This letter is intended to serve ~~ a letter agreement t?etweent;h~ .:.La Quinta
Redevelopment Agency and Th9~ith ~mJ3ani8g ("Consultant") to make available Mr."
Doug Franklin to assist the Agency in providing information for discovery responses in the
Verizon litigation. In addition, since Mr. Franklin is the most knowledgeable person as to
certain facts relating to the dispute, it is anticipated that he will be called to serve as a
percipient witness during depositions and trial, as needed, in matters related to his position
as Project Manager at SilverRock Resort.
Consultant shall be compensated for time spent according to its standard hourly rate for
said individual for such services, which is $~. per hour. It is important to note that Mr.
Franklin is being compensated for his time rather than his testimony, and the
compensation is in no way tied to how he testifies. In addition, it is anticipated at this point
that Mr. Franklin will only be testifying as a percipient witness rather than as an expert
witness. it is possible that this designation could change in the future. If it does, a new
retention agreement would cover those services.
