Public Welfare: Approval of the new equipment for an existing telecommunication facility will not create conditions materially detrimental to the public health, safety and general welfare. 3. The proposed new equipment at the existing telecommunication facility will minimize adverse visual impacts as the proposed replacement antennas and associated equipment will occur entirely within an equipment building, designed to blend consistently with the existing adjacent building. 4. The proposed new and replacement equipment is designed to facilitate continued function of the existing antenna array, without modifying the height or other pre-existing conditions to maintain the service provider's objectives for coverage within this portion of the community. 5. The proposed new and replacement equipment is necessary to improve community access to wireless services. CONDITIONS 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the "City"), its agents, officers and employees from any claim, or litigation arising out of the City's approval of this project. This indemnification shall include any award toward attorney's fees. The City of. La Quinta shall have the right to select its defense counsel in its sole discretion. The facility has been operating since 1993 without causing any negative impact(s) to the existing uses. Verizon's facility will continue operating, and continue complying with Federal Communications Commission standards of the Radio Frequency Emissions. On August 3, 1993,. this request was a business item before the City Council as a report of Planning Commission action approving this application. On June 16, 1993, PACTEL Cellular submitted another application for a public use permit to attach antenna equipment on an existing tower in the rear yard area of the IID Headquarters on Avenue 58. This site will be leased from IID. This application was approved by the Planning Commission during a public hearing on July 27, 1993. Subsequently, the case was scheduled for the August 3, 1993, City Council meeting as a business item. This tower is Iocated in the rear yard area of the IID's compound on - Avenue 58. The applidant proposes to attach a 6 -foot in diameter microwave dish at the 60 -foot elevation above ground point, cellular array supports with antennas near the top of the existing tower, and three whip antennas at the top of the tower; adding an additional 18 -feet in total height. In addition, a 484 square foot equipment control building is proposed that will be 104eet in height. Aesthetically, this site is already impacted. The tower that PACTEL wants to place its dishes and antennas on already exists and is,100-feet tall, Photographs of this yard area are found in Attachment #4. The three 18 -feet tall whip antennas are relatively thin and will not significantly add to the aesthetic impact of the IID site. On -July 29, 1993, the City received a memorandum from the Public Utilities Commission (PUC) dated July 26, 1993. This memorandum pertains to local permitting of cellular telephone facilities and the PUC policy and procedure for siting of such facilities. This memorandum is pertinent to this application in that this is the second attempt by PACTEL Cellular to seek approval of a site for its equipment. The memorandum states that applicants who have been denied by a local agency at least twice in seeking approval of a permit for tower sites can apply to the PUC to preempt a local jurisdiction's decision. CONCLUSION: Staff has reviewed this application and concluded that the IID site is suitable as far as aesthetics and land use are concerned. The PACTEL Cellular proposal represents a shared -facility concept which minimizes the number of new towers needed in an area.
