The signs will advertise and provide directional signage for the Village at La Quinta Mainstreet Marketplace to be held each Friday starting April 17, 1992. Submitted by: Approved for submission to City Council: RON KIEDROWSKI, CITY MANAGER cc#17 �i --- - - 6 0 MEMORANDUM �Of TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: PLANNING & DEVELOPMENT DEPARTMENT DATE: APRIL 7, 1992 SUBJECT: REQUEST FROM THE LA QUINTA CHAMBER OF COMMERCE FOR SPECIAL ADVERTISING DEVICES (SAD 92-023) IN CONJUNCTION WITH THE VILLAGE AT LA QUINTA MAINSTREET MARKETPLACE (SEE ATTACHMENT #1) BACKGROUND: Municipal Code Chapter 5.64, "Special Advertising Devices", provides for a permit to be issued by the City Council for advertising devices other than the usual and customary permanent business identification signs and includes signage for special events / occasions . REQUESTS: The La Quinta Chamber of Commerce requests signage to be placed along Washington Street and Calle Tampico. The signs would be professionally done and installed for six weeks beginning Thursday, April 16, 1992 and removed Saturday, May 30, 1992. DISCUSSION: 1. The proposed signs will be located within City right-of-way and on private property. 2. The Public Works Department requires that the signs should be located so as not to create a traffic hazard. CITY COUNCIL FINDINGS/ACTION: Section 5.64.020 provides, in part, that permits are to be issued for special purposes, " ... and not on a continuing . basis for permanent advertising or identification purposes"; and further that, "Each permit shall be issued for a specific period of time subject to renewal for good cause shown." In taking action on a permit, the Council must find that the special advertising device applied for would not: MEMOJH.185 1 1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or to the public at large; or, 2. Be detrimental to the public convenience or welfare; or, 3. Be inconsistent with the various elements and objectives of the General Plan and all other officially adopted policies and regulations of the City. Conditions may be assigned to any permit granted in order to harmonize it with the. public purposes expressed in this Chapter of the Municipal Code. COUNCIL ACTION: Action of the Council may be taken by Minute Motion to approve or deny the request. SUGGESTED CONDITIONS IF THE REQUEST IS APPROVED: 1. Signs located along streets without curbs must maintain a six-foot setback .between the sign edge and the edge of -the pavement. 2. The edge of signs located along streets with curbs shall not be any closer than 5 feet from the back of the curb. 3. The signs shall not obstruct vision of any traffic control devices. 4. All signs must be removed by May 30, 1992. 5. Written authorization from the property owner must be obtained before installation of a sign on private property. Box 255 La Quinta, CA 92253 SUBJECT: MINOR TEMPORARY OUTDOOR EVENT 92-042 (VILLAGE AT LA QUINTA MAINSTREET MARKETPLACE) Dear Ms. Kerr: This is to inform you that your request for a Village at La Quinta Mainstreet Marketplace is hereby approved by the Planning and Development Department subject to the following conditions: 1. The Marketplace is approved to be held on Friday evenings between the hours of 6 : 00 P . M . and 10 : 00 P . M . , except for the week before and the week of the March La Quinta Arts Festival and the week of the Village Faire which is held' in the fall. The permit is, approved subject to City review after three months or if the City receives a complaint which -it considers to be valid. The City may impose additional conditions or revoke this permit at the time of review. 2. Calle Estado between Avenida Bermudas and Desert Club Drive may be closed from 5:30 P.M. to 10:30 P.M. Except for the first nights operation on April 17, 1992, at which time the City shall install and remove traffic barriers and "No Parking" signs, traffic barriers and "No Parking" signs are to be placed and removed by the La Quina Chamber of Commerce. 3. Prior to the first nights operation on April 17, 1992, the Chamber shall '. personally notify each tenant or occupant on Calle Estado of the Mainstreet Marketplace activities and the need to have vehicles removed from the street by 5:30 P.M. 4. A minimum 20 foot wide unobstructed fire lane on both sides of the street shall ' be provided at all times during the street fair operation. 5. Permits for temporary use structures (tents, stands, stage, etc.) or any open & 1;11flame devices shall be obtained from the Riverside County Fire Department prior to installation in use. 6. Fire extinguishers shall be provided along every 75 feet of the street on both 40 sides of the street by the Applicant at each Marketplace. 7. Vendors who, sell alcoholic beverages shall obtain a license from the Alcohol Beverage Control., >y 8. Applicant shall .provide one on -site Sheriff's Deputy from 5:30 P.M. to 11:00 P.M. during the Marketplace. A minimum two portable restrooms shall be provided for the Marketplace.~ Location and length of time they may be left in place shall be approved by the City prior to the first Marketplace. 10. Applicant shall provide $1 million liability insurance policy for Marketplace activities which "hold harmless" the City of La Quinta and lists the City of La Quinta and its employees, etc. as co-insured. 11. All vendors or operators shall obtain a City business license after approval by the Chamber of Commerce. 12. Each vendor shall be reviewed and approved for operation by the County Health Department, as required._' 13. Applicant shall provide a vehicle barrier at the driveway adjacent to the La Quinta Meat Market and the La Quinta Public Library to the east. 14. Any extension cords for electricity must be heavy duty and equipped with GFI with extension cords _taped to the ground. Vendors must obtain property owners approval to utilize electrical plugs in adjacent buildings. 15. Prior. to use of any private property, the Applicant shall obtain written approval from the property owner. 16. Temporary trash bins shall be placed throughout the street with Applicant insuring that all trash and debris is cleaned up at the closing of the Marketplace. Additionally, the City Council at their meeting of April 7, 1992, approved your request for special advertising devices (SAD 92-023) as submitted, subject to conditions (attached) .
