Audrey Ostrowsky POB 351 La Quinta, Ca. 92253 April 4, 1995 Mayor Pina and Councilmembers, Due to business affairs in Los Angeles, I have not attended all of the council meetings as was my former practice. But in spite of my busy schedule, I try to read most of the agendas. I was amazed to read that the Chamber was responding to a report on one-way traffic on Montezuma, while property owners, and businesses on Montezuma weren't consulted. Even before I investigated the Chamber's position, I saw that everything indicates that the reason the Chamber revoked my membership was because they didn't want me to express my difference of opinion. This is a clear violation of the First Amendment!. People are saying that the power structure of La Quinta, a small clique, feels because they get financial assistance from the City of La Quinta, that they must agree with the city's decisions, without CONSULTING the people who have to pay taxes for their businesses and commercial property. As an owner of commercial property, I have said that if all the businesses in La Quinta had offices in the commercial area, we would have commercial development. Last Saturday, a builder called me to purchase residential lots, and mentioned that he just bought a home for $120,000 with a storage area for his building supplies. And my former neighbor who rented a house for $550.00 a month, conducted his business from his garage. Inspite of my complaining to Mayor Pina about the exceptionally loud noises he was making manufacturing on Sunday, Mayor Pina and the sheriff said it was all right even though the laws of LA Quinta state that loud noises are illegal on Sunday. Yes, why should builders and other businesses buy commercial property when they can illegally conduct their businesses and keep their equipment and supplies at their homes? Some of the Board of Directors as well as regular members of the Chamber of Commerce do this. Why did the city hire architects for the City Hall and Senior Center who don't have business offices in LA Quinta. In fact, the same former Planning Commissioner who was busy telling other developers what to do, has his business in Indian Wells. Also, the attorney who wrote the letter to me from the Chamber has her office in Palm Desert. Why haven't you asked about the effect on business at the Video store on Montezuma, and Isabel the florist, who are struggling to stay in business due to the one-way street? What about the Art Foundation's partial closing of the street, doesn't that effect the stores too? Why doesn't Roger Hurdler investigate your friends who illegally have businesses and supplies at their homes? Why won't he review my attorney's letter on the city's obligation to stop parking on my commercial land during the Arts Festival? In closing, as I told your city attorney, as one of the owners of commercial land, we feel that you should respect our wishes to be heard, and give us the courtesy to have input in the decisions making that affects our investments BEFORE decisions are finalized. As taxpayers on businesses and commercial property, we certainly want to make positive suggestions that will bring added income to La Quinta. It is exactly two years ago, that I told you I was going to have streets, and sewers on my residential property, and I did get them. It is very painful for us to recall the fate of several woman who previously owned valuable La Quinta property, because what we feel is unfair actions of the La Quinta City Council. FISCAL IMPLICATIONS: The estimated cost to complete Phase I of a Community P? Feasibility Report is $10,000. The estimated cost to complete a Community Pool Feasibility Report Phases I and II) is $20,000. It is proposed that funding for the Community Pool Feasibility Report come from the Fritz Burns Community Park Project Phase I fund. There are adequate funds available to support the costs associated with the preparation of the Community Pool Feasibility Report. BACKGROUND AND OVERVIEW: On March 21,1995, the City Council reviewed a Department Report of the City Manager updating Council on the progress of the Fritz Burns Park/Pool Projects. During the course of discussion by Council regarding the pool, staff was requested to further develop the use of an independent consultant to prepare a feasibility report that would further analyze the pool needs and on-going costs for a City pool facility. Since March 21, 1995, staff has discussed this issue with Berry man & Henigar B &H) the consultant used to prepare the City's annual Landscape and Lighting District Engineer's Report). RECOMMEND?ON: Adopt Resolution No.95- a Resolution of the City Council of the City of I? Quinta endorsing the concept of a Coachella Valley NAFTA Rail Corridor. FISCAL IMPLICATIONS: Adoption of this Resolution will not result in any direct fiscal implications to the City of La Quinta. BACKGROUND AND OVERVIEW: On March 21, 1995, the City received a request from Coachella Valley Association of Governments CVAG) to endorse the concept of a Coachella Valley North American Free Trade Agreement NAFTA) Rail Corridor Attachment 1). The Rail Corridor is an alternative solution to the estimated 2,500 trucks per day traveling the Coachella Valley's surface streets and highways, thus reducing air pollution and traffic congestion. It is proposed the Coachella Valley NAFTA Rail Corridor" include a double track rail system from Calexico to Riverside to effectively allow containerized cargo shipments through this area. On March 27, 1995, CVAG adopted 95-002, a Resolution of the Coachella Valley Association of Governments endorsing the concept of a Coachella Valley NAFTA Rail Corridor. Other jurisdictions in the Coachella Valley are considering adopting similar endorsement resolutions. However, to date, none have been adopted. FINDINGS AND ALTERNATIVES: Adoption of Resolution No.95 would express the City Council's endorsement of the proposed Coachella Valley NAFTA Rail Corridor at this time. FISCAL IMPLICATIONS: None at this time. BACKGROUND AND OVERVIEW: On October 4, 1994, Council approved an allocation of $5,000 from the Art in Public Places Fund to support an on-going program in conjunction with the La Quinta Arts Foundation called Youth Art Works on Public Lands". At that time Council approved the Art in Public Places Committee's recommendation additional information provided in City Council staff report-Attachrnent 1) for the EisehhowerlAvenida Colima Minl Park as the location for the first project. It was explained, at that time, that what the students would be installing would come back before the Council for their approval. Since that time, the Foundation has received additional funds for the project no additional funds are being requested of the City). Subsequently, the Foundation requested the project be expanded. The Foundation presented a request to the APP Committee to relocate the project to the Bear Creek Bike Path. The project would still utilize local teenagers, with