MODIFICATIONS TO EXISTING TELECOMMUNICATION FACILITY
Dear Ms. Reimer:
The Community Development Department has reviewed and approved your request to
install twelve (12) replacement panel antennas (replacing same existing panels), three
(3) remote radio units, and other associated equipment within the existing shelter and
lease area at an existing telecommunication facility, located at 54005 Madison Street,
La Quinta Fire Station #70. The approval of this application is subject to the enclosed
approved exhibits, and the following Findings and Conditions of Approval. -
FINDINGS
1. Consistency with the General Plan: The proposed replacement antennas,
new remote radio units and associated equipment at the existing
telecommunication facility are consistent with the goals, objectives and
policies of the General Plan, in that the new antennas will increase the
community's ability for quality access to wireless communication services.
2. Public Welfare: Approval of the new antennas on an existing
telecommunication facility will not create conditions materially detrimental to
the public health, safety and general welfare.
3. The proposed new antennas at the existing telecommunication facility will
minimize adverse visual impacts as the replacement of the current antennas
will occur entirely within the existing antenna array, with no increase in the
facility's existing height or number of antenna arrays..
4. The proposed new antennas are designed to function within the existing
antenna array, which is at an adequate height to achieve the service
provider's objectives for coverage within this por►ion of the community.
5. The proposed new antennas are necessary to improve community access to
wireless services.
CONDITIONS
1: The applicant/property owner agrees to defend, indemnify, and hold harmless
the City of La Quinta (the "City"), its agents, officers and employees from any
claim, or litigation arising out of the City's approval of this project. This
indemnification shall include any award toward attorney's fees.
The City of La Qujnta shall have the right to select its defense counsel in its
sole discretion. The City of La Quinta shall promptly notify the applicant of
any claim, action, or proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of La Quinta Municipal Code
Section 9.170 "Wireless Telecommunication Facilities".
3. The applicant shall comply with all provisions contained in Conditions of
Approval for Conditional Use Permit 2004-085 (CUP 2004-085).
4. The applicant is permitted to replace up to twelve (12) panel antennae on the
existing antenna array on the tower; four antennae per array. Additionally, the
applicant is permitted to place three new remote radio units (RRU) antennas
on existing array mounts, behind all panel antennas. All new installations shall
be painted to match the color on the array as appropriate.
5. The applicant is further permitted to install the following associated additional
equipment:
A. Wall -mounted junction box in the existing equipment shelter.
B. Tower -mounted junction box, mounted on an existing stand-off arm of the
tower.
C. Two (2) hybrid cables from a shelter -mounted junction box to the
aforementioned tower -mounted junction box.
D. Equipment rack with two (2) baseband units in the existing equipment
shelter.
6. New hybrid cables running from the equipment shelter to the new antennas
shall be contained within the existing cable tray between the tower and the
equipment enclosure. All cables shall be interior of the tower and shall not be
visible from surrounding properties.
7. The applicant shall obtain a building permit for the City's Building Division
(760) 777-7012.
Approval of Minor Use Permit 2014-1069 will not result in conditions detrimental to
public health, safety and general welfare, nor injurious to or incompatible with other
properties and uses in the vicinity. The City may elect to add Conditions to this
application request to mitigate any problems that arise not previously addressed herein.
This decision may be appealed to the Planning Commission by anyone provided they
submit the necessary paperwork and filing fee of $1,573.00 to this office within 15 days
of the date of approval of this permit.

We spoke back in November regarding the process for modifying existing wireless facilities. At that time, you
had said most wireless modifications require a Minor Use Permit, but you wanted to take a look at the plans to
confirm the process. I now have plans for Verizon's project at 54005 Madison Street (Fire Station 70), which
entails replacing 12 panel antennas, installing 3 remote radio units (mounted behind the antennas), and the
installation of a junction box on the existing monopalm. The overall antenna count and facility height will remain
unchanged.
Please advise if this project will require a Minor Use Permit or other entitlement application.

The plans will go through the permitting process, but planning wants to know the city leasing is OK with the
change. So we cannot submit until we have authorization from leasing.

As for the approval of the plans, that has to be done through a Minor Use Permit (application attached) for
review/approval by the Community Development Director based on our Wireless Communication ordinance provisions. I
was under the impression we had discussed that but apparently I was mistaken. The fee for the application is $200, and
the plans you submitted can be used as they are for the application (requires filing of the fee, application form and the
required plan sets as specified in the form). There is no public hearing associated with the application so you can ignore
that portion, as well as any other provisions that may be inapplicable, as we use this form for a multitude of application
types. Please note it needs to be submitted by hand and not by mail.
