The approval is granted under Section 9.100.080 of the Zoning Ordinance, subject to the following Conditions: 1 . The placement of the construction fence shall be in accordance with the site plan submitted as part of this application. The fence is permitted to be in place for no more than one (1) year or until completion of construction activity, or whichever comes first. The fence shall provide a screening material to obstruct views into the construction site. The fence shall not exceed six (6) feet in height. 2. No temporary structures are permitted unless separately approved prior to installation by the La Quinta Building & Safety Department and Riverside County Fire Department. 3. Public roadways and parking areas shall not be restricted to adjacent residential properties. 4. The applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the Nag City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. 5. The construction fence, and all debris related to construction shall be removed from the site prior to the issuance of a Certificate of Occupancy. 6. The City may elect to add conditions to this application request to mitigate any problems that may arise and are not addressed herein. Adherence to these conditions as outlined will ensure that adverse impacts to surrounding properties and businesses will be minimized.
