AND MRS. JAMES CHESTER The property is located between Cameo Palms and Washington Street, south of Singing Palms Drive and developed with a single family residence (Attachment #1). The property is listed in the City Historic Resources Inventory Survey which was completed and accepted by the City Council in 1997, primarily because it is over 50 years old (Attachment #2). The Historic Survey indicates the residence was originally constructed in 1933, on the grounds of Point Happy Ranch to the north and subsequently moved to its present location. A site inspection seems to indicate the residences location is original because it has a basement. Additionally, a November, 1966, Press -Enterprise newspaper article regarding one of its renovations indicates the residence is from the 1920's and once home to one of the DuPonts (Attachment #3). No reference is made to a connection to Point Happy Ranch. There have been a number of additions and renovations done to the residence over the years, including a 1.5 story rear addition and lean-to addition on the north side. The Historical Survey notes distinctive characteristics of the residence are limited to the large curved projecting windows with fixed multiple panes and slender mullions on the east, west and south sides of the residence. The Chester's purchased the property last year with plans of expanding and remodeling the residence. The residence sits on four lots which were recently merged by the Chester's into one lot. PROJECT PROPOSAL: Their first phase includes construction of a detached structure adjacent to the Washington Street frontage (Attachment #4). The detached building is a long rectangular structure and will contain a three car garage, hobby room, two bedroom guest quarters, storage area, and enclosed, but unroofed garden area. The garage will face and take access to the Washington Street frontage road. The 14 foot high pl\stan\hpc rpt chester.wpd ., 0 • e structure is proposed to be located between Washington Street and the residence, partially to attenuate traffic noise from Washington Street. The addition is designed in a modern style and utilizes a flat parapet roof and stucco walls. Windows are only placed in the living and garden areas facing west, away from Washington Street. The owner has indicated that the existing residence will be remodeled to be compatible with this addition. . The owner has begun cleaning up and preparing the existing residence for remodeling. However, no plans have been submitted to the City. DISCUSSION: The purpose and intent of the City's historic preservation regulations are to "protect, enhance, and perpetuate historic resources, landmarks and districts that represent or reflect the city's diverse cultural, social, economic, political and architectural history". Additionally, it is to "safeguard the city's historic heritage, as represented by its historic resources, landmarks and historic districts". Therefore, the Municipal Code requires all properties within a historic district or with landmark designation to undergo review by the Historic Preservation Commission and City Council prior to alteration to the property. To help achieve these goals and comply with Municipal Code requirements, a City Historical Survey was completed. To be considered for listing the first criteria is that a residence be at least 50 years old. Each property listed in this survey,was then assessed for its degree of worthiness of preservation. The National Register of Historic Places provides a hierarchical system of categories to be used to evaluate the level .of significance of a historic resource. The highest category or level (#1) is that the resource is already listed in the National Register of Historic Places. The next two levels (#2 and #3) indicate a resource is eligible for listing and appears to be eligible for Federal listing, respectively. A total of seven levels exist. The highest listing (#3) determined appropriate for La Quinta is that a property appears to be eligible for Federal listing. The lowest La Quinta level (#5) is that a property is not eligible for the National Register, but is of Local interest. This property is neither in an adopted historic district or a designated landmark. This property was determined to be a subset of level 5 (#5S3 - not eligible for separate listing, but is eligible for special consideration in local planning). There is no definition of "special consideration in local planning". Therefore, in order to provide "special consideration in the planning process" Staff has placed this matter on the Historic Preservation Commission agenda in order to provide Staff and the applicant with direction. The Historic Survey states the only distinctive feature present today are the curved windows on the east, west and south of the residence. The original residence has been added to and renovated a number of times. This leads Staff to conclude that p[\stan\hpc rpt chester.wpd "special consideration in local planning" means complete documentation of the existing improvements and review of the future additions and remodeling are appropriate. To this end, Staff has taken a number of photographs of the residence and its grounds. A. It is unlawful for any person to tear down, demolish, construct, alter, remove or relocate any improvement or any portion thereof which has been designated a historic landmark pursuant to the provisions of this chapter, or which lies within a historic district, or to alter in