The street closure resolution will allow.Calle Estado to be closed and parking restricted during the hours of street fair operation. The Special Advertising Device permit will allow off -site advertising for each date the event is held. FISCAL IMPLICATIONS: None.. HUNT, CITY MANAGER TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: PLANNING AND DEVELOPMENT DEPARTMENT DATE: OCTOBER 5, 1993 SUBJECT: SPECIAL ADVERTISING DEVICE 93-033 AND CALLE ESTADO STREET CLOSURE REQUEST FOR THE "VILLAGE AT LA QUINTA MAINSTREET MARKETPLACE" STREET FAIR (1993-94 SEASON) ISSUES: A request to establish temporary signs throughout the City during the Mainstreet Marketplace Street Fair and a request to close Calle Estado between Avenida Bermudas and Desert Club Drive during each of the six event days. BACKGROUND: The La Quinta Chamber of Commerce requests special advertising devices for their street fair event on Calle Estado between Desert Club Drive and Avenida Bermudas. The signs will be located at four locations within the City. The 22" x 28" signs will be placed three days before and removed three days after each event. The 1993-94 season street fair dates are October 22nd, November 19th, December 17th, March 26th, April 22nd, and May 13th. The Chamber of Commerce is also requesting that the City allow the closure of Calle Estado to through traffic before, during and immediately after each event to reduce and eliminate pedestrian/vehicle conflicts: ANALYSIS/FISCAL IMPACT: - Special Advertising Device Municipal Code Chapter 5.64, "Special Advertising Devices", provides for a permit to be issued by the City Council for advertising devices other than the usual and customary permanent business identification signs and includes signage for special events / occasions . Discussion 1. The proposed signs will be located within City rights -of -way, at Washington Street and Highway 111, Eisenhower Drive and Washington Street, Calle Tampico and Washington Street, and Calle Tampico and Avenida Bermudas. 2. The Public Works Department has reviewed the sign locations and requires that the signs be located so as not to create a traffic hazard. MEMOGT . 019/ CS 2 0 Temporary Street Closure Municipal Code 12.32 (Parking) provides standards for prohibiting and regulating parking within the City for certain reasons in conjunction with Section 21101(e) of the Vehicle Code. The Vehicle Code states: Temporarily closing a portion of any street for .celebrations, parages, local special events, and other purposes when, in the opinion of local authorities having jurisdiction, the closing is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing. . Discussion The temporary closing of Calle Estado during the afternoon and evening hours once a month will not create an undue burden on the business owners along the public street because the businesses are actively involved with the Chamber's event, their business generally closes on or before the event, and the existing parallel east/west public alleyways provide secondary circulation to the area. The temporary closure of the street will not drastically effect the Village area since other streets in the area service the downtown area with or without this small section of street being closed to through traffic. In addition, without the closure, staff can envision major safety conflicts between pedestrians and vehicle traffice thus creating a unnecessary liability to the City. Staff recommends the City Council approve the attached draft Resolution approving the temporary street closure and establishing the parameters of the event. The signs shall be posted 24 hours in advance of each event to inform the public about the event. This proposed temporary closure has been reviewed by the Engineering Department, Riverside County Sheriff, and the Riverside County Fire Department, and none have voiced any objections to the closure. City Council Findings/Action Section 5.64.020 provides, in part, that permits are to be issued for special " purposes, ...and not on a continuing basis for permanent advertising or identification purposes"; and further, that "Each permit shall be issued for a. specified period of time subject to renewal for good cause shown" In taking action 'on a permit, the Council must find that the special advertising device applied for would not: 1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or to the public at large; or, 2. Be detrimental to the public convenience or welfare; or, 3. Be inconsistent with the various elements and objectives of the General Plan and.,all other officially adopted policies and regulations of the City. MEMOGT . 019 / CS 2 Conditions may be assigned to any permit granted in order to harmonize it with the public purposes expressed in this Chapter of the Municipal Code. Fee Waiver It is recommended the applicable fee ($80.00) be waived per Ordinance #216. The fee has been .waived in previous years. Last year the'City Council granted the La Quinta Chamber of Commerce permission to.have off -site advertising and the temporary closure of Calle Tampico subject to conditions, and no problems were experienced. RECOMMENDATION: 1. Adopt Resolution 93 approving the street closure permit for the La Quinta Chamber of Commerce Mainstreet Marketplace 1993-94 season. 2.
