CC Resolution 2002-137 RESOLUTION NO. 2002-137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING A PLANNED SIGN PROGRAM FOR A COMMERCIAL CENTER AT THE NORTHWEST CORNER OF WASHINGTON STREET AND HIGHWAY 111 CASE NO. SIGN PROGRAM 2002-629 MADISON/P.T.M. LA QUINTA, L. L C. WHEREAS, the City Council of the City of La Quinta, California, did, on the 1 st day of October, 2002 hold a duly-noticed Public Hearing, to consider a Planned Sign Program for Point Happy Commercial Center. The project area is located at the northwest corner of Highway 111 and Washington Street, more particularly described as: PARCEL MAP 29736 WHEREAS, the Planning Commission of the City of La Quinta, California, did, on the 3rd day of September, 2002 hold a duly-noticed Public Hearing, and continued said Public Hearing to the 24th day of September, 2002, to consider a Planned Sign Program for Point Happy Commercial Center. The project area is located at the northwest corner of Highway 111 and Washington Street. WHEREAS, said Specific Plan 2000-043 has complied with the requirements of the California Environmental Quality Act of 1970 (as amended), pursuant to the adoption of Resolution 83-68 by the City Council. The Community Development Director has determined that a Mitigated Negative Declaration (EA 2000- 395) was certified by the City Council for "Point Happy Specific Plan" (SP 2000-043) under Resolution 2000-47 on May 16, 2000 and an Environmental Addendum was certified on by the City Council for "Point Happy Specific Plan" (SP 2000-043, Amendment No. 1) under Resolution 2002-58 on April 16, 2002, and that there are no changed circumstances, conditions, or new information which would trigger the preparation of a subsequent Environmental Assessment pursuant to Public Resources Code 21166. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons wanting to be heard, said City Council did make the following mandatory findings of approval to justify a recommendation for approval of said Sign Program: Resolution No. 2002-137 Sign Program 2002-629 Madison/P.M.T. La Quinta, L. L C. Adopted: October 1, 2002 Page 2 1. That the proposed Sign Program is consistent with the goals and policies of the La Quinta General Plan in that the property is designated Community Commercial which allows the uses and associated signs proposed for the properties. 2. That the proposed Sign Program is consistent with the La Quinta Zoning Code (Section 9.160.090) in that the property is designated Community Commercial with more than three planned signs for proposed for the properties. 3. That the proposed Sign Program is consistent with the La Quinta Zoning Code (Section 9.160.090 E) in that sign adjustments for additional area, additional number, alternative placements, and alternative sign types can be granted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council in this case; 2. That it does hereby approve of the above-described Sign Program request for the reasons set forth in this Resolution.
