Box 777 La Quinta, California 92253 SUBJECT: TEMPORARY USE PERMIT 2002-334 Dear Ms. Hunt: 6 FILE COPY (760) 777-7000 FAX (760) 777-7101 The Community Development Department hereby approves your request to hold the 2002 La Quinta Arts Festival at your property on the west side of Washington Street, north of Avenue 48 from March 14-17, 2002, with a Patron Appreciation event on March 13, 2002, from 5 p.m. to 10 p.m., subject to the following conditions being completed by March 12, 2002: 1. Proof of Liability Insurance naming the City, and its staff, as additionally insured during the outdoor event in the amount of $1,000,000.00 shall be posted with the Community Development Department. 2. Permits for temporary structures (e.g., tents exceeding 200 sq. ft. and/or canopies exceeding 400 sq. ft.) shall be obtained prior to installation. If you have any questions, the Fire Department personnel can be reached by calling 863-8886 (i.e., Planning and Engineering). Fire lanes shall be established and/or maintained during the special event. 3. A notice shall be given to the existing property/business owners in the immediate area informing them of the upcoming special event and associated parking restrictions and access routes. A copy of the written notice shall be given to the Community Development Department. 4. Approval includes directional signs as submitted. An encroachment permit shall be issued by the Public Works Department for any signs placed in the City's rights-of- way. Signs in the City right-of-way shall be mounted on maximum 2 -inches by 2 - inches wood posts unless otherwise approved by the Public Works Director. No signs shall be closer than 100 -feet from an intersection. Temporary signs shall be p:\stan\Itr app mup 2002-334.wpd 4 posted no closer than 5 -feet from the edge of the paved area of any public road or street and placed a minimum of 200 -feet from. an identical sign. Signs placed on private property shall be installed only if authorization from the owner has been secured prior to installation. All signs shall be placed in a manner which does not obstruct traffic visibility, traffic or street signs or other important equipment. 5. A check (or cash) in the amount of $100.00 shall be posted with the Community Development Department guaranteeing removal of the temporary signs by March 25, 2002. The posted monies will be refunded when all on-site and off-site signs are removed as defined herein. Additional conditions are: 6. Prior to start of the event, a site inspection shall be made by City staff and the Fire Marshal to insure compliance with all project conditions. 7. Temporary trash receptacles shall be provided so that trash/debris can be deposited accordingly. The site shall be left clean of any litter at the close of the event. 8. Portable restrooms shall be provided for guests and volunteers as required by the Building and Safety Department. Restroom facilities shall be accessible to the physically challenged. 9. The serving of food and alcoholic beverages at the event shall be subject to the rules and requirements of the Riverside County Health Department and State Department of Alcoholic Beverage Control. Alcoholic beverages shall be served in paper or plastic cups. 10. All portable light standards shall not exceed the approved 12 foot height of the permanent lights nor be within 50 feet of the south property line (Laguna de La Paz). Area lighting must be adequate to permit patrons proper visibility within the festival, stage and seating areas. Temporary lighting shall not be directed toward surrounding residential properties and shall be adjusted to eliminate spillover and glare if requested by the City. Additional light poles may be approved by the Community Development Department upon request. 11. Lights used overnight for. security shall be lowered and dimmed, if possible, if deemed necessary by the City to minimize light impacts. 12. Portable generators, if used, shall be shielded to prevent accidental contact with guests. Extension cords shall be secured to the ground to prevent tripping. Noise. created by musical entertainment shall not be physically annoying to adjacent residential property owners. The applicant shall comply .with noise control standards established in Sections 9.100.210 (Noise Control) of the Zoning Code. 14. Riverside County Sheriffs Deputies shall be employed during the event to provide security and traffic control supervision as determined necessary by their agency through prior contractual arrangements. 15. If ground excavation is required, please contact Underground Service Alert (USA) at 1-800-227-2600. The service is free of charge provided USA is given at least two days' notice. 16. No overnight camping at the site is permitted. Please note City Codes do not permit overnight camping at Wal-Mart. 17. The applicant shall strictly adhere to the Air Quality Management Plan as approved for this project. This is especially critical since the parking areas will not have the gravel parking surface applied in time for this event. The applicant shall apply sufficient amounts of water during the off hours to control dust, but shall be careful not to over water, creating ponding/mud within the parking lot areas. 18. Any tracked -out or other accumulation of soil material(s) onto paved areas, whether public or private, shall be wet -swept, water flushed, or otherwise removed (no dry - sweep methods permitted) by the end of each day, and shall be kept damp during event operation hours until removed. 19. The applicant shall provide temporary "No Parking Anytime" signs at 150 foot spacing along the project frontage on Washington street to prohibit on street parking. 20. All designated private security personnel must be licensed by the State of California and possess a current Private Security Guard license. 21. Parking attendants shall wear reflective vests and carry flashlights after dusk. 22. Vendors shall obtain a City Business License. 23. By holding the outdoor event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This year we celebrate La Quinta Arts Festival's 20`h anniversary and we are very excited to be at the new location. La Quinta Arts Festival is scheduled for March 14-17, 2002, and will be open to the public for the hours indicated on the enclosed flyers. Also, on the evening of March 13, 2002 we will host a private patron appreciation event on the grounds from 6pm to Spm. We hope our neighbors will share our excitement for the 20th Annual La Quinta Arts Festival and consider being a part of the very important volunteer team at this beautiful new location. Volunteering at La Quinta Arts Festival is rewarding and fun! Because of the inexact nature of construction, and our dependency on the installation schedules of some of the public utilities, it may be necessary to utilize some temporary power and lighting sources for this event. Thus we have taken the precaution of filing a minor use permit with the City of La Quinta.
