The intersection of *Montezuma*a and Navarro marked A' on the en- closed map) has been the scene of two recent accid- ents. One or more traffic signs are needed to better control the intersection. As it stands now, a vehicle proceeding west on *Montezuma yellow line B') could collide with a vehicle traveling east on N. *Montezuma red line C'), because both would feel they have the right of way. Normal procedures of studies, surveys, etc., will take too much time in this instance. immediate action must be taken in order to possible sid save lives and perhaps save the city a lawsuit for allow- ing a hazardous situation to exist. I would suggest a yield or stop sign be erected in the vicinity of the greed sic] dot D' on the enclosed map. This should effectively solve the probl*n, at least for the time being. You are certainly invited to attend. I would also like to inform you that the La QLiinta Traffic Safety Ccaaittee currently has a vacant position. The City Council is accepting applications for that position if you are interested. Regarding your ccrtr[*ts on the traffic situation at *Montezuma and Navarro, I would like to ccn*t as follows: 1. The Traffic Safety Ca*ittee is preparing a lengthy report on traffic related problems*S throughout La Quinta for presentation to the City Council. That report will address the situation you have reported in your letter, as that matter has already been studied. 2. The records indicate that there have been three accidents at this inter- section since the City incorporated 5-1-82). on 6-6-83 at 10:30 PM. there was a two vehicle accident with no injuries. The cause of that accident is un]**n as it was a hit and run. This lends itself n*re to wreckless driving than a traffic. design problem*.) on 11-25-83 at 9:35 P.M. there was a two vehicle accident with four minor injuries. The cause of that accident was failure to yield the right*f-way and unsafe speed. On 12-22-83 at 3:15 P.M. there was a two vehicle accident with no injuries. The cause of that accident was failure to yield the right*of-way and it involved a stolen vehicle which hit and ran another vehicle. Under the California Vehicle Code this would necessitate yielding the right- of**ay to eastbound traffic on *Montezuma north). Bonner, Principal Planner** Date: February 7, 1984 Subject: TENTATIVE TRACT MAP NO. 19458, A Request to Divide a 154.5 Acre Site Into Lots for the Purpose of Constructing 894 Statutory Air Space) Condominiums. Property Located at the Northeast Corner of Washington Street and 48th Avenue Alignment; VTN Consolidated, Inc., Applicant. At its January 10, 1984 meeting, the Planning Commission voted unanimously to recommend to the City Council approval of the Isla Mediterranea project as proposed by Mervyn Johnson. At the January 3, 1984 hearing, the City Council voted to approve the related general plan amendment to allow a maximum of six units per acre on the site; however, the change of zone request was continued to February 7, 1984 to allow the City Council time to review the proposed tentative tract map and development plan. Tentative Tract Map No. 19458 was introduced to the City Council at its January 17, 1984 study session. At that meeting, Jim Johnson, City Fire Marshall, and John Lower of Berryman and Stephenson, traffic consultant for the City, were present to discuss the project. Proposed Change to the Proposed Tract Map The Applicant is proposing a minor change to the tentative tract map which was approved by the Planning Commission and introduced to the City Council. The previous map proposed individual lots for each of the dwellings on the lakeshore" or perimeter of the project. The Applicant now proposes to change these units to statutory air space) condominiums, whereby only the units of the buildings are sold while the land underneath remains in common undivided ownership. The number of total lots will be reduced from 555 to 107. This will have no effect on the density or the size, design or location of the proposed buildings. The Applicant is submitting the amended map in response to a recent change in the City Fire Marshall*s construction standards for the firewalls which are required between the attached single-family dwellings built on individual lots. A firewall is a specially constructed wall or separation designed to resist the spread of fire from one unit to other portions of the building. C. B. Prior to designing the buildings and submitting the tract map to the City, the Applicant received approval from the City Fire Marshall to construct the type of firewall which extends above and out on either side of the common wall between units underneath the roof, thereby preventing the spread of fire through the attic. This is the type of firewall required in statutory condominiums such as the Duna La Quinta condominiums on 50th Avenue.) After the Planning Commission approved Tentative Tract Map No. 19458, the Fire Marshall and Building Official determined that the lakeshore units as originally proposed would require parapet firewalls. Unlike the other type of construction, parapet firewalls extend from the common wall through the attic and above the roof line an example of this is the duplex under construction at Eisenhower Drive and Avenida Montezuma). Because this new standard would drastically change the appearance of the units, the Applicant is requesting that the lakeshore units be changed to statutory condominiums to allow the construction of the previously approved type of firewall which is located underneath the roof. This change to a statutory condominium plan for the lakeshore units will not result in a reduction of fire safety; both types of walls are designed to contain a fire for two hours. Neither the City Fire Marshall nor the Building Official have any objections to the proposed map amendment. James Longtin, the City Attorney, has stated that this amendment is a minor change and therefore need not be referred back to the Planning Commission for its consideration. Staff recommends that the amendment be approved to allow for the construction of the units as originally designed, and the addition of the following condition: 12(f) Firewalls shall be required in accordance with the requirements of the Uniform Fire Code in effect at the time of this tentative tract map approval. Additional Comment At the City Council study session on January 17, 1984, comments were made regarding the need for constructing Adams Street north of the project to Highway 111. The Applicant has agreed with this requirement. Staff recommends that the City Council add the following condition: 22. The Developer shall participate in the construction of Adams Street between Highway 111 and the northern project boundary as follows: a. If the above described section of Adams Street is not constructed prior to the developer installing Adams Street half-width improvements adjacent to the project boundary, then the developer shall install the Adams Street part-width improvements in accordance to City standards. The attached staff report to the Planning Commission provides the background information