any manner any feature of such a designated landmark, landmark site or improvement within a historic district without first obtaining a permit in the manner provided in this chapter. B. No board, department or commission shall grant any permit to cant' out such work on a designated landmark, landmark site or within a historic district, unless a permit has previously been issued by the city council as provided in this chapter. No application for a building permit, demolition permit, grading permit, redevelopment permit, conditional use permit, variance, development plan, zone change, tentative parcel or subdivision maps, or any other permit which would allow the addition of a designated landmark, landmark site or any improvement in a historical district, shall be deemed complete unless a permit has previously been issued pursuant to this chapter. C. No permit shall be necessary for ordinary maintenance and repair if the proposed work will not alter or change the style, color, design, features or character of the landmark site or, improvement and a*permit • is not required under Section 301(b) of the Uniform Building Code, nor does this chapter prevent the construction, reconstruction, alteration, restoration, demolition or removal of any such improvement when the building and safety department certifies to the council that such action is required for the public safety due to an unsafe or dangerous condition which cannot be rectified through the use of the State Historical Building Code. An application for a permit to do work in a historic district or on a designated landmark shall be submitted to the planning and development department on forms provided by the planning and development director. This application must include the plans and specifications for the proposed work. Within thirty days of the receipt of the complete application the commission shall review the application and shall make a written report to the city council. The city council shall hold a public hearing on the application within thirty days of receipt of the commission's report. Notice of the public hearing shall be given as provided in Section 9-+64040 of this code. B. At the conclusion of the public hearing on the permit application, the city council shall, by resolution, issue or deny, in whole or in part, any permit application. (Ord. 238 § 2 (Exh. A) (part), 1993: Ord. 207 § I (part), 1992) 7.08.030 Permit criteria. The city council shall issue a permit for the proposed work if, and only if, it determines: A. In the case of a designated historical site, that the proposed work would not detrimentally alter, destroy or adversely affect any architectural or landscape improvement; B. If the owner of a designated historical site or landmark demonstrates to the city council that such property cannot be economically used and denial of a permit would deprive the owner of all or most of his or her economic interest in the property, the council may issue the permit with an effective date one hundred eighty days from the date of issuance of the permit to allow time for the investigation of alternatives to the • work proposed in the permit application, such as acquisition of site or improvement by the city or a public interest group; 162-9 (La Quima 4-94) 7.08.030 • C. In the case of construction of a new improvement, upon a historic site, that the exterior of such improvement will not adversely affect and will be compatible with the external appearance of existing historically designated improvements in said site; D. That the applicant has presented clear and convincing evidence of facts demonstrating to the satisfaction of the city council that such disapproval will impose immediate and substantial hardship on the applicant because of conditions peculiar to the person seeking to carry out the proposed work, whether this be property owner, tenant or resident, or because of conditions peculiar to the particular improvement, or other feature involved, and that approval of the application will be consistent with the purposes of this chapter. He states no one ever told him of the City survey (I gave him a copy) and the need to go through this process for a detached improvement. He said he just got his plan check comments from Bldg. and safety and thought his MUP would be approved now that he merged all the parcels, etc. Mr. Chester reiterated that he wants to remodel the existing house to match the new detached improvements via adding a parapet although these plans have not been prepared. He states our "project delays" may kill his project and he could either hire an attorney, or abandon the project. (Mr. Chester is an owner of a local Manhattan Bagel shop; bag at front counter.). He also states that he has just finished installing new perimeter walls and is slated to do some demo work to upgrade the HVAC system, wiring, and other necessary improvements. He also just pay to hook the house an off -site sewer line. I requested a meeting with staff and he said he is very busy, but he'd be happy to meet ASAP. Regarding the City HPC survey, Mr. Chester disagrees with some of the survey material such as the house being moved to the property and he states the house has a basement and "dilapidated copper" roof. Mr. Chester further states that the ' City should have recorded the survey results and/or notified the property owners of the results. I told Mr. Chester that I've prepared a letter to explain our HPC process and that it is close to being finaled. I asked B/S for the building plans, but to date they haven't responded. Mr. Chester has verified that his plans are here and close to being ready to go. After my talk with him, he said he didn't know where he is going now. Oscar, do you want to buy his house? They bought the property in Nov. 2002. 