(MUP) 2004-458 to establish overflow outdoor seating for the Easter Sunday church services (April 11th) from 7:30 AM to 12:30 PM. Pursuant to Section 9.210.020 (Minor Use Permits) of the Zoning. Code, the Community Development Department has made the following findings: 1. Consistency with the General Plan - The church service is an .activity that is allowed by the General Plan Land Use designation for this site. 2. Consistency with the Zoning Code - The church service. is subordinate to the church use which is allowed within the Low Density Residential Zoning District. 3. Compliance with CEQA - This activity is exempt pursuant to Categorical Exception lection 1-5323 (Normal Operations of Facilities for Public Gatherings). 4. Surrounding Uses - Approval of this application will not create conditions materially detrimental to the public .health, safety and general welfare or injurious to, or incompatible with other properties or land uses in the vicinity. Based on these findings, your MUP application is hereby approved subject to the following .conditions: 1. The applicant and property owner agree to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this special event. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. 2. The applicant shall obtain a permit from the Riverside County Fire Department to install the tent structure(s). Please contact Mr. Neil Stevenson of the Fire Department at 427-9827. 3. The property shall be restored to its original condition prior to the event. Adherence to these conditions will ensure that adverse impacts to surrounding properties will be minimized.
