CC Resolution 2017-058RESOLUTION NO. 2017 - 058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT PREPARED FOR ZONING ORDINANCE AMENDMENT 2017-0003 TO AMEND SECTION 9.100.210 OF THE LA QUINTA MUNICIPAL CODE RELATING TO GOLF COURSE MAINTENANCE NOISE CASE NUMBER: ENVIRONMENTAL ASSESSMENT 2017- 0012 APPLICANT: CITY OF LA QUINTA WHEREAS, the City Council of the City of La Quinta, California did, on the 5th day of December, hold a duly noticed public hearing to consider a request by the City of La Quinta to adopt Environmental Assessment 2017-0012, prepared for Zoning Ordinance Amendment 2017-0003 to amend Section 9.100.210 of the La Quinta Municipal Code relating to exempting golf course maintenance noise from the City's noise limits. WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 14`I' day of November, 2017, hold a duly noticed Public Hearing and recommended certification of a Negative Declaration of Environmental Impact prepared for Zoning Ordinance Amendment 2017-0003; and, WHEREAS, said Environmental Assessment complies with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" as amended (Resolution 83-63), in that the Planning Director has conducted an Initial Study (Environmental Assessment 08-601) and has determined that there will not be a significant effect on the environment, and that a Negative Declaration of environmental impact should be adopted; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did make the following mandatory findings pursuant to Section 9.220.010 of the Municipal Code to justify approval of said Environmental Assessment "Exhibit A": 1. The proposed zoning ordinance amendment will not be detrimental to the health, safety, or general welfare of the community, either indirectly, or directly, in that no significant impacts were identified by Environmental Assessment 2017-0012. The proposed zoning ordinance amendment will not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of rare or endangered plants or animals or eliminate important examples of the major periods of California history or prehistory. 3. There is no evidence before the City that the proposed zoning ordinance amendment will have the potential for an adverse effect on wildlife resources of the habitat on which the wildlife depends. 4. The proposed zoning ordinance amendment will not result in impacts which are individually limited or cumulatively considerable. 5. The proposed zoning ordinance amendment will not have environmental effects that will adversely affect the human population, either directly or indirectly. Impacts associated with noise and air quality will be less than significant. 6. There is no substantial evidence in light of the entire record that the project may have a significant effect on the environment. 7. The City Council has considered Environmental Assessment 2017-0012 and said assessment reflects the independent judgment of the City. 8. The location and custodian of the City's records relating to this project is the Design and Development Department located at 78-495 Calle Tampico, La Quinta, California. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: SECTION 1. That the above recitations are true and constitute the Findings of the City Council in this case. SECTION 2. If so, has consultation begun? 2 EVALUATION OF ENVIRONMENTAL IMPACTS: 1) A brief explanation is required for all answers except "No Impact" answers that are adequately supported by the information sources a lead agency cites in the parentheses following each question. A "No Impact" answer is adequately supported if the referenced information sources show that the impact simply does not apply to projects like the one involved (e.g., the project falls outside a fault rupture zone). In determining whether impacts to forest resources, including timberland, are significant environmental effects, lead agencies may refer to information compiled by the California Department of Forestry and Fire Protection regarding the state's inventory of forest land, including the Forest and Range Assessment Project and the Forest Legacy Assessment project; and forest carbon measurement methodology provided in Forest Protocols adopted by the California Air Resources Board. The proposed properties are not zoned for agricultural use and will not result in the conversion of existing farmland to non-agricultural uses. There will be no impacts to agricultural resources. This project involves no ground moving activity, leading to no impact on agricultural resources. 8 III. The 2035 General Plan EIR analyzed sources of emissions from the use of electricity and natural gas, and from area sources and mobile sources. Fuel used for landscaping purposes such as golf course maintenance is considered a type of area source emission. The Zone Text Amendment 9 would not introduce any new sources of emissions above what already has been assessed in the 2035 General Plan EIR related to permitted activities performed for existing land uses such as landscape and golf course maintenance. Any emissions related to golf course maintenance equipment are addressed in the 2035 General Plan EIR; therefore, the proposed Zone Text Amendment will have no impact on air quality. IV. The noise standard is 50 dB(A) for noise sensitive land uses between 10:00 p.m. — 7:00 a.m. Golf course maintenance occurs within this time period beginning at 5:30 a.m. Noise from golf course maintenance is generated from the equipment that is used to maintain the grounds, which includes mowers, sweepers, and blowers. The maintenance begins at 5:30 am to occur before the golf course is being used, as tee times start as early as 6:00 a.m. 20 A survey on August 30, 2017 was taken to complete noise readings of golf course maintenance work at different holes at a representative golf course, the PGA West golf course located south of Avenue 54 and west of Madison Street. Maintenance at this golf course usually occurs one hole at a time, where maintenance lasts 2-3 hours per hole. The readings were taken from 6:00 am — 7:00 am at the closest residences to the golf course. Golf course sweepers produced decibel readings as high as 60 dB(A) and as low as 52 dB(A) during the duration of the maintenance work. The mowers produced readings ranging from 52 dB(A) to 65 dB(A), and a blower produced readings within the same range as the mowers. The maintenance equipment is a mobile source of noise and noise levels are observed to decrease when the mobile source travels away from the residence. The City of La Quinta 2013 General Plan identifies dB(A)'s from 50-60 as having a moderate subjective loudness and sleep disturbance as a noise effect. The General Plan identifies dB(A)'s of 60-80 as being subjectively loud and creating speech interference. The City of La Quinta General Plan and Municipal code identifies dB(A)'s from 55-70 for single family dwellings as conditionally acceptable. The City of La Quinta Municipal Code, states that it is unlawful for noise on any property within the City to occur from 10:00 p.m. — 7:00 a.m. to exceed 50 dB(A) for a cumulative period of more than thirty minutes in any hours, 55 dB(A) for a cumulative period of more than fifteen minutes in any hour, 60 dB(A) for a cumulative period of more than five minutes in any hour, 65 dB(A) for a cumulative period of more than one minute in any hour, and 70 dB(A) for any period of time, where the term "cumulative period" means the number of minutes that a noise occurs within any hour, whether such minutes are consecutive or not. The noise readings taken at the PGA West course would exceed these limits. However, the maintenance equipment is not stationary; does not remain in front of one residence for the entire maintenance period, and the noise levels that occur from the maintenance are identified as conditionally acceptable, per the City's General Plan and Municipal Code. Additionally, golf course maintenance will be permitted take place between 5:30 a.m. and 10 p.m. and would not occur during the night. Due to these factors, the noise generated from golf course maintenance noise would not constitute a significant impact. . b) No Impact This project does not involve any groundborne vibration. There is no construction or ground moving activity proposed in this project that is a source of groundbourne vibration. The project will not expose any persons to any excessive groundborne vibration or groundborne noise levels. 21 c) -d) No Impact This project involves an exemption of noise levels for golf course maintenance and will not permanently or temporarily increase ambient noise levels in the project vicinity. Current ambient noise levels in the project vicinity already include noise from golf course maintenance. This would not change upon adoption of the proposed exemption. e) Less Than Significant Impact Portions of the project area fall within Zone E of the Riverside County Airport Land Use compatibility Plan for the Bermuda Dunes Airport. Zone E is the zone furthest away from the airport. The project will not increase exposure to new noise levels, as the golf course maintenance would occur without the project and the noise exemption action is not creating additional noise. f) No Impact The project is not within the vicinity of a private airstrip. 22 XIII.
