The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. A. Various public agency permits are required prior to the event occurring to insure that the event will be conducted in an acceptable manner. Health Department permits are required for all food and beverage vendors serving the event, and police and fire personnel will be on hand to assist the organizers in providing a safe environment for vehicles and patrons coming to the event. The public roadways surrounding the project are capable of handling the local patrons. No problems are anticipated which would be detrimental to the community based on the recommended Conditions. B. This project is categorically exempt under Section 15304 (Class 4(e)) of the California Environmental Quality Act (CEQA) because the outdoor event is being conducted at existing country clubs with golf courses that have adequate facilities to accommodate the daily patrons and public streets will be used to direct traffic to designated parking areas. C. Temporary signs directing patrons to the event will be displayed along various public streets in the community. The signs will be placed so that they do not interfere with traffic safety signs or other facilities (i.e., traffic signals, etc.). Sign removal will occur immediately after the event is over to guard against the signs becoming roadside debris or litter. 2. There is adequate area to conduct the event and to accommodate the anticipated attendance. A. This annual golf tournament is held in adequately designed facilities which can hold the daily patrons because various facilities will be provided such as restrooms, first-aid station, food and beverages, parking, and other facilities which provide services to those paying to attend the daily activities. The existing country club buildings and landscaping facilities which complements the other temporary improvements planned for the golf tournament. The applicant is proposing on- and off-site parking areas to accommodate guests and employees for the event. The information is on file with the Community Development Department. CONDMUP97-016/18 Page 1 of 4 CONDITIONS: The following Conditions shall be completed by January 1, 1998: 1. A Certificate of Insurance, in the minimum amount of $1,000,000.00, shall be posted naming the City and its employees as being coinsured for liabilities arising from the special event. 2. A building permit shall be obtained to construct temporary facilities such as bleachers, trailers and tents, and to provide electrical power to these improvements, subject to approval of the Director of Building & Safety. A special inspection fee of $100.00 is required. 3. Vendors who sell or serve alcoholic beverages shall obtain a license from the State of California Alcoholic Beverage Control Department. A copy of the special permit shall be given to the Community Development Department. Alcoholic beverages shall be served in paper or plastic cups. 4. Permits for temporary use structures, any open flame devices or fireworks shall be obtained prior to installation. If you have any questions, please contact Fire Safety personnel by calling 863-8886. 5. A notice shall be sent to affected Homeowner's Associations explaining the upcoming event and/or any parking restrictions, and requesting the HOA's forward this information to its residents. A copy of the notice shall be submitted to the Community Development Department. 6. The applicant shall submit a traffic control plan for the City's review. A permit for the proposed event will not be issued until the traffic plan has been approved by the City Engineer. The plan shall indicate any disruptions to the normal flow of traffic including, but not limited to, the location and nature of entries to parking areas, proposed public street routes for shuttles, and proposed pedestrian crossing locations, if any, associated with each parking area. 7. The applicant shall guarantee restoration and stabilization of all temporary parking areas, continual cleaning and maintenance of adjacent public streets and removal of temporary signs and devices after the event. The applicant shall be responsible for any costs associated with stabilizing the temporary parking areas. Conditions from each Department are as follows: Building and Safety Department 8. Portable restrooms shall be provided for patrons and vendors as required by the Building and Safety Department. Restroom facilities to accommodate the physically CONDMUP97-016/18 Page 2 of 4 challenged shall also be provided in addition 'to allowing use of the existing on-site building facilities. 9. Physically challenged parking spaces shall be provided in close proximity to the golf tournament entrances that comply with the Americans with Disabilities Act requirements. Code Enforcement Department 10. The event may be held on January 14-17, 1998, between the hours 7:30 A.M. to 4:30 P.M. (See attached). 11. Overnight camping is not permitted. 12. Temporary trash receptacles shall be provided so that trash/debris can be deposited accordingly. The site shall be left clean of any litter at the close of the event. Finance Department 13. All on-site food and beverage vendors shall obtain a City Business License. Community Development Department 14. The maximum number of off-site directional signs is 30 excluding bunting flags which is addressed separately in the next condition. The signs may be installed on January 12, 1998, and removed by January 17, 1998. 