A G R E E M E N T
(Relating to Developer Street Improvements Obligation)
THIS AGREEMENT, made and entered into this 28th day of March ,
19 84 , by and between the CITY OF LA QUINTA, STATE OF CALIFORNIA, acting by and
through the City Council, who are duly authorized, hereinafter designated as City,
and Rick E Johnson hereinafter designated as
Developer.
WHEREAS, Developer has incurred certain street improvement responsibilities as
specified by City Ordinances and Plot Plan approval in connection with
Plot Plan No. 84-052, Single -Family Residence ; and
WHEREAS, Developer's responsibility for installing street improvements on
53-345 Avenida Ramires, La Ouinta, CA 92293 consists of
the installation of 50 lineal feet of concrete curb and gutter and 500
square feet of connecting A.C. pavement to City Standards; and
WafREAS, Developer has requested the City perform the installation of street
improvements as part of a Public Works project; and
WHEREAS, City has determined that deferment of construction of said Developer's
street improvements obligation will most enhance the public safety and general welfare
because of the following circumstances;
Will allow the City to perform the engineering and install the improvements on a
block -by -block basis.
Will allow the City to install street improvements in conjunction with an areawide
drainage plan.
MD4%7, THEREFORE, it is agreed between the parties as follows:
1. Developer shall deposit with the City a cash payment in the amount of
$ 10.00 per lineal foot of curb and gutter and $ 1.00 - per square foot
of paving to be installed, said amount being a total of $ 1,000.00 Said cash
payment to be provided by Developer at the time of execution of this contract.
2. City shall use said cash payment, to install Developer's street improva"TlP._nts
obligation in connection with a City Public Works project at a time and in a manner as
determined by City to be in the best public interest. Developer hereby agrees that he
will not request that City install said street improverrnts at a time earlier than that
determined by City to be in the best public interest.
