The City, and its employees, shall be additionally insured for this event in the minimum amount of $1,000,000.00. A copy of the Certificate of Insurance shall be submitted to the Community Development Department. 2. Permits from the Fire Department for temporary structures (e.g., tents exceeding 200 square feet and/or canopies exceeding 400 square feet) shall be obtained prior to installation. If you have any questions, the Fire Department personnel can be reached by calling 863-8886 (Planning and Engineering). Fire lanes shall be established and/or maintained during the special event. 3. Written notices shall be sent to property owners and occupants in the immediate area notifying them of the special event and any special parking provisions. A copy of the notice shall be submitted to the Community Development Department. 4. Obtain approval to temporarily close public streets for the event from the City Council. Your request is tentatively scheduled for the City Council meeting of March 21 st. If you have any questions, please contact Mr. Romano Verlengia at 777-7046. 5. An encroachment permit shall be obtained from the Public Works Department to close public streets and/or to place off-site signs in the City's rights-of-way. 6. The applicant is responsible for all traffic control measures and devices required by the approved traffic control plan. Under the request of the applicant, the Public Works Department will provide any or all of the measures and devices required by this condition (traffic control plan, rental of traffic control devices and setup/takedown of the devices) for fees previously established by City resolution. MUP 198 SoapBox - 39 r Additional conditions are: 7. Temporary trash receptacles shall be provided so that trash/debris can be deposited accordingly. The site shall be left clean of any litter at the close of the event(s). 8. Permission to park vehicles on private property shall be obtained prior to the event commencing. 9. Portable restrooms shall be provided to accommodate guests and volunteers. Restroom facilities shall be accessible to the physically challenged. 10. The serving of food at the event shall be subject to the rules and requirements of the Riverside County Health Department. 11. Before any cranes, forklifts, or other aerial equipment are raised, please check for overhead wires. Please note that California Title 8, Electrical Safety Orders, specifies the closest distance that unqualified electrical workers can get to electrically energized conductors. Unqualified electrical workers can get no closer than six (6) feet to Imperial Irrigation District distribution lines and no closer than ten (10) feet to transmission lines. People operating boom type lifting or hoisting equipment can get no closer than 10 feet to distribution lines and 17 feet to transmission lines. 12. If ground excavation is required, please contact Underground Service Alert (USA) at 1-800-227-2600 or 1-800-422-4133. The service is free of charge provided USA is given at least two days' notice. 13. Portable generators, if used, shall be shielded to prevent accidental contact with guests. Extension cords shall be secured to the ground to prevent tripping. 14. A maximum of 30 directional signs, not exceeding nine square feet, are permitted, subject to the provisions of Section 9.160.060 (Items C, D, and F through H). No other temporary outdoor signs are permitted unless first approved by this Department. 15. By holding the special event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This action is appealable to the Planning Commission, provided a written request and filing fee of $175.00 are received within 15 calendar days. During the March 7, 2000 City Council Meeting, City Council approved an amount of $2,700 to support the Soap Box Derby. In addition, $500 was budgeted for the Soap Box Derby Operating Materials in Account No. 101-453-703-847. The total amount available to support the Soap Box Derby is $3,200. Of the money available, the estimated allocation is as follows: Franchise Fee . $1,300 In Kind Services $1,400 Operating Materials $ 500 Total $3,200 None. On March 6, 2000, representatives of the Greater Coachella Valley Soap Box Derby applied for a temporary use permit to hold their annual event on April 8, 2000, between the hours of 5:00 A.M. and 7:00 P.M. The Community Development Department will issue Minor Use Permit 2000-198 after they receive comments from potentially effected agencies. TAMDEMCOUNCU2000\000321 g.wpd The proposed race route is identical to the route used in previous years, and requires the closure of Avenida Bermudas between Calle Arroba and Calle Nogales and closure of the side streets to the west that connect to Avenida Navarro which include Calle Arroba, Calle Colima, Calle Monterey, Calle Chihuahua, and Calle Nogales. Temporary street closures are allowed if the City Council adopts a Street Closure Resolution pursuant to Municipal Code Section 12.32. If the Resolution is approved, the Public Works Department will issue an Encroachment Permit pursuant to Municipal Code Section 12.16 that requires the implementation of traffic safety measures including traffic control signs, barricades, and other safety measures. The temporary street closure will have minimal impacts on the surrounding area because other streets adjoining the site are