Approve Special Advertising Device 94-051 for a one year time period, subject to the attached Findings and Conditions of Approval limiting the total number of flags to 21. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: Municipal Code chapter 5.64 (Special Advertising Devices) provides for a permit to be issued by the City Council for advertising devices other than the usual and customary permanent business identification sign. As identified in this application the special advertising devices requested are flags and therefore, require City Council approval. Inco Homes is constructing 150 single family residences south of Miles Avenue and west of Adams Street. Models will be constructed at the southwest corner of Coldcreek Lane and Sunbrook Court which is near the northwest corner of the tract (see Attachment 1). In order to identify the model area, the applicant has submitted a request for subdivision flags and model identification flags. The applicant is requesting approval of a total of 25 subdivision flags on 20' high poles (see Attachment 2). Fourteen of the flags would be located on Miles Avenue with the balance located on both sides of Coldcreek Lane between Miles Avenue and the model complex. These flags will be rigidly mounted flags. Two designs of flags are proposed in an alternating pattern. One style will.indicate "Inco Homes" with a second style indicating "Reunion" which is the name of the project. The Inco Homes sign will be primarily blue with "Inco" repeated three times in white letters. The word "Homes" will be at the bottom in black letters on a white background. The "Reunion" flag will have an orange background with "Reunion" repeated four times in white letters. All flags will be 28" wide and 84" tall. For each of the four model homes, the applicant wishes to use identification signs which are provided on poles (see Attachment 3). For each model, there will be three closely spaced poles of 21', 18', and 15' heights with flags of 28" wide and. 36" high. One flag will indicate the model number and bedroom/bath size, with the second flag indicating the "Reunion" subdivision name.. The third flag will be for some type of phrase such as "This is it" with the second one saying "No, this is it" and so on. This is typical of Inco Homes model identification signage. These flags will be 28" wide and 36" tall and be set rigid by poles at the top and bottom of the flag. These flags will have an orange background with white copy and a blue band at the top. Photographs of similar flags for other Inco Homes projects is included as Attachment 4. rrss. i no • Findings Section 5.64.020 provides in part,. that permits are to be issued for special purposes, "...and not on a continuing basis for permanent advertising or identification purposes", and further, "each permit shall be issued for a specific period of time.subject to renewal for good cause shown". The Council's consideration for granting of this permit must find that the special advertising device applied for would not: 1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or to the public at large; or, 2. Be detrimental to the public convenience or welfare; or, 3. Be inconsistent with the various elements and objectives of the General Plan and all other officially adopted policies and regulation of the City. ANALYSIS/FISCAL IMPACT: In September, 1990, a policy was adopted by the City Council indicating that a maximum of 21 flags be permitted for residential subdivision advertising. The rationale is that more than 21 flags is excessive and that 21 is sufficient to provide an advertising statement. As indicated, the applicants show a total of 25 advertising or subdivision flags along Miles Avenue and Coldcreek Lane. Staff has indicated to the applicant that the policy is to allow not more that 21 flags. Another factor to consider in this case is the model home identification signs. Normally, developers utilize small ,pedestal mounted signs near the front door to identify their models. These signs, since they are under 3 square feet, do not require approval. In this case, the applicants. utilize rigid flags which amounts to advertising of the subdivision from the adjacent public streets. These model flags, since they are placed clo::c= together, can either be considered as four flags (one for. each model) or 12 flags if taken individually. Sta: generally feels that these model home flags should be considered in the total number of signs with each model being considered one flag. This would mean that after discounting the four model flags, a total of 1" additional flags should be permitted adjacent to Coldcreek Lane and Miles Avenue. FINDINGS AND ALTERNATIVES: Approve Special Advertising Device 94-051 for one year, subject to the attached Findings and Conditions of Approval. 2. Deny the request. As you will recall, we required that they reduce the number of flags at their site from 21+ to 8 by Sept. 20th. He states they will not have any equipment on -site to remove the poles since they were set in concrete, etc. Recommendation: Require them to remove the flags and within 10-days remove the flag poles. PS - He would like to leave the flag poles in place because he is hoping Jerry will amend the flag policy with Council in the next few months. ' Mr. Fred Farr stated he was not happy ° with the City Council's modification to the on -site flag program, and he was unaware that it had changed last year. Therefore, they plan to appeal to the Planning Commission for a waiver.- I told him that even if the Commission approves the request, the case will be forwarded to Council because they adopted the flag policy on Oct. 18, 1994. They will submit their request this month and I will place the request on the Sept. 12 or 26 agenda.
