The first step in the City's development application review process is to determine if your application meets the minimum requirements for processing. These requirements are listed and described in the application forms you signed and submitted as part of your application packet. Unless specifically waived, each item listed on the application forms is required to determine your application complete and acceptable for processing. It has been determined that your application, as submitted, is incomplete and cannot be accepted for processing until the following items are submitted and determined adequate for review for each listed application: Modification by Applicant: Building Elevations and Renderings Sheets - The following items shall be addressed and determined complete for review: Scaled two dimensional illustrations of all sides of each existing building. Please provide complete north and east building elevations. CEQA Requirements - The project application(s) have been determined to be exempt from review under the California Environmental Quality Act, pursuant to CEQA Guidelines Section 15301 (Existing Facilities). Therefore, in order to prepare and process a Notice of Exemption (NOE) as required under CEQA, a fee in the amount of $73.00 is required (payable to City of La Quinta). In addition, a $50.00 filing fee, payable to Riverside County, is required to post the NOE for a 30 -day review period. Staff is requiring that a physical simulation of ,,the, enclosure configuration and height be placed on the building roof in its proposed `,;,Idcation' Please] :provide a proposed methodology and schedule for set-up of this `simul'ation to the Planning Division. The view simulation of the south antenna/RRU well extension does not appear to be accurately reflected when compared with the south elevation view from the plan set (i.e. appears wider above the windows). Staff is concerned about the 7 -foot extension of the north FRP screen wall, which does not appear to be adequately represented in the submitted view simulation (appears similar in depth to the southern 3.5 -foot wall depth), and would prefer to see it modified along the parameters of the south wall screen. It appears the MW dish creates the need for the additional depth, and staff suggests investigating feasibility of relocating the dish to the central equipment area. Also, the north antenna/RRU screen wall should be "centered" along the elevation, similar to the south wall. Please contact the Community Development Department if you need to go over the outstanding items for your application. Please be advised that each resubmittal of any information determined as incomplete initiates a new 30 -day completeness review period. Once the outstanding items are received and determined to be acceptable for processing, you will receive a letter of completeness and your application will move to the second step in the City's application review process, the distribution to appropriate City departments for review and comment. As part of this request, approval has also been granted for the following related applications as concurrently filed: Modification by Applicant 2015-0007 The proposed project requires modification to the existing north and south building facades, to add fiber -reinforced polymer (FRP) screening. It has been determined that the modifications constitute minor changes that are eligible for consideration under LQMC Section 9.200.090.C; specifically, subsection C.S. These criteria were reviewed and were determined to be applicable to the changes proposed. Minor Adjustment 2015-0005 The proposed project requires an adjustment to the 40' height limit of the Community Commercial (CC) zoning district, to allow the proposed 7' 6" screen wall enclosure to exceed the height limit at an overall height of 40' 2", as shown on the approved plans for the Minor Use Permit. The proposed increase of 2" to the CC zoning limit of* 40 feet, will not affect land use consistency, nor be incompatible with or otherwise measurably impact surrounding land uses. 2. Consistency with Zoning Code. The project is consistent with the provisions of the La Quinta zoning code. The proposed increase of 2" to the CC zoning height limit of 40 feet is permissible under provisions of 9.200.040 of the zoning code governing minor adjustments, as it is well under the maximum allowable 10% adjustment (0.04%). Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. The adjustment requested falls under CEQA Guidelines Section 15305(a) as a "Minor Alterations to Land" - Class 5 Categorical Exemption. 4. Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The adjustment has no impact on health or safety issues, and will not affect physical land use characteristics in the vicinity. FINDINGS — MINOR USE PERMIT APPLICATION: 1. Consistency with the General Plan: The proposed equipment and related improvements are consistent with the goals, objectives and policies of the General Plan, in that the proposed equipment is intended to enhance community access to quality wireless communication services. Public Welfare: Approval of the new equipment and related improvements will not create conditions materially detrimental to the public health, safety and general welfare. The equipment will be adequately screened, and is mounted on o commercial roof structure which is inaccessible to the public. 3. The proposed new equipment and improvements will minimize adverse visual impacts as the proposed replacement antennas will be placed on an existing rooftop and will be adequately screened from view and access. 