3; THE DESIGN AND CONSTRUCTION OF A TRAFFIC SIGNAL AT
4; FRED WARING DRIVE AND WASHINGTON STREET
5;; THIS AGREEMENT is between the County of Riverside (COUNTY) and
6;; the City of La Quinta (CITY) to provide for the Project (PROJECT)
7;; to design and construct a traffic signal and highway lighting
8;; system at the intersection of Fred Waring Drive and Washington
9;; Street.
10ii WHEREAS, a portion of this intersection lies within the
11;; incorporated limits of the CITY and the remaining portion lies
12;; within the COUNTY, and
13;; WHEREAS, the COUNTY and the CITY desire to complete the PROJECT
14;; to design and construct a traffic signal and highway lighting
system at the intersection of Fred Waring and Washington Street.
16ii IT IS AGREED:
17;; 1. COUNTY, through its Road and Survey Department, will provide

18;; design and construction engineering for the PROJECT. Design
19;' engineering consists of preparation of plans, specifications,
20; and documents. Construction engineering consists of
21;; construction survey, inspection, and administrative effort to
22' maintain PROJECT accounting records.
23; 2. In determining construction engineering costs, COUNTY shall
24;; keep accurate records regarding hours worked, equipment used,
25;; vehicle unit mileage recorded and administrative charges
26;; incurred, said PROJECT records shall be available for review
27;; by CITY.
28; 3. The total cost of the PROJECT which is to include design

engineering, construction engineering, traffic signal equip-
ment and the cost of the construction of the traffic signal
and highway lighting system, shall b- allocated to the CITY
and COUNTY on the basis of the portion of the project in
each jurisdiction. It is determined for this PROJECT, that
the CITY portion is 25 percent and the COUNTY portion is 75
percent of the total cost.
For the basis of this agreement, the total cost of the
PROJECT is estimated to be ninety thousand dollars ($90,000).
COUNTY upon final acceptance of the constructed PROJECT
improvements, will prepare a statement of costs and will
submit to CITY for payment within 30 days thereafter.
Upon completion of all work under construction contract and
final acceptance of completed signal installation by the
COUNTY, maintenance of the signal will be performed by COUNTY
in accordance with the signal maintenance agreement now in
effect between CITY and COUNTY. Costs of maintenance shall
be apportioned between and paid by the parties of the same
percentages as determined in Section number 3 of this
Agreement.
Any notice required to be sent pursuant to this Agreement
shall be sent by regular mail, addressed as follows:

Each party, as to any claim or liability out of any act or
