The applicant agrees to indemnify, defend and hold harmless the City of La Quinta, its agents, officers, and employees from any claim, action, or proceeding to attack, set aside, void, or annul the approval of this Minor Use Permit. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2. The applicant shall comply with all provisions of the La Quinta Municipal Code (LQMC). 3. Once the storage container is placed on site, it can remain on-site for a six-month period. An extension may be applied for, with no additional fee, in writing to the Community Development Department before expiration. 4. Use of the container shall be for storage purposes only and limited to the hours of construction as listed in the La Quinta Municipal Code (Chapter 6.08_ Nuisances). The storage container shall be placed on the subject residential property. The storage container may not be located on the -street or front lawn. 6. The storage container shall comply with Code Section 9..60.050 Storage and Other Accessory Buildings. 7. The storage container shall be immediately removed by the authorized disposal service at the applicant's expense if any noxious or nuisance odors are found to emanate from the container. 8. It - is the responsibility of the applicant to ensure that refuse stays within the container by use of a tarp or netting under windy or other adverse weather conditions. 9. The dumpster may not be used to remove hazardous waste. It is the responsibility of the applicant to properly dispose of any and all waste. 10. The City may elect to add conditions to this application request to mitigate any problems that may arise and are not addressed herein. 11. Approval of this Minor Use Permit Application will not result in conditions detrimental to public health, safety and general welfare, nor injurious to or incompatible with other properties and uses in the vicinity. Applicability. Accessory buildings, such as storage or gardening sheds, are permitted on a residential lot containing a primary residence subject to the requirements of this section. (Carports and garages are regulated separately by Section 9.60.060, patio covers by Section 9.60.040, swimming pools and spas by Section 9.60.070, and recreational vehicle parking by Section 9.60.130.) B. Drainage from Roofs. Accessory buildings shall be constructed in a manner so as to prevent rooftop water from draining onto any adjacent parcel. C. Lot Coverage Maximums.
