BOX 1504 - LA OUINTA, CALIFORNIA 92253 CONDITIONS OF APPROVAL - FINAL MINOR USE PERMIT 98-053 GREATER COACHELLA VALLEY SOAP BOX DERBY FINDINGS: The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. A. Various public agency permits are required prior to the event occurring to insure it will be conducted in an acceptable manner. Health Department permits are required for all food and beverage vendors serving the event, and police and fire personnel will be on hand to assist the organizers in providing a safe environment for vehicles and patrons at the event. No problems are anticipated which would be detrimental to the community based on the recommended Conditions. B. This project is categorically exempt under Section 15304 (Class 4(e)) of the. California Environmental Quality Act (CEQA) because the outdoor event is being conducted on an existing public street and the areas along the race course are adequate to accommodate the participants and guests. C. Temporary signs directing patrons to the_ event will be displayed along various public streets in the community. The signs will be placed so that they do not interfere with traffic safety signs or other facilities (i.e., traffic signals, etc.). Sign removal will occur immediately after the event is over to guard against the signs becoming roadside debris or litter. 2. There is adequate area to conduct the event and to accommodate the anticipated attendance. The areas along the race course can accommodate the participants and various facilities are provided to ensure the event is successful (i.e., restrooms, first-aid station, food and beverages, parking, and other facilities). Parking areas will be provided adjacent to Avenida Bermudas on other existing public streets as required by the City Council during review of the street(s) closure permit request. CONDITIONS: The following Conditions shall be completed by March 30, 1998: Arrangements shall be made with the Building and Safety Department to inspect the site on the day of the race. A fire inspection is required for temporary structures (tents, etc.) or any open flame devices by the Riverside County Fire Department before installation and use. If you have any questions, please contact their office at 863-8886. Fire lanes shall be established and/or maintained during the special event. 3. An encroachment permit shall be issued for any signs placed in the City's rights-of- way. No signs shall be closer than 100 -feet from an intersection. Temporary signs shall be posted no closer than 5 -feet from the edge of the paved area of any public road or street and placed a minimum of 200 -feet from an identical sign. Signs in the right-of-way shall not exceed six square feet, and signs on private property shall not exceed 12 square feet. Signs placed on private property shall be installed only if authorization from the owner has been secured prior to installation. All signs shall be placed in a manner which does not obstruct traffic or street signs or other important equipment (Chapter 9.160 of the Sign Ordinance). 4. A cash bond in the amount of $100.00 shall be posted to insure that all off-site directional signs'are removed by April 7, 1998. The security deposit is refundable provided the signs are removed after the event. The Community Development Department shall receive the deposit. 5. A notice shall be given to the existing property owners and/or tenants in the immediate area informing them of the upcoming special, event and associated parking restrictions and access routes. A copy of the written notice shall be given to the Community Development Department. 6. Proof of liability insurance in the amount of $1,000,000 shall be posted with the City with its employees or representatives named as additionally insured. 7. No public streets may be blocked or barricaded for the Soap Box Derby event unless prior approval has been obtained from the Public Works Department (i.e., Encroachment Permit). General Conditions 8. The outdoor event is permitted to be held on April 4, 1998, between the hours of 6:00 A.M. and 7:00 P.M. 9. Portable restrooms shall be provided as required by the Building and Safety Department. Restroom facilities to accommodate the physically challenged shall also be provided. Temporary trash receptacles shall be provided so that trash/debris can be deposited accordingly. The site shall be left clean of any litter at the close of the event. 11. Riverside County Sheriffs Deputies shall be employed during the event to provide security and traffic control supervision as determined by their agency through prior contractual arrangements. 12. All food and beverage vendors shall obtain a City Business License. 13. If ground excavation is required, please contact Underground Service Alert (USA) at 1-800-422-4133. The service is free of charge provided USA is given at least two days' notice. 14. Before any cranes, forklifts, or other aerial equipment is raised, please check for existing overhead wires. 15. All designated private security personnel must be licensed by the State of California. and possess a current Private Security Guard license. 16. The Community Development Department may impose additional conditions, or revoke this permit, if any problems arise during the event that need special attention or consideration. 17. Parking areas for patrons and participants shall be paved. 18. Any temporary banners installed for the Derby shall be approved as to size and location by the Community Development Director. 19. Applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have, the right to select its defense counsel in its sole discretion. AGENDA CATEGORY: BUSINESS SESSION: CONSENT CALENDAR: STUDY SESSION: PUBLIC HEARING: The Greater Coachella Valley Soap Box Derby is requesting $1,200, plus in-kind services (e.g. street barricades, etc.). The City's Special Project Contingency Fund (101-101-663-000).,. originally budgeted for $25,000, currently has a balance of $3,097 (the balance of the funds having been expended or encumbered). When the Council awarded the Community Services Grants on November 18, 1997, they did not award funds to the Miss La auinta Pageant or the Friends of the La Quinta Library; however, it appeared that the Council "earmarked" funds for those organizations following further research by staff.' The funding recommendation for the Miss La auinta Pageant was $500 and the funding recommendation for'the Friends of the Library was $2,500. If the Council still wishes to hold those funds for those two organizations, the balance in the Special Project Contingency Account would. be $97. There are two other potential sources of City funding for this request: AB939 Recycling Program -Community Promotion (101-402-605-542) which currently has a balance of $7,500; or, General Fund Reserves. The Greater Coachella Valley Soap Box Derby (Soap Box Derby) sent a letter to the Mayor and Council Members requesting financial assistance for the 1998 Greater Coachella Valley Soap Box Derby (Attachment No. 1). .The Council reviewed the letter under the Written Correspondence section of the agenda on November 18, 1997 and directed that the request be agendized for consideration. The City received a similar request last year and provided $1,200 to cover the cost of the franchise fee for the 1997 Soap Box Derby. The costs for in-kind services O.e. street closure notices, barricading, etc.) totaled $2,450. Therefore, the total City financial assistance for the 1997 event was $3,650. Public Works staff has reported that the cost for the in-kind services, if provided by the City, would be the same for the 1998 event as it was for the 1997 event. The Soap Box Derby is requesting payment of the franchise fee ($�) and provision of in-kind services ($2,450) for the 1998 Soap Box Derby for a total funding request of $3,650. Although a Community Services Grant application was mailed to the Soap Box Derby, no application was received for consideration for this year's grant cycle. Thus, the Soap Box Derby has not been reviewed for funding consideration from the Special Project Contingency Account. An alternative funding source could be AB939 Recycling Programs -Community Promotion account which has a current balance of $7,500. To utilize AB939 funds, specific criteria must be followed and the Soap Box Derby's funding request letter touches on some of those areas. Staff from the Community Development Department has indicated that this event, as represented, should be eligible for A8939 funds because it promotes recycling. If the Council chooses to fund this request from AB939 funds, it is recommended that the Soap Box Derby be required to work with staff to ensure a legitimate recycling program (e.g. staff to review promotional materials, flyers, etc.). Another option would be to utilize the General Fund Reserves Account to finance the Soap Box Derby's request for funding by transferring funds into the Special Project Contingency Account in the amount of $3,650. The alternatives available, to the City Council are: 1. Approve the request by the Soap Box Derby for funding from one of the following sources: Special Project Contingency Account funds, AB939 Recycling Account funds, or General Fund Reserves Account; or 2. I would imagine our program will include (but not be limited to); promotion of the public's recycling in all our materials, use of recycled paper for all our printed materials, promoting the recycling of old soap bog derby cars, as well as the day .of the event promoting the recycling of aluminum cans, phone books and paper. Our Committee will be meeting next week to come up with a date for the 1998 event and discuss this new aspect of our race. When we have more information, we will be coming before the City Council and requesting funding for our Franchise Fee of $1,200.00, as well as the other in-kind donations made by the City in the past (1997 race cost was appx. $4,000.00). The posting of "no parking" signs and installation of traffic barricades in all areas necessary to ensure traffic safety shall be completed as required by the Public Works Department. 2. The temporary street closure will have minor impacts on the area because other streets adjoining the site are available to provide access to the immediate neighbors surrounding the race event. The City Council can grant an encroachment permit to allow activities on public streets for specific periods if legitimate reasons can be found to allow the closure and safety standards (Chapter 12.16 of the Municipal Code, Traffic - Control Devices) are provided, such as traffic barricades and "no parking" signs to ensure that the public is not at risk while attending the special one -day event. 4. Approval of the temporary street closure will not create conditions that may threaten the public health and safety needs .of the community at the various events because specific conditions will be imposed and shall be met. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows:. Section 1. That the above citations are true and correct and constitute the findings and requirements of the City Council in this case. Section 2. The City Council approves the closure of portions of- Avenida Bermudas between Calle Arroba and Calle Nogales and those interconnecting streets to the west approximately 200 -feet (Exhibit "A") from 6:00 A.M. to 7:00 P.M. subject to conditions imposed by the Public Works and Community Development Departments. Section 3. The City Traffic Engineer, or his designee, can issue an encroachment permit (Chapter 14.16 of the Municipal Code) to the Greater Coachella Valley Soap Box Derby regulating the closure of the streets provided certain traffic control standards and the Conditions of Approval for Minor Use Permit 98-053 are met. Section 4. "No parking" signs will'be posted (Chapters 12.16 and 12.32 of the Municipal Code) as required by the Public Works Director. The Riverside County Sheriff's Department will tow any unauthorized vehicle within this area at the