local artists assisting in the designing and creation of the covered rest stops along the path. The covered rest stops would be three dimensional and would provide shade at different locations. The location and number of stops to be constructed would be determined after a design and costs had been determined. This design would then be presented to Council for their approval. The Foundation plans to hold a community meeting where the project would be explained in more detail. The high school students selected for the project would be required to do a historical and geographical research of the City La Quinta and collect artifacts to be used in the structures. FISCAL IMPLICATIONS: None at this time. BACKGROUND AND OVERVIEW: The consultant services selection process as defined in Resolution 93-28 Attachment 1) provides for a request for proposal process or the renegotiation of existing consultant services agreement. Further, Resolution 93-28 provides the procedures, rules and regulations that shall be applied to the selection of firms and award of contracts which are not subject to the formal bidding procedures prescribed in subsections 3.12.120 through 3.12.260 of the La Quinta Municipal Code. The City of La Quinta has utilized the services of Conrad and Associates for professional auditing service, specializing in local government auditing, for approximately three years. In addition to auditing the financial statements of the City, Conrad & Associates performs a financial and compliance audit of the Redevelopment Agency in accordance with guidelines issued by the State Controller's Office. They perform a single audit on federal financial assistance, and review the internal controls of the City each year to report any deficiencies. It is staff's opinion that Conrad & Associates' performance in the course of these duties over the last three years has been exemplary. The firm has provided services in accordance with the requirements of the City and have presented invaluable recommendations as a result of internal control reviews. DEPARTMENT REPORTS: b- * MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: TOM HARTUNG, BUILDING & SAFETY DIRECTOR 4 DATE: APRIL4,1995 SUBJECT: UPDATE ON CITIZENS ON PATROL PROGRAM At the March 7, 1995 City Council meeting a number of citizens voiced their concern regarding recent gang activities that had taken place in the Cove area. After that meeting a sign up list of people interested in reactivating the Citizens on Patrol Program was circulated and approximately 25 individuals volunteered to participate in the program. Patrols were initiated on Friday, March 1 Oth and have continued on every Friday and Saturday night to date. Typically there are 3-5 two person teams patrolling from 8:00 p.m. to 1:00 a.m. on the weekend evenings. An extra duty deputy in addition to the three normally on duty) has been assigned to work with the group and to respond directly to incidents that the citizens report. The radios donated by the Rotary Club of La Quinta several years ago are being used for car-to-car communications. It is important to note that the program is being set up as an independent 501 3(c) entity and not a City run program. Volunteers eventually will be registered as Sheriff's Volunteers and operate much the same way that the Sheriff's Posse does, in that they will establish their own By-Laws, elect Officers, conduct fundraisers, etc. It is also possible that the organization could expand into other areas such as volunteer assistance du?1ng times of natural disasters. It is envisioned that the organization could become an important support function to the Sheriff's Department just as the La Quinta Volunteer Fire Department supports the Riverside County Fire Department in the City. To date the volunteers have had one organizational meeting at the Civic Center at which time they elected Officers and discussed the general direction of the program. Captain Dye attended the meeting and provided draft By-Laws as well as information on obtaining non-profit status through the State. A second organizational meeting is scheduled for March 30, 1995. Currently 30 citizens have volunteered to participate in the program. Although the group is primarily comprised of Cove residents at this time, the organization welcomes participation from other areas of the City. The Chamber will be providing a space at future street fairs for the organization so that they may solicit additional members. Solicitation of names will begin May 1,1995 and will be advertised in the May Chamber of Commerce Newsletter and newspaper press releases. Over the 30 day solicitation period, the Parks and Recreation Commission will collect the submittals of park names. Cosper, PuMic Works Director?City Engineer Date: April 4,1995 Re: Chamber of Commerce response to one-way traffic on Montezuma On February 21, 1995, the City Council reviewed a Department Report regarding the one- way traffic circulation pattern on Avenida Montezuma Attachment 1). The report indicated that the circulation pattern had been in place for approximately one year without incident. The Council requested the Chamber of Commerce to re-address the one-way traffic circulation pattern to confirm that the circulation pattern was not creating an adverse condition for businesses located in the general area. On March 13, 1995, the Business Development Task Force for the Chamber of Commerce discussed this issue. The Task Force determined, at this point, the traffic pattern appears to have been successfully implemented without incident. However, the Task Force indicated that property values may be affected by the traffic pattern. Attachment 2 is a copy of the memo received from the Chamber of Commerce outlining the March 13,1995 meeting. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: Case History This plot plan request was originally approved by the Planning Commission on May 11, 1993, and accepted by the City Council on May 18, 1993. The approved plans allow a three story medical office building, additional retail/office buildings, and a multi-level parking structure. Planning Commission Approval On May 24,1994, the Planning Commission conducted a pu?ic hearing on the request for a one year extension of time Attachment D. Modifications to the original Conditions of Approval were made. The changes were necessary because the Washington Street dedication had not been made by the applicant(s). The Planning Commission determined that the one year extension should be allowed based on the State's current economic environment. The anrnng Commission voted 3-1 Commissioner Adolph voted no) to approve the applicant's submittal pursuant to amended Conditions of Approval Attachment 2). Appeal Request The applicant is not appealing the one year time extension approval, but is requesting that the City Council reconsider seven of the Planning Commission's amended Conditions Conditions 2, 38, 39, 40, 43, 44, and 48).