4. The proposed equipment and improvements are designed to facilitate continued function and augmentation of existing service capacities, without significantly modifying pre-existing conditions to maintain the service provider's objectives for coverage within this portion of the community. The building was approved by the Planning Commission on October 12, 2004. The building houses a number of medical uses, including doctors, rehabilitation specialist, and optometrist; however, leases are still available. Royal Street Communications is a relatively new applicant to the Coachella Valley and the City of La Quinta. They are currently processing this application on behalf of Metro PCS who is also new to the City and Valley. Because the applicants are new to the Valley and City existing telecommunication service through this provider is lacking. Royal Street Communications has submitted three separate Conditional Use Permit applications to provide Metro PCS service within the City in the areas of Caleo Bay, Adams Street, and Avenue 54. REQUEST: In this application, Royal Street Communications is requesting to install six (6) panel antennas, one (1) parabolic antenna and associated equipment on the roof of the La Quinta Medical Center (Attachment 2). Four of the proposed panel antennas will be placed on the eastern edge of the building, while the two remaining panel antennas and the parabolic antenna will be placed on the building's western edge (Attachment 2, pg. A-2). The proposed antennas and equipment will provide Metro PCS cellular service in and around this portion of the City. The La Quinta Medical Center is a two-story, 42,000 square foot medical building. The building's roof line is thirty-two (32) feet in height, and is surrounded by a three foot high parapet wall. The cornice walls are placed above the entrances to the building and are approximately thirty nine (39) feet in height. The existing cornice walls are an architectural element that enhances the aesthetic of the building. Both the parapet and cornice walls provide adequate and proper screening of the existing heating, ventilation and air conditioning units and equipment. Existing roof mounted equipment complies with the City's screening requirements, Section 9.100.050, and are not visible from public view. The six (6) panel antennas are approximately three (3) feet in height, and when placed on the buildings roof would be visible from public view. The applicant has proposed to construct four additional cornice walls to match the existing building's architecture and to meet the screening requirements set by the Municipal Code. The architectural additions will match the height of the existing cornice walls at the building and will be painted to match the building. The architectural additions are approximately five (5) feet in width and five (5) feet in length and are designed to add character to the existing architecture (Attachment 2, pg. A-4). PAReports - PC\2009\7-28-09\CUP 2009-119 PC Staff Report.doc 2 • ANALYSIS: The primary purpose of Chapter 9.170 (Communication Towers and Equipment) of the Zoning Code regulates the construction of new communication towers. As the applicant is not proposing the construction of a new tower, the great majority of this section- of code does not apply. The portions that due apply address compliance with applicable Federal regulations which are addressed through the Federal Communications Commission's required licensing. Since the applicant had proposed to place the telecommunication antennas and equipment on the building's roof, the applicant is required to comply with Section 9.100.050 (Screening) of the Municipal Code. This code section provides that all roof mounted equipment be screened "so that the highest point of the equipment is below the surrounding parapet wall." Additionally, the code section states that "screening enclosures shall be an integral part of the roof design and not appear as an "add-on." Based upon the information provided by the applicant, the proposed architectural cornice walls will meet the screening requirements for the panel and parabolic antennas. The walls will match the height of the existing cornice wall and will be designed and painted to match the existing walls. The proposed walls integrate well into the existing architecture and enhance the overall aesthetic of the building. The existing and proposed walls are illustrated in the photo simulation included in Attachment 1. A lease agreement between Royal Street Communications and the property owner is needed in order for the applicant to install and operate at the proposed location. Royal Street Communications will not be permitted to begin installation at the site until an executed lease agreement is provided to the Planning Department. As Metro PCS is a new cellular provider in the area, service coverage maps showing existing and proposed coverage areas were not required for this application. C«IIi7� The proposed Conditional Use Permit is exempt from the provisions of the California Environmental Quality Act pursuant to Title 14 California Code of Regulations Section 15332 (Infill Development), in that the project is located on an existing building on a site that is less than five (5) acres in size and surrounded by an area of urban development. General approval standards for all telecommunication facilities include: 1. Compliance with all federal and state statutes, including, but not limited to, FCC licensing, NIER levels, and FAA requirements; 2. Addition of the planned equipment to an existing or approved tower shall not result in NIER levels in excess of those permitted by the FCC; 3. Antennas, equipment, and all ancillary components shall be stealth to the maximum extent feasible. B. Telecommunication Tower Provisions. 1. All towers shall incorporate stealth/camouflapd design(s) to the maximum extent feasible, to avoid adverse visual impacts to the surrounding properties and the community as a whole. 2. The base of the tower shall comply with the setback standards in the underlying zoning district, except where additional setbacks under subsection (B)(7) apply. 3. Towers shall not be located within primary image corridors as designated in the general plan. 4. If a telecommunication tower is located adjacent to any of the city's designated image corridors, as identified in the city's general plan, the tower's height shall conform to the height limitations as identified in the city's general plan. 5. All new towers shall be designed at the minimum height functionally required. No new telecommunication tower shall exceed one hundred feet in height. 6. The proposed tower shall be designed structurally to accommodate the maximum number of foreseeable users, including all potential co -location scenarios. 7. All accessory structures associated with a tower shall comply with the setback standards in the underlying zoning district. 8. Any guy -wire anchors shall be set back twenty-five feet from any property lines. 9. Towers shall not be artificially lighted unless required by the FAA or state aeronautics division. 10. Existing on-site vegetation shall be preserved to the maximum extent feasible. C. Roof -Mounted and Building -Mounted Telecommunication Facilities. 1. All building -mounted facilities shall comply with Section 9.100.050 of the LQMC. 2. Equipment shall not be visible to surrounding properties. 