15. Fifteen (15) off-site bunting flags are permitted for this event. The bunting flags may be installed on January 7, 1998, and removed by January 20, 1998. 16. The applicant is responsible for removal of all temporary signs. A security deposit in the amount of $50.00 shall be posted with the Community Development Department to insure all signs are removed after the event. 17. All public streets surrounding the golfing event shall not be blocked or barricaded unless prior approval has been obtained from the City Council and Public Works Department. Sheriff Department 18. All designated private security personnel must be licensed by the State of California and possess a current Private Security Guard license if required by the Sheriffs Department. Riverside County Sheriffs Deputies shall be employed during the event to provide security and traffic control supervision as determined by their agency through prior contractual arrangements. 20. Any vehicles that block traffic will be towed at the owner's expense. 21. Parking attendants shall wear reflective vests and light-colored clothing. Public Works Department 22. Placement of temporary directional signs shall comply with Chapter 9.160 (Signs) of the Municipal Code. Temporary signs on public right-of-way shall not be placed closer than 100 -feet from any intersection unless specifically approved in the traffic control plan. Fire Department 23. A fire inspection is required prior to the event being held. 24. Fire lanes shall be established and/or maintained during the special event. General Conditions 25. If ground excavation is required, please contact Underground Service Alert (USA) at 1-800-422-4133. The service is free of charge provided USA is given at least two days' notice. 26. Before any cranes, forklifts, or other aerial equipment is raised, please check for existing overhead wires.. 27. All food and beverage vendors shall have a permit to operate from the Riverside County Health Department. 28. Permits from other public agencies shall be obtained as needed to comply with the above-mentioned conditions. 29. Fees for this event shall be paid unless waived by the City Council. 30. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. (collectively, "Licensor") and DESERT CILkRlTIES, INC., a California nonprofit public benefit corporation d/b/a the Bob Hope Chrysler Classic ("Licensee"). RECITALS 'ArHEREAS, Licensor owns certain parcels of vacant land in La Quinta; California, as more particularly described and attached hereto as Exhibit A (the "Property"); WHEREAS, Licensee is holding the Bob Hope Chrysler Classic golf tournament (the "Tournament") Tanuaty 14 -19, 1998 and desires to use the Property as parking lots for the Tournament; and, 'XIIEREAS, subject to the terms, covenants and conditions of this Agreement, Licensor is willing to grant Licensee a license to use the Property as parking lots for the Tournament. NOW THEREFORE, in consideration of the payment of Ten Doflars ($10.00), the mutual ��romises, terms and conditions contained herein and for other good and valuable consideration the -eceipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. GRANT. (a) Licensor hereby grants to Licensee a license to use the Property as parking lots for the Tournament beginning January 14, 1998 through January 18, 1998. Subject to the provisions contained in Paragraph l(c), Licensor shall permit Licensee to enter the Property prior to the 'Tournament, upon KSL's written approval, to complete reasonably necessary sitework to prepare Lhe Property for use as parking lots, including, but not limited to, grading, drainage and dust control. Under no circumstances shall Licensee use the Property for any other purpose. (b) The Parties acknowledge that this Agreement is revocable by Licensor at anytime, in its sole discretion, and this Agreement is of a limited nature and Licensee shall not, by reason of this Agreement, obtain any perpetual rights or interests in the Property. Licensor hereby specifically reserves and shall retain all rights in and to the Property. (c) Licensee further understands and acknowledges that Licensor does not curremly own "Parcel A-1 ", as defined in Exhibit A, and that Licensee's use of Parcel A-1 as provided herein is conditioned upon Licensor acquiring ownership of said Property prior to the Tournament. If Licensor fails to acquire ownership of Parcel A-1 prior to the tournament, all provisions contained herein with respect to Parcel A-1 shall become null and void. 2. TERM. The "Tenn" of this Agreement shall commence on the effective date hereof and shall expire January 25, 1997; unless sooner revoked by Licensor, as provided herein. (a) Licensee hereby agrees to be responsible for any and illi clean-up of any new environmental contamination and/or aggravation of existing environmental contamination (as defined by all applicable federal, state and local environmental laws) which occurs as a result of, or arises in connection with, this Agreement and/or Licensee's, or its