Dear Mr. Armstrong:
This is to inform you that the City Council at their meeting of February 18, 1992,
approved your request for a special advertising* device. The approval is for the
following items:
1. Two 31 X 12' red vinyl with white copy "Welcome" and "Grand Opening"
banners to be attached to the fencing at the .Century Homes model site.
2. Twelve 45" X 72" purple flags with white copy .located around the perimeter
of the model home complex lots as shown on approved plan exhibit.
3. Multi -colored 31' high cold air balloon tethered to the ground.,
•
Approval of this special advertising device is subject to the following conditions:
1. The flags shall be removed after a period of one year.
2. The banner shall be removed after a period of two days (February 22nd and
23rd, 1992).
3. The balloons shall be erected for only one day (February, 22, 1992).
4. All equipment shall be in "UL11 approved and shall conform with the 1990.
"NEC". Please contact the Building and Safety Department for further
information on these issues.
5. The balloon shall be tethered more than 351 from the curb on La Vista Drive.

& 23, 1992.
BACKGROUND:
Municipal Code Chapter 5.64, "Special Advertising devices",
provides for a permit to be issued by the City Council for
advertising devices other than the usual and customary
permanent business identification signs. This includes items
such as searchlights.
REQUEST:
The applicant has requested the following to be located on the
model home complex site for Century Homes. The site is located
on the southwest corner of Sanita Drive and Las Vistas Drive in
Tract 23269 (See Attachment #2 & 3).
1. Two 3-foot x 12-foot red vinyl with white copy welcome
and grand opening banners to.be attached to the fencing
at the Century Homes model home sites.
2. Twerrty-evne 45-inch x 72-inch purple flags with white copy
located around the perimeter of the model home complex
lots.
3. Multicolored 31-foot high cold air balloon tethered to
the ground.
CITY COUNCIL FINDINGS:
Section 5.64.020 provides, in part., that permits are to be
issued for special purposes, "...and not on a continuing basis
for permanent advertising or identification .purposes"; and,
further that, "Each permit shall be issued for a specified
period of time subject to renewal for good cause shown."

In taking action of a permit, the Council must find that the
special advertising device applied for would not:
1. Constitute a traffic hazard or nuisance to adjacent or
surrounding properties or to the public at large; or,
2. Be detrimental to the public convenience or welfare; or,
3. Be inconsistent with the various elements and objectives
of the General Plan and all other officially adopted
policies and regulations of the City.
ANAT.VfiT C -
1. Flags and banners have been used by many developers in La
Quinta and should not be detrimental to the surrounding
neighborhood if used as proposed. Staff recommends the
banners be allowed to be displayed for the weekend of the
grand opening (February 22 & 23, 1992) and the flags
could be allowed to remain for a period of one year.
2. Century Homes application for a tethered cold air balloon
is a more unusual request. This balloon will be utilized
for one day only and will have a grand opening banner
attached.
3. Code Enforcement and the County Sheriff Department have
no negative comments regarding the tethered balloon. The
Building Department has the following comment: "all
equipment has to be UL (Underwriters Laboratories) and
has to conform with the 1990 NEC (National Electrical
Code Book)".
4. Staff therefore recommends that the flags, banners and
balloons be approved with the following Conditions of
Approval:
1. The flags shall be removed after a period of one
year.
2. The banners shall be removed after a period of two
days.
3. The balloon shall be erected only for one day
(February 22, 1992).
4. All equipment shall be UL approved and has to
conform with the 1990 NEC. Please contact the
Building Department for further information on
these issues.
5. The balloon shall be tethered more than 35-feet
away from the curb on La Vistas Drive.
