TUP 2017-0013 Home Depot Christmas Tree Lot (11.20.2017)78-495 Calle Tampico La Quinta, CA 92253 760.777.7000 November 20, 2017 Mr. Russ Hallett The Home Depot 79-900 Highway 111 La Quinta, CA 92253 SUBJECT: TEMPORARY USE PERMIT 2017-0013 THE HOME DEPOT CHRISTMAS TREE LOT Dear Mr. Hallett: The Design and Development Department has reviewed and approved your request to establish a temporary Christmas tree sales lot within the Home Depot parking lot. The approval of the event is granted under Section 9.100.080 of the La Quinta Municipal Code subject to the following Conditions of Approval: 1. The Christmas tree sales lot shall not be in operation before the Thanksgiving holiday and shall be removed and the premises cleared of all debris and restored to pre-event conditions no later than January 8, 2018. Specifically, the event may be open on the following dates: November 24, 2017 – January 8, 2018; Monday through Sunday, between the hours of 7:00 a.m. and 8:00 p.m. Event setup may begin no sooner than November 21, 2017. 2. The location of the event is limited to the Home Depot parking lot. Traffic aisles shall not be blocked. 3. The facility shall not engage in the sale of any merchandise not directly associated with Christmas trees and Christmas decorations. 4. The applicant shall comply with fire prevention standards as approved and enforced by the Fire Marshal. The Fire Marshal can be contacted by calling (760) 863-8886. At a minimum, one (1) 2A10BC fire extinguisher shall be placed inside the tree sales area in an easily visible and accessible location. 5. A temporary fence surrounding the Christmas tree lot is permitted. The proposed fence shall be constructed of chain link fencing material and shall not exceed a height of six (6) feet. No other temporary structures are proposed or permitted as part of this permit. 6. Temporary lighting shall not be directed towards surrounding properties. All temporary lighting shall conform to the City’s Outdoor Lighting Ordinance; Section 2 9.100.150 of the City’s Municipal Code. 7. If portable generators are used for electricity, they shall be shielded to prevent accidental contact with guests. If extension cords are used, they shall be ground- secured to prevent tripping. Power equipment (i.e. chain saws, etc.) shall not be operated before 7:00 a.m. 8. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be maintained accessible at all times. 9. Signs shall be restricted to one banner sign per street frontage, each sign not exceeding thirty-two square feet. Banners may be placed on the temporary fence or adjacent within the parking area, but not on Highway 111. Other signs and advertising devices such as pennants, flags, A-frame signs, etc. are prohibited. 10. Adequate trash receptacles shall be provided. 11. A security guard is permitted on-site if needed during the operations of the Christmas tree sales lot. No overnight camping, either in tents or vehicles, is permitted as part of this permit. 12. The applicant shall obtain a special inspection permit from the Building Division for egress and electrical. 13. By holding this Christmas tree sale, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City’s approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized.