employees, agents and subcontractors negligent act, error or omission. Licensee hereby agrees to indemnify and hold Licensor harmless from and against any and all claims, losses, damages and injuries of any nature 1A,hatsoever resulting from or arising out of such environmental contamination. (b) Licensee shall be responsible for obtaining and complying; with all necessary hermits and approvals from all applicable governmental authorities and/or homeowner associations, if any, to use the Property as parking lots including, but not limited to, local regulations governing dust control. (c) Licensor makes no representations or warrantees with regard to the location of any utilities, irrigation systems or any conditions and/or hazards, hidden or otherwise, which may be 1 ocated in or around the Property or located beneath the surface of Property. Licensee shall take whatever steps necessary to insure that its use of the Property will not adversely impact the Property in ;,my way, without limitation, such as subsidence, utilities and irrigation. (d) Licensee shall be fully responsible for the entire cost of repair and/or i-cstoration of the Property, including without limitation, removing trash and debris from the property on a daily basis and upon conclusion of the Tournament. (e) Licensee shall not cause, suffer or permit any mechanic's, materiahnan's or other liens and claims to attach to or be recorded against the Property in connection with this Agreement. (0 Licensee agrees to be fully responsible for the Property during the Tenn of this Agreement. (g) Licensee warrants and represents to Licensor that the Property shall be returned to Licensor in reasonably the same condition as it was delivered to Licensee at the commencement of this Agreement, subject to I.icensor's full satisfaction and approval, in its reasonable discretion Licensee shall immediately surrender the Property to Licensor at the end of the Term of this Agreement in said condition. 4. INSURANCE. At all times during the Term of this Agreement, Licensee shall carry and maintain, in full force and effect, at its sole cost and expense, the following insurance policies with insurance companies having an A.M. Rest & Company rating; of A or better and licensed to do business in the state of California. Such policies shall include a provision requiring; a minimum of 30 days' notice to Licensor of any change or cancellation. Licensor shall be named as additional insured on the Policies listed in Subsections 4(a) and (b) as its interests may appear and Licensee shall provide Licensor with Certificate(s) of insurance prior to commencing any activity on the Property. Licensee shall require all of its subcontractors and/or independent contractors, if any, utilized in connection with this Agreement or the use of the Property to comply with the provision of this Section 4. REVOCATION, Licensor shall have the right to revoke and terminate this Agreement at any time with or without cause by giving the Parties, their successors or assigns, twenty- four (24) I lour written notice. 6. Licensee hereby agrees to indemnify and hold Licensor, its >ubsidiaries and affiliates, their respective officers, directors, agents and employees, harmless from any ,111d all demands, claims, causes of action, damages, liabilities, liens, losses, costs, charges, penalties, abligations, judgments, fines and expenses (including, without limitation, attorneys' fees and costs) of ;very kind whatsoever, in connection with, arising out of or in any way related to this Agreement or the negligent acts, errors or omissions of Licensee or any of its employces, agents, servants, Subcontractors or invitees. 7. MTSCELLANEOUS. (a) Except as herein otherwise provided, no amendment, alteration, modification of or addition to this Agreement shall be valid or binding unless expressed in writing and sig ed by the party or parties to be bound thereby. (b) The covenants, conditions and agreements contained in this Agreement shall bind and inure to the benefit of Licensor and its respective heirs, distributes, executors, administrators, successors, and assigns. (c) This Agreement shall be governed by and interpreted in accordance with the laws of the State of California. (d) This Agreement contains the entire Agreement and understanding between the parties and there are no terms, covenants or conditions which exist other than those contained herein. Thursday is the main celebrity day at La Quinta Country Club. Trams used from this lot will go north on Calle Tampico to Eisenhower Drive, East on Eisenhower Drive to 50th Ave and drop off at the entrance of La Quinta Country Club. The lot at 50th and Eisenhower will be used the three (3) remaining days Wednesday, January 14th, Friday, January 16th and Saturday, January 17th, for general admission and volunteers. The main lot at PGA West is on Jefferson and 54th. This will be used on Friday, January 16th. The Tram would go from this lot to a drop off point on PGA Boulevard at the Arnold Palmer Clubhouse. Lot 1 across from the clubhouse will be used the off days for both general parking and volunteers. It will be used Wednesday, January 14th, Thursday, January 15th and Saturday, January 17th. La Quinta Country Club and PGA West are two of the sites of the 1998 Bob Hope Chrysler Classic, A PGA Tour co-sponsor golf tournament which raises monies for the Eisenhower Medical Center and forty other local charities. In addition to the charitable aspects of the tournament, the Classic impacts the Coachella Valley economy by more than $20 million annually. 