3. All equipment shall blend or architecturally match the existing design of the building. Elements used to screen roof -mounted or building -mounted equipment shall not appear as "add-on" elements to the existing building. D. Other Facilities. Screening Required. Screening shall be provided for all nonresidential uses in accordance with this section. The planning commission may also require screening beyond that required in this section as a condition of approval for a development project if it determines that such measures are necessary to mitigate adverse visual impacts created by the project. B. Screening of Mechanical Equipment. Roof -mounted mechanical equipment such as air conditioning, ventilating units, ducting, roof access structures, etc., shall be screened as follows: 1. Screening shall be provided so that the highest point of the equipment is below the surrounding parapet wall or other screening enclosure such that the equipment is not visible from a horizontal he of sight. 2. If the building roof is visible from surrounding higher buildings, roof equipment shall be screened from such buildings via metal latticework, metal louvers, or similar features unless determined unnecessary by the decision-making authority. 3. Screening enclosures shall be an integral part of the roof design and not appear as an "add-on." 4. Solar heating equipment shall be installed or screened so that the underside of the equipment is not visible from surrounding properties. 5. Wall -mounted exterior roof access ladders are prohibited if visible from off-site or from pedestrian plazas, courtyards, or walkways. C. Screening of Facilities. Storage, trash and loading area facilities shall be screened as follows: 1. Storage Areas. All storage, including cartons, containers, materials or equipment shall be screened from public view as required by Section 9.100.120 (Outdoor storage and display). 2. Trash Areas. All outdoor trash and waste bins shall be enclosed by a solid wall not less than six feet in height in accordance with Section 9.100.200. Gates shall not open toward a public street. Landscaping or decorative overhead structures such as trellises shall be integrated into the enclosure design if it is visible from higher terrain or buildings. 3. Loading Areas. Loading platforms and berths shall be screened from adjacent streets and from residential, open space and recreation areas. D. Screening of Property. Screening of property shall be installed in accordance with the following standards: 1. Height Standards. All screening shall comply with the height standards of Section 9.100.030 (Fences and walls). 2. Abutting Residential and Open Space Areas. Screening shall be installed along all building site boundaries where the premises abut areas zoned or designated for residential or open space uses. Required screening shall be at least six feet in height except where prohibited by Section 9.100.030 (Fences and walls). 3. Parking Along Public Streets. Screening shall be installed to shield views of parking areas from public streets in accordance with Section 9.150.080 (Parking facility design standards). 4. Allowance for Grade Differential. In order to take into account the effect of grade differentials on visibility, the city decision-making authority may require increased or decreased screening than that set forth in this section if the finished elevation within five feet of the site boundary is different from that of the building site. 0 E 5. Wall Articulation. To avoid visual monotony, long straight stretches of wall or fence shall be avoided. Walls and fences shall be varied by the use of such design features as offsets (i.e., jogs), open panels (e.g., containing wrought iron), periodic variations in materials, texture or colors, and similar measures. 6. Wall Planting. Shrubs and/or vines shall be planted on one or both sides of perimeter walls to add visual softening except where determined infeasible or unnecessary by the decision-making authority. Plant spacing shall be appropriate to the growth habits of the selected plant species and shall be designed to provide interest and variety along the wall rather than creating a complete covering of the entire wall surface. Where the decision-making authority determines that screening is not required, walls may incorporate tubular steel, wrought iron or other open design. 7. Screening Materials. Screening shall consist of one or a combination of the following types: a. Walls. A wall shall consist of concrete, stone, brick, tile or similar type of solid masonry material a minimum of six inches thick. Walls shall utilize durable materials, finishes and colors consistent with project buildings. b. Solid Fences. Solid fences may be used for screening if approved by the decision-making authority. Such fences shall be constructed of wood or other materials with a minimum nominal thickness of two inches and shall form an opaque screen. All wood fencing shall be constructed of not less than a grade of construction heart or merchantable and better redwood or No. 2 and better (no holes) western red cedar, stained or painted to match or complement the adjacent wall or structure. Alternatively, if left in natural color, all wood shall be treated with a water -repellant material. c. Berms. Landscaped berms may be used for screening or in combination with walls, solid fences, and plant screens. d. Plant Screens. Plant materials, when used as a screen, shall consist of compact evergreen plants. Such planting shall be of a kind or used in such a manner so as to provide screening with a minimum thickness of two feet within eighteen months after initial installation. Permanent automatic irrigation shall be provided. If, eighteen months after installation, plant materials have not formed an opaque screen or if an opaque screen is not maintained, the planning director may require that a wall, solid fence or berms be installed. Would it be at all possible to provide revised photosimulations instead of the physical mock-up of the equipment height? Perhaps showing different angles would better help you visualize what the finish installation will look like. The only reason I ask is that often times it can be difficult to schedule and coordinate the installation of physical mock-ups at project locations, so we try to avoid this if at all possible. Of course, if the City feels this is the only way to judge the visual impact we can do our best to accommodate this request. Finally, we are looking into the feasibility of removing the MW dish altogether. If this is possible, it would solve the issue of the width of the equipment area wells. • Thank you!
