Products sold by the vendor are limited to fresh regionally grown produce, dried fruits, nuts and other similar food -stuff items. Fresh cut flowers and other plant items may also be sold. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the "City"), it's agents, officers and employees from any claim, or litigation arising out of the City's approval of this proposal. This indemnification shall include any award toward attorney's fees. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. 2. The approval of this minor use permit allows the establishment of a temporary produce stand at the following locations and times: • Trilogy Santa Rosa Clubhouse i. Every Friday between 8:00am and 3:00pm • The Hideaway Golf Clubhouse i. Every other Saturday between 9:00am and 4:00pm • La Quinta Resort & Spa i. Every Saturday between 8:00am and 4:00pm 3. This minor use permit shall expire on May 3151, 2009. A time extension of up to one year may be approved by the Planning Director if the director finds that all requirements of LQMC Section 9.100.1 10 and all other city F requirements have been met. Upon the request of the applicant, minor adjustments to the plan of operations and conditions of approval may be approved by the Planning Director. Additionally, changes to existing conditions of approval or the addition of new conditions may be required by the Planning Director if determined to be necessary in order to protect the public's health and safety. 4. The use, as herein approved, shall be maintained in conformance with the project description, business plan, application exhibits and conditions of approval. 5. The site shall be left clean and in its original manner .after every event. Trash receptacles shall be provided so that trash/debris can be deposited accordingly. No person shall deface, abuse, or otherwise alter in any way the surrounding parking lots, buildings, plants, or landscaping. 6. The applicant shall comply with the City of La Quinta Noise Ordinance (LQMC 9.100.210). The vendor is prohibited from the use of loudspeakers, public address, radios or boom boxes, or other amplified music or speech. No loud hawking, shouting or barking to promote products is permitted. The vendor shall not harass, follow, or intimidate event visitors. 7. Permits, separate from this approval, for any temporary structures (e.g. tents exceeding 200 square feet and/or canopies exceeding 400 square feet), stages or open flame devices shall be obtained prior to their installation. Prior to the event set-up, please contact the La Quinta Building and Safety Department and Riverside County Fire Safety at 863- 8886, for any additional requirements of the Fire Marshal. Fire lanes shall be established and/or maintained during the event, as may be prescribed by the Fire Marshall. 8. If necessary, obtain a building permit for temporary electric service and any other required items (e.g. bleacher, portable generators, etc.). Contact the Building and Safety Department at (760) 777-7012 for permit requirements. 9. Portable generators shall be shielded to prevent accidental contact with guests. Extension cords shall be ground -secured to prevent tripping. Any lighting shall be directed away from surrounding roadways and surrounding residential properties. No spot or searchlights are permitted. 10. All temporary electrical wiring to any concession/vendor spaces shall be secured to prevent physical hazards to the public and participants. , Wiring/cords shall not be subjected to environmental or physical damage. Portable generators, if used, shall be shielded to prevent accidental contact with guests. Extension cords shall be secured to the ground to prevent tripping. 11. Craft vendors are prohibited. 15. The vendor shall maintain a City Business License when conducting business in the City of La Quinta. If applicable, the vendor shall obtain and properly display a California State Board of Equalization Seller's Permit for the sale of merchandise and/or products within the City of La- Quinta. 16. The vendor must understand and comply . with any and all state and federal laws relating in any manner to their goods and services. The vendor may not . sell items that are commercially available or have been purchased wholesale. The vendor is not allowed to prop or hang any merchandise, banners, or boards on any sign or light post, .wall, building or trees. 17. The vendors must remove all boxes and containers used in the transportation of their merchandise before each event begins. Empty boxes may be stored under tables as long as they are not visible, e.g., under a drape. 18. All tables used within the vendor space are encouraged to be covered and _skirted with a fire -retardant fabric, which may be either disposable or non - disposable material. The covering or skirting should be neat and clean and should not be more than two (2) inches from the ground on all sides. Products may be displayed below the booth spaces, so long as all products are kept at least six (6) inches off the ground and are displayed in a neat and clean fashion. 19. The sale of any product directly from a vehicle is prohibited. 