The following findings are applicable to the approval of this Minor Use Permit: A. The land use proposed is consistent with the General Plan, which designates the property for Low Density Residential Development. B. The use as proposed is consistent with the provisions of the Zoning Code, in that the RL setbacks and other related development standards have been shown to be in compliance. C. Processing and approval of this minor use permit is in compliance with the provisions of the California Environmental Quality Act (CEQA). This proposal represents a temporary sales office use of an approved residential use, which ultimately implements TR 31123 as previously certified under CEQA. D. Approval of this minor use permit will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. All surrounding properties are or will be developed with residential land uses, consistent with the subject property's ultimate use. E. The access, parking and circulation, as proposed with this minor use permit, will not result in excess traffic congestion or safety hazards. Enclosed are copies of approved Exhibit A. In addition, development of this use is subject to the following conditions: I 5 Mr. Richard Wasserman Page 2 01/26/2005 1. Prior to any landscape installations, provide written approval from the Riverside County Agricultural Commissioner's office, as to acceptability of plant materials for the desert climate. 2. All landscaping, irrigation plans and water use and allowance calculations shall be accepted by Coachella Valley Water District. An approved copy of these plans shall be submitted to the Community Development Department prior to any landscape installations. 3. The parking area shall be improved to the specifications of the Public Works Department, and completed prior to the temporary trailer being used for sales. Wheel stops shall be provided for all parking stalls, and shall allow for a 2 -foot forward overhang. The trailer shall be skirted, with no visible or accessible undercarriage. 4. Applicant shall post a $1,000.00 per unit cash deposit. as surety for the conversion/removal and other remedial requirements of the temporary model facilities. Conversion shall be completed within 90 days of termination of the model home and sales office uses conjunctively. 5. Install one 2A 10BC fire extinguisher inside the front exit door of the sales office. Additional requirements beyond those associated with the water systems approved for TR 30092 may be imposed by the office of the Fire Marshal for other life safety issues. Please contact the Fire Marshal at 760-863-8886. 6. This.model complex/sales office use approval is valid for one year from the date of this letter, unless an extension is granted by the Community Development Director, pursuant to Section 9.60.250.F of the Zoning Code. 7. Certain advertising features (e.g. advertising banners, pennants, flags, etc.) are prohibited under LQMC Section 9.60.250.D. All signing must comply with Chapter 9.160 (Signs) and Section 9.60.250.13, LQMC.. Any pole -mounted flags shall be governed as specified in LQMC Section 9.60.250.C. 8. The applicant/developer agrees to indemnify, defend, and hold harmless the City of La Quinta from any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion.
