I have had experience with. The conclusion is that the lowest cost would be provided by Book Publishing Company of Seattle. The total cost for La Quinta, if printed jointly with Cathedral City, would be approxi- mately $3,400. This would represent a savings of approximately $500 to each city. I believe that Book Publishing Company is a very well qualified and competent firm and the quoted cost estimate a very reasonable fee. UPDATE MARCH 1983 It in my pleasure to present to you our first monthly update, or report, which will endeavor to keep you informed of activities and events involving the Community Safety Department of the City of La Quinta. The computerized crime statistics for February 83) have been received and studied. It is very pleasing to report an overall 60% reduction in major crimes in La Quinta over February of last year 82). Burglaries shoved a 5 decrease from 8 burglaries in February 1982 to 23 burglaries in February 1983. Combined efforts of the sheriff's office and public crime prevention programs seem to be helping in this area. Traffic citations issued by the Riverside County Sheriff's Office are up +O% for moving violations and are up 50 % overall. Increased efforts by the sheriff's office are evident here, too. Over 25 vehicles were cited as abandoned which were parked in the public right-of-way or on public streets. These vehicles have since been towed away or removed by their owners. Five individuals were caught illegally dumping debris and were cited. New signs have been posted in problem areas where illegal dumping flourished indicating No Trespassing No Dumping". The signs combined with increased enforcement patrolling have resulted in very few new finds of illegal dumping. The Vehicle Abatement Program has begUm and to date nix 6) vehicles have been tagged for abatement. A contract for free" towing of those vehicles has also been negotiated and will go into effect shortly. This program will make it possible to remove old unsightly vehicles which have been wrecked, dismantled, abandoned, or dismantled on private property. BIB] 09-18-1996-U01 02:16:28PM-U01 CC-U02 04-U02 05-U02 1983-U02 "CITY SAFETY DEPAMENT MONTHLY! UPDATE, C0. PA 2 The dog licensing program is moving right along. To date we have licensed 75 dogs. On March 12 we conducted a Rabies Vaccination Clinic at the La Quinta Community Center and licensed dogs in just two hours. The citizens task force for animal control, under the direction of Marilyn Knecht, was extremely helpful in setting up the clinic and helping to license the dogs. on March 30 a surprise sweep" was made in the early morning hours by city staff and Riverside County Animal Control personnel which resulted in the capture of 12 straying dogs, 3 citations to pet owners for leash law violations, and 4 warnings for similar offenses. The Community Safety Department also aided the Celebration of the Arts event with traffic control sign placement and overall monitoring the safety of the event. We were very happy that not a single incident occurred at the event of a public safety nature. Our department also assisted the citizens task force on water quality by preparing and obtaining data relevant to the P.U.C. earing appeal. Both members of the Community Safety Department participated on the La Quinta Report Channel 10) which aired on March 6th. Members of the CSD also attended two special eminars this past month, regarding hazardous material incidents and the other one was on helicopter use for emergencies. In conclusion it has been a very busy month. A highlight not mentioned earlier, but certainly a noteworthy accomplishment, was the apprehension of tvo burglary suspects in-the-act" at the Fireside Pharmacy on March 10. Our thanks to the RCSO for another job well done. We are still waiting word from Toyota regarding our application for two free" four-wheel-drive vehicles. We should know pretty soon. WHEREAS, the City Council of the City of La Quinta has deter- mined the need for the establishment of a Traffic Safety Coittee; and WHEREAS, such a Committee would enhance citizen participation in traffic safety rnatters; and WHEREAS, the City Council desires to establish such a Committee for the purpose of advising the Council on all matters to come before it relatin9 to traffic safety of the citizens of the City of La Quinta; and NOW, THEEFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: SECTION 1. Establishment. A Traffic Safety Committee hereby is created. SECTION 2. Type of Committee and Member Qualifications. The Committee shall be an advisory body to the City Council. Five 5) of its members shall be repre- sentatives of public agencies which are involved with traffic safety, as follows: City of La Quintaity Council One Mr City of La Quinta-Staff Mrs Riverside County Sheriff's Dept.: One Mirber Riverside County Road Dept. One Meber Additionally, four 4) members shall be appointed at large by the City Council. These members shall be residents and electors of the City of La Quinta. If for any reason a member ceases to be a resident or elector of the City, his or her membership shall terminate and a replacement who is a resident and elector of the City shall be appointed. SECTION 3. Functions. The Committee's functions shall include, but not be limited to, advising the City Council on matters regarding: a) traffic hazards, b) speed control activities, c) vehicular accident data, d) speed control, e) street design and/or improve- ments, f) pedestrian safety, and q) other pertinent matters requested by the City Council. A background check was conducted on various towing agencies in the Coachella Valley and it was decided to utilize ayco Towing as our contract tow firm. Briefly, the vehicle abatement program is designed by ordinance to remove any abandoned, wrecked, inoperative, or dismantled vehicles from private property that are in public view. The vehicles, or parts of vehicles, are tagged by the Code Enforcement Officer, photos taken, and necessary documentation completed. The last registered owner of the vehicle and the legal owner of the private property it is located on are notified by certified mail that they have ten 10) days to abate the problem or they may request a hearing. If no hearing is requested, and the vehicle has not been removed from public view within the time allotted, the contract tow company removes the vehicle. Once the contract tow company takes possession of the vehicle the City is no longer involved in the future activity of the vehicle as it becomes the responsibility of the tow company. As of this date the Code Enforcement Officer has cited six 6) vehicles for abatement with many more targeted to follow. This program could do a lot to help clean up La Quinta. APPVED AS JO CONTENT.