about the site and zoning and proposed development in the surrounding area. Following staff's recommendation, the Applicant originally requested R-3 zoning on the 28.8 acre site of the proposed hotel. At the Planning Commission study session held on January 9, 1984, the following two major concerns were raised by the Commission regarding the requested rezoning to R-3 General Residential): While construction of the hotel requires R-3 zoning, the Commission did not want to set a precedent for additional R-3 zoning in the area. This was a major concern since the R-3 zone permits a number of commercial uses e.g. offices) which are not compatible with the low density single-family residential development which will occur in this area. o While this destination resort hotel as designed is compatible with the area and probable adjacent future development, the Commission did not want to set a precedent for additional motel or hotels on 50th Avenue. The Planning Commission directed staff to consult the City Attorney regarding the above concerns. The City Attorney recommended that the lisp" Specific Plan) suffix be added see attached memorandum); this would require that any development approval would require a specific plan development plan) which would be subject to the review and approval of both the Planning Commission and City Council. This is the same procedure currently being followed in Cathedral City. The R-3/Specific Plan zoning designation accomplishes the following advantages: o The Specific Plan" addendum is a legal means for the City to limit the types of uses permitted within the R-3 zone. The restaurant will be open to the public however, it is being operated primarily for the convenience of the hotel guests. The proposed recreational facilities will include six 6) pools, a guest library and an outdoor theatre; the Applicant has stated that the guests will also have the use of the La Ouinta Hotel Golf and Tennis Club facilities. This proposal was submitted concurrently with Change of Zone Case No.83-005 requesting R-3 General Pesidential) zoning for the hotel site. The proposed hotel is consistent with the requirements of the *inicipal Zoning Ordinance, Section 21.39, regarding accessory commercial uses operated as a part of a resort hotel see attached). The restaurant c*rises approximately 10% of the total ground floor area of the hotel excluding garage area), which is below the maxb]rn 20% allowed. In addition, the seating capacity of the restaurant 85 persons indoors, a total of 150 persons both indoors and on the terraces) indicates that the size of the restaurant is reasonable with respect to the number of hotel units. Intensity of the Proposed Use Although a hotel is a c*rcial use, this project as designed is a very low intensity use. The density of the project is only two ro*ns per acre, which is below even the maxirtu* residential density of three dwellings per acre allowed by the general plan. Another indicator of land use intensity is the percentage of the lot developed with structures; less than 8% of this site will be covered by buildings. As a point of reference, Tract 18767 Duna La Quinta) approved by the Planning Commission had a density of three 3) dwellings per acre with 19% of the site covered with buildings. In addition, it should be noted that this project is designed as a destination resort, where people ccce to stay on vacation rather than only stay overnight during their travels. Oonseguently, this type of hotel provides for a far higher level of amenities and recreational facilities than a standard hotel. In addition, because of its nature as a destination resort, with its guests staying more than one night, this type of use generates less traffic than a conventional hotel. With incorporation, this responsibility now becomes the responsibility of the City of La Quinta, and the Water District has formally requested that the City accept the bridges. This is the procedure normally followed with new bridges in all cities because the maintenance of the public right-of-way is a municipal responsibility. The proposed resolution would be based upon the previously supposed authority of the City under CEQA to formulate special measures to mitigate adverse environmental impacts brought about by residential development. The power to do this with regard to school impact fees has been thought to exist under the City's general police power" granted by Article II, Section 7 of the California Constitution. However, at the time the subject was presented to the Council on January 16, 1984, neither Dallas Holmes nor I had become apprised of the decision of the Court of Appeal, Fourth District La Quinta is in the Fourth District) in the case of Candid Enterprises, Inc., vs. Grossmont High School District. 12-21-83). A copy of that decision is attached hereto for your information. The court held that the subject of school impaction fees is preempted by Government Code Sections 65970 to 65981. Under the holding of that case, the result is that any school impaction fee must conform to the requirements of those sections. This court decision combines with Public Resources Code Section 21004 which took effect 1-1-83) to say that CEQA does not provide any different independent method of imposing this kind of fee. You will note that the resolution proposed by Dallas Holmes for adoption by the La Quinta City Council does not conform with Government Code Sections 65970-65981. Therefore, it could not validly be adopted in its present form if the Candid Enterprises case represents the final rule. It is possible, of course, that the case may be further appealed to the Supreme Court, but in the meantime the City's appropriate course of action in adopting or not adopting the fee in the form proposed, will have to be closely considered. Box 1504 La Quinta, California 92253 Dear Frank: Thank you for taking the time to talk with me regarding the possibility of developers' fees in the City of La Quinta. Since we met with the city council at the study session, a court decision relating to devel- opers fees has been handed down by the Fourth District Appellate Court. This decision, if it stands, places a cloud over the possibility of developers' fees within the state. It is my understanding that the Grossmont School District appealed this decision to the California Supreme Court last week. We will know within thirty days whether or not the Supreme Court will hear the case. Obviously, to request that the La Quinta City Council take action on developers at this time would be inappropriate. In discussing this matter with our school board, it is their decision not to place the La Quinta City Council in a potentially awkward situation. Therefore, we are requesting that no action be taken at this time, but that we await developments in the judicial system. In the meantime, be assured that we are continuing our work to build a school in La Quinta. We wish to work very closely with you in determining the location for that school. To that end, I will contact you in the next few days to discuss possible specific sites.