20. If the vendor is selling products by the pound, they shall have a scale certified by the Riverside County Department of Weights & Measures. Without a certification sticker, the vendor may sell products by the pound. For more information, please contact the Riverside County Agricultural Commissioner, Indio Office, at (760) 863-8291. Please note this letter serves as the Planning Department's approval of Minor Use Permit 2008-1004, and authorizes the use of the properties as identified herein and subject to the conditions of approval listed herein. As discussed, in order to complete the review and decision on your application, a map of each proposed site identifying the location of each product stand is required. The purpose of this requirement is to specifically identify the location of each stand and assure that each complies with the requirements for outdoor vendors (LQMC 9.100.110) and does not impair any required pedestrian, American Disability Act, or emergency access way. To facilitate this requirement, I provided you this morning with an aerial photographic map of each clubhouse area you have identified as a proposed site. Identification on these maps of where each stand is to be located will meet this requirement. In addition to the site maps, it is my understanding that you will also bring in a revised description of your operations ,'including days and hours of operation, on Monday. As we discussed, Les Johnson, Planning Director, is the approval authority for this application and once this information is submitted a one to two day turnaround for a decision is anticipated for this case. Please note that an approval of your application will be conditioned to comply with the requirements listed in LQMC Section 9.100.110 (which I have included below for your reference), City business license requirements, and any additional conditions deemed appropriate based on the specifics of your application (description of operations and site maps). 9.100.110 Outdoor vendors. A. Definition. Outdoor vendors include hotdog stands, ice cream carts, and similar retail uses which utilize a movable or relocatable .stand or cart for walk-up sales. The stand or cart- must be of a size and design suitable for placement on a private sidewalk, plaza, or pedestrianway. B. Minor Use Permit. An outdoor vendor use may be established as an accessory use in any nonresidential district upon approval of a minor use permit pursuant to Section 9.210.020. All such uses shall comply with the following standards: 1. An outdoor vending use may only be established as accessory to the principal use on the parcel. 2. The location of the outdoor vending use shall not interfere with access to adjacent buildings or with pedestrian circulation. No portion of the vending use shall be located in a parking lot, street, or other area intended for vehicular parking, access or circulation. 3. The outdoor vending .site shall not exceed one hundred fifty square feet. The vending site includes all areas separated from pedestrian access and used for vending activities, including storage. 4. The outdoor vending use shall not be located on public sidewalk or within a public street right-of-way. 5. IR Area farm now offering delivery of fresh produce DEC CITY ()F ; -A QUINTA WNING DFPARTMN Mariecar Mendoza The Desert Sun A local farm is taking its produce to the front doors of many homes in an effort to boost sales while offering a convenient way for residents to eat healthy during these tough economic times. "The idea really goes back to the summer when gasoline was $4.50 a gallon," said William Leach, vice president of sales and business development for Madison Street Produce in Indio. "We have clients all the way from Palm Desert so we thought instead of making them drive to us, we'd go to them." Madison Street Produce, whose slogan is "Your Neighborhood Farmer's Market," has taken its motto literally by offering an "Exclusive Farmers Market" to a number of gated communities in the desert. Its debut was at Sun City Shadow Hills on Nov. 4 and has expanded to setting up shop Tuesdays, Fridays and Saturdays throughout La Quinta at Trilogy Golf Club, The Hideaway, Mountain View Country Club and the La Quinta Resort & Club. While the appearances at the country clubs are exclusively for club members, the market at La Quinta Resort & Club is open to the public. Madison Street Produce, which is certified by Riverside County, also expects to bring its exclusive market to Andalusia at Coral Mountain in La Quinta and Indian Palms Country Club and Resort in Indio in the coming weeks with plans to continue to spread throughout the valley, Leach said. Formerly a participant of the recently established La Quinta Farmers Market, Leach said he pulled out after attending twice because it just wasn't a right fit. "Our biggest problem was that you had to set up your stand at 7:45a.m., but because we pick our produce fresh daily ... it was hard for us to get ready by. that time," Leach said. "The obvious solution is to do the picking the night before, but we didn't want o compromise our product." Their new strategy, however, has proven to be a good move as sales have gone up considerably since November, Leach said. "The homeowners have really embraced the concept," he said. The new service particularly comes at a time when researchers have found that during a down -turned economy, people tend to forgo healthy food options for cheaper, unwholesome food like hamburgers and fries. Sun City Shadow Hills lifestyles director Eric Angle said that was part of the attraction to hosting the market. "We have active adults and we just want to continue to facilitate their healthy lifestyle," Angle said. "Plus, we want to use local farmers and keep everything within the local economy ... and if we can make healthy food convenient that's even more of a no-brainer to host this." Gayl Biondi, who has lived in the valley for 40 years, called the new market "amazingly convenient" — especially as a resident of Trilogy, where the nearest grocery story is more than five miles away. "It's lovely to have them come to us. How many people can say that produce that was picked fresh is there in your parking lot to take home and eat?" Biondi said.