1 checked the file and I'm asking the Chester's' to provide recordation paperwork of this matter. Now, let's talk about the MUP request. As you are aware, their request is a hybrid type project where they want a guesthouse merged with other attached buildings (3 car garage, storage, hobby room, greenhouse, etc.). Mr. Chester called to say he will drop-off the facade elevations in the next few days, but when I talked with him he said the architecture won't match the existing house because they want to build the new unit so that they can live in it while they "rehab" the main residence (circa 1933). Hence, a reverse type idea to our Code provisions, but probably something we'd want. To date, B&S Dept. has responded to my e-mail, so I'll assume Mr. Chester has only submitted the guesthouse plans during the preparation of his main house remodel. Idea: Add a condition to the MUP request that requires the main residence (over 3,700 sq. ft.) to be remodeled within one year to ensure that all building look architecturally compatible. Or, post bond? Personally, I think this guy is going to work forward on his project based on the fact that he's got an architectural firm working on his project. I think Stan spoke with him before he bought the property regarding HPC implications. I believe his exterior changes are new dual pane windows, upgraded doors, and stucco (I'll ask when he comes by.). When I spoke with Mr. Chester a few months back he said he need to remodel the kitchen as well as other "modernizing". Personally, I think his merged building, combining satellite buildings abutting the guesthouse, is OK per our Code after giving it some Zen thought. Because the guesthouse is self-serving and only affiliated with the abutting buildings via wall elements. So - What do you think???????????????? It originally consisted of 134 acres and the current project area represents a fraction ofthe original holdings. Mr. Clarke passed away shortly after. the acquisition ofthe property. Mrs: Clarke is credited with the development and maintenance ofthe date farm and the rearing of Arabian horses for personal use. Overall, the Clarkes are not recognized as individuals of note in California history. Therefore, Criterion B (see earlier discussion) cannot be applied here. The development of orchards and date farms in the deserts of Southern California can and has been identified as a significant event in California. Riverside County is recognized as an area leading the State in such developments. The Clarke property (Point Happy Date Farm) was a very small part of the developments in the La Quinta/Coachella Valley enterprises. The dates and citrus raised on this property were sold locally through a street -side fruit stand. Overall, this level of involvement does not meet the criteria of Criterion A, broad pattern in California history. The lack of a "Point Happy Date Farm" would not have impacted the developments seen in other, larger enterprises. Therefore, McKenna et al. concludes that the resources do not meet the requirements of Criterion A. Architecturally (Criterion C), there is no evidence of significant remains. Some structures.dating to the historic period have been removed from the property. Other structures have been added during the ;modern period (post-1948). Elements of the property that can be associated with the historic period, (1922 1948) reflect no unique architectural. elements and, for the most P. are `not in good condition. There ° is .not evidence to associated these structures with any known or recognized,artisan and the maintenance of these, structures does no constitute recognition under Criterion C. Overall, the Point Happy Date Farm has a local recognition, but does not meet the requirements for _ significance under CEQA guidelines. As noted earlier, there is a.potential for buried resources ofprehistoric origin. Therefore, the property should be considered sensitive for subsurface prehistoric remains. -Following the criteria for Criterion Dths project area does have the potential to yield information important to historic and/or prehistoric. Based on the findings presented above, McKenna et al. recommends clearance for the property with respect to historic resources. Because ofthe level of sensitivity for buried resources, McKenna et al. recommends that any tree removal or structural demolition be monitored by a qualified archaeological monitor. In addition, all grading of the property should be monitored to insure adequate coverage and recovery of any archaeological remains that may be identified on the property. The original portion, fronting the street, is oriented north -south and has a composition clad gabled roof with overhanging eaves and stucco walls. The original structure was built in 1933 on the grounds of the Point Happy Ranch in La Quinta and was moved to the present location. Extensive renovations occurred in 1975. A high concrete block fence surrounds the structure on its south and west sides. Distinctive characteristics are limited to large curved, projecting windows with fixed multiple panes and slender mullions set into the centers of the east, west, and south elevations.
