The approval of the event is granted under Section 9.100.130 of the La Quinta Municipal Code under the following Findings and subject to the following Conditions: FINDINGS: The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. 2. There is adequate area to conduct the event and to accommodate the anticipated attendance. 3. Sufficient parking will be provided for the anticipated attendance. 4. Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. CONDITIONS: 1 . By holding this sidewalk event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. 2. The event will be held on the following date: March 14, 2009 between the hours of 9:00 a.m. and 12:00 p.m. 3. The event shall be conducted as stipulated in the site plan submitted with the application for this event. 4. Roadways, parking areas, and pedestrian traffic aisles to other businesses and activities in the vicinity shall be maintained accessible at all times. 5. The site shall be left clean and in its original manner the event. 6. No tent structure shall be installed for this event. 7. The use of amplified equipment for music presentations is permitted. The applicant shall comply with the City of La Quinta Noise Ordinance (LQMC 9.100.210). Adherence to these.conditions as outlined hereinwill ensure that adverse impacts to surrounding properties and businesses will be minimized.
