RIGHT OF ENTITY
The undersigned Real Property owner (Grantor) hereby grants the City of La Quinta California
(Grantee), its contractors, agents, representatives and assigns the right to enter upon a portion of the
property known as:
Riverside County Assessor Parcel Number: 600-030-019
for the purpose of conducting subsurface cultural exploration on the portion of the property depicted on
attached "Cultural Work Exhibit". The exploration will consist of 17 hand dug holes, 16 inches in
diameter and up to 4 feet deep. At the sole expense of the Grantee or its contractor, all holes will be
back#illed and compacted and the ground will be returned to the pre -exploration condition to the extent
possible. In the event that any artifacts or other culturally -related items are discovered during the
exploration. the Grantee will be responsible for mitigation, removals and restoration of the land.
It is understood between the parties hereto that the field work will require between 2 and 4 weeks to
complete the study with the anticipated site exploration period being between April 10 and June 30.
It is understood that the grantee and its contractors will indemnify the undersigned and hold them
harmless from any and`all liability for bodily injury, death and property damage arising out of or in any
way connected with such use, and reimburse the undersigned grantee for all costs, expenses and loss,
including attorney's fees, incurred by them in consequence of any claims, demands and causes of action
which may be made or brought against them arising out of such use. Additionally, the Grantee agrees to
name the Grantor as an additional insured/additional protected party under its coverage through the
California Joint Powers Insurance Authority.
It is hereby agreed that the Grantee shall provide a notice to the Grantor five (5) working days in advance
of entering the property and that the termination of this Right of Entry shall be the earlier of the
completion of Grantee's exploration or four (4) weeks after the initiation of the exploration.
