SAD 1993-036NUI APPLICATION f� MEMORANDUM TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: PLANNING & DEVELOPMENT DEPARTMENT DATE: DECEMBER 7, 1993 CASE: SPECIAL ADVERTISING DEVICE 93-036 SUBJECT: REQUEST FROM AM CONSTRUCTION FOR APPROVAL OF SPECIAL ADVERTISING DEVICE 93-036 CONSISTING OF 5 FLAGS FOR A HOUSE FOR SALE AT 78-500 AVENIDA TUJUNGA FOR THE MONTHS OF DECEMBER AND JANUARY . BACKGROUND: The La Quinta Municipal Code provides for the issuance of permits for "Special Advertising Devices" in Chapter 5.64. These devices are for advertising purposes and are other than the usual and customary permanent business signs. Flags are included in this category. REQUEST: AM Construction has requested approval for four or five flags to. be placed around the front- of a single family house that they recently constructed. The house is located at 78-500 Avenida Tujunga (Attachment No. 3), at the end of a cul-de-sac and behind the wall along Washington Street (Attachment No. 2) . The flags are approximately 16" by 24" in size, and blue and white in color (Attachment No. 3) . They are to be placed on poles approximately 12 feet high around the front of the house. Originally, the Applicant requested the flags to fly for the months of November and December. However, due to the date of application (November 9, 1993) , Council could not hear the request until December 7th. Therefore, the Applicant has revised the request to be for the remaining month of December through the end of January, 1994 (Attachment No. 4) . The Applicant's letter (Attachment No. 3) states that because of the privacy wall and the cul-de-sac at the end of Avenida Tujunga, there is limited drive -by traffic. The applicant feels flags are necessary to draw attention to the house that is offered for sale. ANALYSIS: Staff has reviewed this request and agrees that marketing the house for sale is difficult given its location. It is felt that five flags would be too many, and that if approved, three should be the maximum allowed. A two month period should be the MEMOLC.013 maximum time permitted for the flags. No other flag requests of this type have been requested in La Quinta. This request. could be a 'precedent -setting case. The Council has approved requests by developers for tract flags on several occasions, most recently a request by Acacia Construction, Inc. (Plot Plan 93-035), approved on November 2, 1993. Zoning Ordinance Section 9.212.100 - Sign Regulations allows for Real Estate -For - Sale, Lease, or Rent signs. Flags or banners are not permitted by the ordinance. However, through the Special Advertising Device applicatiori process, the City Council may grant a permit for. any type of device as it sees fit. FINDINGS: Section .64.020 of the Municipal Code states, in part, that permits are to be issued for special purposes, ' ... and not on a continuing basis for permanent advertising or identification purposes", and further that "Each permit shall be issued for a special period of time subject to renewal for good cause". The request may be granted for a permit if certain findings are made. The findings must state that the special advertising device would not: 1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or to the public at large; or 2. Be detrimental to the public convenience or welfare; or 3. Be inconsistent with the various elements and objectives of the General Plan and all other officially adopted policies and regulations of the City . . RECOMMENDATION: By Minute Motion 93- approve the request of AM Construction for three (3) flags as recommended by staff, subject to the findings contained in the staff report, for the months of December, 1993 through January, 1994. These flags will fly durings the months of November and December, 1993, in an effort to attract attention to an open house for sale. Because of the Washington privacy wall and the cul-de-sac at the western end of Avenida Tu junga, there is limited drive -by traffic and these flags will serve to promote the entire area.