available to provide access to the surrounding residential properties. The affected property owners will be notified of the upcoming event pursuant to the conditions of Minor Use Permit 2000-198. Approval of the temporary street closure will not create conditions that may threaten the public's health and safety needs of the community because specific conditions will be imposed as a part of Minor Use Permit 2000-198. The alternatives available to the City Council include: 1. Adopt a Resolution of the City Council approving the temporary closure of Avenida Bermudas between Calle Arroba and Calle Nogales and the side streets to the west that connect to Avenida Navarro for the annual Greater Coachella Valley Soap Box Derby on April 8, 2000; or 2. TO 7:00 P.M. FOR THE GREATER COACHELLA VALLEY SOAP BOX DERBY WHEREAS, the Greater Coachella Valley Soap Box Derby has applied for City Council approval to close Avenida Bermudas between Calle Arroba and Calle Nogales, and the side streets to the west that connect to Avenida Navarro, for their special outdoor event to be held April 8, 2000; and WHEREAS, the City Council on the 216t day of March, 2000, reviewed and heard public testimony on this request to temporarily close Avenida Bermudas between Calle Arroba and Calle Nogales and those interconnecting streets to the west between the hours of 5:00 A.M. and 7:00 P.M.; and WHEREAS, the City Council finds the following facts and reasons to justify approval of said temporary street closure: 1. The temporary street closure is allowed based on Chapter 12.32.080 (D) of the Municipal Code which permits the City Council, by Resolution, to designate "temporary no parking" areas by placing signs adjacent to the street curb. The posting of "no parking" signs and installation of traffic barricades in all areas necessary to ensure traffic safety shall be completed as required by the Public Works Encroachment Permit. 2. The temporary street closure will have minor impacts on the area because other streets adjoining the site are available to provide access to the immediate neighbors surrounding the race event. The affected property owners will be notified of the upcoming event as required by Minor Use Permit 2000-198. 3. The City can grant an encroachment permit to allow activities on public streets for specific periods if legitimate reasons are found to allow the closure and safety standards (Chapter 12.16 of the Municipal Code, Traffic -Control Devices) are provided, such as traffic barricades and "no parking" signs to ensure that the public is not "at risk" while attending the special event. 4. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: Section 1. That the above citations are true and correct and constitute the findings and requirements of the City Council in this case. Section 2. The City Council approves the closure of portions of Avenida Bermudas between Calle Arroba and Calle Nogales and the side streets to the west that connect to Avenida Navarro (Exhibit "A") from 5:00 A.M. to 7:00 P.M. subject to conditions imposed by the Public Works and Community Development Departments. Section 3. The City Engineer, or his designee, will issue an Encroachment Permit (Chapter 14.16 of the Municipal Code) to the Greater Coachella Valley Soap Box Derby regulating the closure of the streets provided certain traffic control standards and the Conditions of Approval for Minor Use Permit 2000-198 are met. Section 4. "No parking" signs will be posted (Chapters 12.16 and 12.32 of the Municipal Code) as required by the Public Works Director, a minimum of 24 -hours prior to the event. The Riverside County Sheriff's Department will tow any unauthorized vehicle within this area at the time of the event. Section 5. In case of bad weather, the City Manager is authorized to reschedule the street closure provided all conditions of approval under Minor Use Permit 2000-198 are met. Section 6. The Greater Coachella Valley Soap Box Derby personnel shall obtain an Encroachment Permit from the Public Works Department, including a traffic control plan, prior to closing the streets, and make arrangements to install all traffic safety signs and barricades prior to the closure of said streets. Section 7. A condition of Minor Use Permit 2000-198 shall be to have Riverside County Sheriff's Department personnel on hand to assist the applicant with on-site security and provide traffic control measures needed to carry out the street closure permit. Section 8. Council Member Adolph asked about including "La Quinta" in the title since La Quinta is the only City that financially supports the event and asked if other cities are asked to contribute. Lucia Moran, P. O. Box 1305, stated she has asked other cities to support the event and that the Soap Box Derby headquarters in Akron, Ohio requires the name of the local group to reflect the geographic area involved in the local event, which includes the entire valley area. She stated the City logo will be prominent in Fox's new commercial. A brief discussion ensued wherein Council expressed their desire to have the City's name listed in some prominent manner if possible. MOTION - It was moved by Council Members Sniff/Adolph to approve the Community Services Grant request by the Greater Coachella Valley Soap Box Derby in the amount of $2,700 from the Special Projects Contingency Account.
