The United State Bureau of Land Management has or will acquire fee simple to that certain real property located in the City of La Quinta, County of Riverside, State of California, of approximately Five Hundred Sixty (560) acres in size, and more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference ("Donor Parcel'). In connection with such acquisition, W. C. Lusardi,�the seller of the Donor Parcel ("Transferor"), has reserved to himself in perpetuity the development rights and credits described in paragraph 2, to be transferred to one or more specific receiving parcel(s) of real property within the City of La Quinta in accordance with the La Quinta Municipal Code. 2. As a result of the transfer described in paragraph 1 above, the number of dwelling units which may be permitted on the Donor Parcel by the City of La Quinta by virtue of the General Plan Land Use and Density Designations has been reduced by One (1) dwelling unpt per ten (1.0) acres, for a total reduction of Fifty -Six (56) dwelling units. As the owner f the Donor Parcel, the Transferor hereby acknowledges that all development rights of the Donor Parcel have been extinguished and that no further rights or entitlements to construct residential improvements on the Donor Parcel shall be granted by the City of La Quinta in perpetuity. The number of dwelling units which may be permitted on the Recipient Parcel(s) by the City of La Quinta has been increased by a total of Fifty -Six (56) dwelling units, subject to the restrictions as set forth in Chapter 9.145.060 (or other applicable sections) of the La Quinta Municipal Code. 1 24323 1 3. Transferor is also the owner of certain real property located in the City of / La Quinta, County of Riverside, State of California, of approximately One Hundred Sixty (160) acres in size, anmore particularly articularly described in Exhibit "B" attached hereto and X incorporated herein by this reference ("Recipient Parcel"). Recipient Parcel is a subdivided portion of the same property as the Donor Parcel, Quinta 1s located below Munic pal Code. Upon identification of the additional Recipient Parcel(s) by the Transferor, there shall be recorded with respect to such Recipient Parcel(s) the right to develop Twenty (20) additional dwelling units, pursuant to the document required by Section 9.146.025 of the La Quinta Municipal Code within the time set forth in Chapter 9.146.020 of the La Quinta Municipal Code. No transfer of development rights shall be effective until such document, duly executed by the City, is recorded. 5. The above described and referenced transfer and corresponding increase and decrease in development rights and credits shall be appurtenant to the Donor Parcel and the Recipient Parcel(s) and shall be binding upon the respective successors and assignees of the Transferor.