2. The Pro -Am portion of the tournament will be held at both the La Quinta Country Club and PGA West Country Club. The schedule for both clubs is Wednesday, January 14th through Saturday, January 17th, 1998. The celebrity day for La Quinta Country Club is Thursday, January 15th and Friday, January 16th for PGA West Country Club. The crowd on these days will number approximately 10,000 people and 6,500 vehicles each day. Set up of all temporary equip- ment will begin approximately January 7th and be removed by January 21st. 3. Parking areas to be utilized are shown on the attached plans. We have marked areas to be used for parking, as well as tentative bus shuttle routes. We have asked the owners of the property shown to give us permission, in writing, to use their property. We will furnish you with proof of this permission. As has been the practice, we will place the owners additional insureds under our lia- bility policy. Mr. Greg Trousdell May 28, 1997 Page Two 4. The parking lots that are used will be soil stabilized after the event. This will be done to meet the PM -10 requirements. We are in the process of contracting for soil stabilization. Fire lanes will be maintained between every two rows of vehicles so that each has a means of exit at all times. 5. We work closely with the Riverside County Sheriff's Department and California Highway Patrol in assuring compliance with appropriate state and county traffic control regulations. 6. Food concessions is in the process of being contracted. A map of the locations of food booths has been attached. We will comply with all the requirements of the Riverside County Health Department and the County Fire Department. 7. The tournament requests permission to display banners. in the city that show tournament dates. The banners are 3' x 61. The logo banner is printed on both sides with logo and dateline. It will be hung on the left side and a 3 color fan is hung on the right side. We would display them on various palm trees and light poles. This has already been requested from Cal -Trans. The map location and picture of banners has been included. 8. Waste Management of the Desert will provide portable toilets, trash pick-up, and recycling bins. Two hundred trash cans and liners will be delivered to the ground superintendents for placement around the con- cessions areas, rest areas, and tees and greens. 9. We are working with John Duncan, American Red Cross Government Liaison Officer. He will be the disaster preparedness co-ordinator. The PGA Tour Risk Management Committee will also be involved in any natural disaster plans. 10. Additionally, we will place The City of La Quinta as an additional insured under our liability policy. The minor use permit from the City specified January 7, 1998 as the installation date. The permit from Cal Trans will allow the banners in Indian Wells to be installed "not more than two weeks prior to the event and shall be removed after the event". Rancho Mirage did not have a time limit on installation, but a date for removal right after the tournament. At Bermuda Dunes in the County the installations will be around the clubhouse only. We have just secured the release from KSL Landmark. The lot on Calle Tampico, has three owners, and the permission for the lot was becoming too difficult. The lot on Ave 52 will only be used on Thursday January 15th, which is the Celebrity Day at La Quinta Country Club. The trams to be used are from the LA County "Fairplex. Fairplex P.O. The lot at 50th and Eisenhower will be used the three remaining days, Wednesday January 14th, Friday January 16th, and Saturday January 17th, for general admission and volunteers. The trams to be used at La Quinta, will go west on Ave 52, north on Washington, and west on Ave 50 to the club entrance. The main lot at PGA West is located by the Jack Nicklaus Resort Course, inside the PGA West compound. This lot will be used on Friday, January 16th. The tram would go from this lot to a drop off point on PGA Boulevard at the Arnold Palmer Clubhouse. Lot 1 across from the clubhouse will be used the off days for both the general parking and volunteers. It will be used Wednesday January 14th, Thursday January 15th, and Saturday January 17th jee f irFl� • • Secure Horizons has signed a contract with us to sponsor the Celebrity Day at La Quinta Country Club. They did sponsor the Thursday Celebrity Day last year. Therefore we will put up the 20 x 20 canopy for them on the south east end of the clubhouse, where the spectators will enter. Bank America will also have a hospitality area at the club on the southeast corner of the clubhouse, on the patio. We will put up a 40 x 50 canopy over the patio. This is all the changes that pertain to tents. The porta-potty's for the Celebrity Day at La Quinta will, be split 4 units behind the 18th green, and 4 units on the concrete, rather than all behind the 18th green.
