The establishment of a parking lot and sales office associated with the model home complex for Mountain View Country Club requires a Minor Use Permit. The Community Development Department has reviewed your request for this use on Lots 149 (parking lot) and 148 (sales office) and has approved them subject to the exhibits on file and the following conditions: 1. This permit shall be binding with Site Development Permit 2002-742, which was approved by the Planning Commission on June 25, 2002, and on file with the Community Development Department, for the model home complex which Is associated with the parking lot and sales office for Mountain View Country Club.' 2. Mounted on the exterior of the sales office shall be a written notice providing emergency personnel your 24-hour emergency phone number they can call in case problems arise that need your prompt attention (i.e., minimum 1 " high letters). 5. Install one 2A10BC fire extinguisher inside the sales office and each model. 6. A cash deposit of $1,000.00, shall be posted with the City to insure the garage conversions of the model/sales office is removed within 90 days after the expiration of this permit. 7. The installation of parking lot improvements (walkways, fencing, etc.) will require review and approval by the Public Works Department. The parking lot design and improvements shall comply with Chapter 9.150 (Parking) of the City's Municipal Code. 8. Parking for handicap individuals shall comply with the American with disabilities Act provisions which require hard surfacing with proper striping and signs. 9. Dust control measures shall .be employed during construction of the parking lot and sales office. Such control measures shall include a paving the parking lot and landscaping the yards as shown on the approved Site Development Permit plans. 10. All requirements addressed in Section 9.60.250 (Model Home Complexes) of the City's Municipal Code shall be net where applicable. 11. The model home complex shall be permitted to remain until August 15, 2003, unless a time extension is applied for and granted by this Department. The Community Development Director may extend the permit for a set time period if needed. No fee is charged to extend this permit. 12. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. 13. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the "City"), it's agents, officers and employees from any claim, or litigation arising out of the City's approval of this project. This indemnification shall include any award toward attorney's fees. The. City of La Quinta shall have the right to select its defense counsel in its sole discretion. MUP 2006-944 was to "Convert Model Garage to Sales Center" and our records do not show a $1,000 deposit for that case number. However, I do find a $1,000 deposit for MUP 2002-353 which was the original "Model Complex and Parking Area". That money is still being held and I can refund it, but I would need to have you re -send your previous e-mail referencing MUP 2002-353 instead of 2006-944. Let me know if you have any information, or copies, contrary to this.
