BACKGROUND AND OVERVIEW:
On March 21, 1994, Parc La Quinta requested approval of 19 subdivision flags consisting of six
10 foot high flagpoles, and thirteen 20 foot high flagpoles. Parc La Quinta is located on the east
side of Washington Street, just north of Sagebrush Avenue (Attachment 1) . The applicant
replaced existing flags which had become worn and faded with new flags; however, no new permit
was secured. A citation was issued on March 11, 1994, by Code Enforcement for removal of the
flags pending approval by the City Council. The poles and flags have since been removed.
The new flags are described as solid orange in color and rectangular in shape. The location of
the flags is depicted in the plot plan included as Attachment 2.
Municipal Code Chapter 5.64 , "Special Advertising Devices", provides for a permit to be issued
by the City Council for advertising devices other than the usual and customary permanent
business identification signs. This includes items such as tract flags.
On September 10, 1990, a policy was approved by the City Council regarding the number of
advertising flags in residential subdivisions. The policy states that a maximum 21 flags may be
approved. The rationale is that more than 21 flags is excessive and 21 flags is sufficient to
provide an advertising statement.
On February 1, 1994, Council established a policy for a six month approval for the displaying of
flags with a six month extension if, after review by the Planning Director, the flags are in good
shape or worn flags are replaced. Flags have been used by many developers in La Quinta and
have been shown not to be detrimental to the surrounding neighborhood if used properly.
FINDINGS AND ALTERNATIVES:
Section 5.64.020 provides, in part, that permits are to be issued for special purposes, "...and
not on a continuing basis for permanent advertising or identification purposes", and further that
"Each permit shall be issued for a special period of time subject to renewal for good cause shown".

The Council's consideration of granting this permit must find that the Special Advertising
Device (s) applied for would not:
1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or the public
at large; or,
2. Be detrimental to the public convenience or welfare; or,
3. Be inconsistent with the various elements and objectives of the General Plan and all other
officially adopted policies and regulations of the City.
The following options are available to the Council:
1. Approve the request with Findings and Conditions;
2. Deny the request.

On April 5, 1994; the City Council approved a six-month permit for 19 subdivision flags for the Parc La
Quinta tract, subject to conditions of approval (Attachment 1). On September 5, 1994, staff received a
letter of request for a time extension.for an additional six months (Attachment 2).

flagpoles to display solid orange rectangular flags. In August, the applicant replaced the flags with white
colored flags in compliance with the original conditions of approval requiring replacement if they become
faded or torn. The flags are placed along the Washington Street side of the tract with six flags clustered
at the tract entrance.
Municipal Code Chapter 5.64 (Special Advertising Devices ) provides for a permit to be issued by the City
Council for advertising devices other than the usual and customary permanent business identification signs.
This includes flags as requested in this application.
Section 5.64.020 provides, in part, that permits. are to be issued for special purposes, "...and not on a
continuing basis for permanent advertising or identification purposes", and further, "each permit shall be
issued for a specific period of time subject to renewal for good cause shown".
The Council'.s consideration for granting of this permit must find that the Special Advertising Device
applied for would not:

the private streets leading to the existing model complex on Sandia to draw attention to their on -site sales
program.

extension if, after review by the Planning Director, the flags are in good condition or worn flags are
replaced. The Conditions of Approval require the extension of time to be reviewed by the City Council.
FINDINGS AND ALTERNATIVES:
On September 20, 1994, the City Council requested the Planning Commission to review the subdivision
flag program to determine if the existing City policies should be revised to reduce the number of flags for
each project. The Planning Commission's recommendation is as follows:
1. Twelve flags shall be considered the maximum number of flags permitted.
2. The pole heights shall be a maximum of 20-feet in height for the perimeter of the project and 16-
feet for the interior.
3. The flags size shall be a maximum of 18 square feet for the perimeter and 12 square feet for the
interior.
4. Rigid flags, secured on more than one side, are not permitted.
5. The flags may vary in color or have multiple colors, but fluorescent colors are not allowed.
6. Any wording on the flags shall be limited to the name of the subdivision and/or name of the
developer. Flags which have a phrase or part of a phrase which is read on multiple or subsequent
flags shall not be allowed.
7. The flags shall be approved for a six month period then reviewed by the Community Development
Department and if in acceptable condition, granted an extension for up to six months.
8. There shall be no more than one flag per pole.

9. The location of the flag pole shall be relative to the height of the pole. The height of the pole is
determined at the grade of the property line.
10. The structure of the pole shall be determined by the wind load and size of the flag. Staff shall
supply applicants with the acceptable standards.
Staff Comments
Based upon the Planning Commission's recommendation, the applicant's request cannot be approved
without modification to conform to the above policies. That portion of the request that needs to be
modified is:
b. The perimeter flags shall be limited to 18-square feet in size;
The options available to the Council are' as follows:
1. Approve the request with modifications as recommended by the Planning Commission and subject
to the Findings and Conditions as recommended by staff;;

The Parc` La Quinta�development, currently .c7 plays eight ._(8) 'flags
along Washington . '-Street, four -(4) on each side -of our gated
entrance. The flags are scli& white in color and rectangular in
shape.
Per your correspondence of October 20, 1994, our approval for
these flags expires April 18, 1995. We are requesting a six (6)
month extension to display these flags. They are a definite plus
in bringing prospective buyers into the on -site sales office.
We have just twelve (12) `homes remaining to sell -out the entire
development of 150' homes: ,

Please accept. this letter as our formal written requek for extension
of our permit for nineteen (19) advertising flags which currently expires
on October 5, 1994.
After receiving Mr. Hirdler's memo of July 21, 1994, we replaced the
faded• flags with new white flags just last month (August 1994). The
new flags are very presentable and we do, hope you will approve our
request for this extension. We have just twelve new homes left in
the Parc La Quinta inventory and the flags are very important to our,
marketing efforts as many people think the development is sold out.
