MUP97-024Century/19 MEMORANDUM TO: Susan Maysels, Deputy City Clerk FROM: Carolyn Walker, Executive Secretary lig' DATE: February 3, 2010 SUBJECT: Release of Model Home Deposit Security for Tract 27899, Marbella Susan: In researching the request for -release of Certificate of Deposit No. 128000080, in the amount of $1,000.00, 1 have. found out the following information: The two model homes were on Lots 59 (79-090 Kirsten Ct) and 60 (79-085 Kirsten CQ in the MarbeHa Development, Tentative Tract 27899. 1 have attached a map showing their I iqn. The Building A Safety Department shows that V ese two homes received "temporary final inspections° and had Correction Notices issued on each of them. (A copy of each Correction Notice is attached). I will not be able to release the Certificate of Deposit since the items on the Correction Notices were not completed and final inspections were not done. In order to release the Certificate of Deposit, Century Crowell would have to contact the Building & Safety Department to obtain applications for Special Inspections for each of these two models. The Special Inspection Fee would be $100 and would apply for each model for a total of.$200.00. Upon completion of the application for Special Inspection and final inspection and approval of the model home conversions, we would then be able to release the CD. As you uncovered, Century Crowell sold the two homes some time ago without getting the required Building Dept inspection for the conversions back to single-family homes. Although Doris Benoit of Century Crowell has been asked to arrange for Inspector access to the properties, she has not responded for almost 4 months. Greg attempted to resolve the matter with a drive-by inspection, but nothing could be concluded from the exterior. This started as a Record Request from Ms. Benoit for outstanding deposits, but regarding this one CD, the Clerk's Office has concluded its work and must now refer it to Planning to process the forfeited CD. Since it was Century Crowell's responsibility to make the corrections, and the $1000 CD was security against that work, we have to look to Century Crowell to make the arrangements for inspections in order to determine if the CD should be released. As stated below, if Century Crowell declines this request to arrange for final inspections, it forfeits the $1000 security. Please let me know how your company would like to proceed. (A copy of each Correction Notice is attached). I will not be able to release the Certificate of Deposit since the items on the Correction Notices were not completed and final inspections were not done. In order to release the Certificate of Deposit, Century Crowell would have to contact the Building & Safety Department to obtain applications for Special Inspections for each of these two models. The Special Inspection Fee would be $100 and would apply for each model for a total of $200.00. Upon completion of the application for Special Inspection and final inspection and approval of the model home conversions, we would then be able to release the CD.