time of the event. Section 5. In case of bad weather, the City Manager is authorized to reschedule the street closure provided all conditions of approval under MUP 98-053 are met. Section 6. A traffic control plan shall be submitted by the applicant and approved by the Public Works Department. The Greater Coachella Valley Soap Box Derby personnel shall obtain an Encroachment Permit from the Public Works Department prior to closing the streets, and install all traffic safety signs and barricades prior to the closure of said streets. TO 7:00 P.M. FOR THE GREATER COACHELLA VALLEY SOAP BOX DERBY PURSUANT TO CONDITIONS FOR MINOR USE PERMIT 98-053. APPLICANT: LUCIA MORAN, RACE DIRECTOR. There was no staff report given. City Council Minutes 7 March 17, 1998 The work in front of the schools was completed on December 2 and 24, 1997 while students were on Christmas vacation and CVWD has a _u ted their claim amount from $23,000 to $18,561. In further reviewin some background related to the claim issue, he advised that on July 21, 1 97, CVWD illegally encroached into the City right-of-way, to accelerate their wer installation work ahead of the City's overlay project on Jefferson Stree . The City then issued CVWD an emergency permit which outlined the condi ions and standard for the trench restoration. CVWD failed to complete a tandard T -section trench restoration and was notified on November 24, 997, that the trench was failing. On December 5, 1997, staff met with C D to discuss their claim for the work they did out of sequence in July 1997 to save approximately $5,000 in overlay costs. In January, CVWD complete he trench overlay work without requesting any inspections and it wasn't com leted per City standard, resulting in a "speed bump" situation. and no T -sect' n to account for the differential settlement and to prohibit water intrusion ' to the trench. Staff recommended that the City split t $18,561 cost for a cost to the City of $9,280.50, providing that CVWD c mpletes the restoration work per City standards. In response to Mayor Pena, Mr. VogYadvised that he would look into the repair work on Avenida Bermudas near thk Fritz Burns Park. In response to Council Member Atuld 1ph, Mr. Vogt advised that CVWD has tried to negotiate what the T -section be like if completed differently, instead of according to City standards. a further advised that a CVWD employee was recently told on-site that theork would have to be completed according to City standards and the employ a walked away, advising that he was instructed by his supervisor to leave th job as -is and to dono more. Mr. Genovese, City Mana er, advised that staff's recommendation is to go forward with what has beep negotiated pursuant to Council's direction and that CVWD will still be requirep to meet City standards on the project. Council Member Sniff su�ported staff's recommendation. He felt it's reasonable and fair. Council concurred. MOTION - It was m�ved by Council Members Sniff/Henderson to approve a settlement for 50%1 of the claim in question in the amount of $9,280.50, provided that CVWD completes the trench work as specified in the City standard that was provided to CVWD as part of the Emergency Permit No. 2634. Council Member Adoloh was concerned that no local contractors had bid on the project and asked if t re are any that do restriping. Mr. Vogt, Public Works Iirector, advised that there are some listed in the yellow pages, but he didn't kno why they failed to bid on the project. Council Member Adolph It the City wished to support local contractors whenever possible and aske if it would be appropriate or legal for the City to send direct notices to them hen projects come up for bid. Mr. Vogt advised that the prof ct notices are sent to F. W. Council Member Adolph questionedthe p rpose of fast -tracking the project if they're not looking for approval until April 1 `h. He was concerned that the City might get in a jam and cause more work f r staff by moving forward.too fast. Mr. Vogt, Public Works Director, advised t to get the City backed into a corner. He a wouldn't cause any additional work for staff to go forward and yet keep the requirem subdivision agreements still in effect. CONSIDERATION OF A REQUEST FOR FINANCIAL ASSISTANCE FROM THE GREATER COACHELLA VALLEY SOAP BOX DERBY. Mr. Wilson, Management Assistant, advised that the Greater Coachella Valley Soap Box Derby (GCVSBD) has requested funding in the amount of $3,650 -- $1,200 for the franchise fee and $2,450 in in-kind services. He advised that the Special Projects Contingency Fund, which has been used to fund this request in the past, does not have any funds available at this time and the alternative funding sources available are the General Fund Reserves and the AB939 Recycling Promotions Fund. He noted that certain criteria would have to be followed for the AB939 funds to be used. Lucia Moran, P. O. Box 1305, Race Director, advised that they would soon be setting a date for the event which will include a recycling component this year. They will be collecting various materials for recycling as well as using recycled materials in their promotional materials. In response to Council Member Adolph, Ms. Moran advised that they are requesting the same amount they requested last year. In response to Council Member Sniff, Ms. Moran advised that the winning cars in each division would be shipped to Akron, Ohio for the finals along with the drivers and one parent per car. Council Member Sniff believed it's a great event and supported granting the funding. Council Member Henderson totally supported the event in conjunction with using the AB939 funds. Council Member Adolph agreed. MOTION - It was moved by Council Members Sniff/Perkins to approve the request for financial assistance in the amount of $3,650 from the Greater Coachella Valley Soap Box Derby - funding to come from AB939 Recycling Program -Community Promotions Funds, contingent upon staff determining that it is an appropriate use of those funds.
