The conditions stated below are deemed necessary to protect the health, safety, and welfare of the community. 3. The temporary advertising is consistent with the standards of the Municipal Code of the City of La Quinta. CONDITIONS: 1. Signs located along streets without curbs must maintaina six-foot setback between the sign edge and the edge of the pavement. 2. The edge of signs located along streets with curbs shall not be any closer than 5-feet from the back of the curb. 3. The signs shall not obstruct vision of any traffic control devices or vehicles. 4. CONAPRA.118 STAFF REPORT PLANNING COMMISSION MEETING DATE: FEBRUARY 14, 1995 CASE: SPECIAL ADVERTISING DEVICE 95-063 APPLICANT: LA QUINTA ARTS FOUNDATION (SUSAN FRANCIS) REQUEST: APPROVAL OF TEMPORARY OFF -SITE DIRECTIONAL SIGNAGE FOR AN UPCOMING ARTS FESTIVAL AT THE DOWNTOWN VILLAGE. PARK IN MARCH, 1995 LOCATION: SOUTH AND NORTH OF MONTEZUMA, BETWEEN EISENHOWER DRIVE AND AVENIDA NAVARRO BACKGROUND: On January 23, 1995, an. application was received from Ms. Francis with the La Quinta Arts Foundation, requesting permission to install temporary off -site directional signs for their art festival to be held March 16-19th (Attachment 1). A copy of the signage request is attached (Attachments 2 and 3). The applicant is requesting small signs with directional information depending on the placement of the sign. Approximately 29 signs are proposed. The signs are located along the major arterial streets surrounding the site. Most signs are within two miles of the downtown park. A billboard sign is also being proposed for the event at the southeast corner of Washington Street and Highway 111. The applicant's minor temporary outdoor event permit (MTOE 94-069) for this event was approved by staff on January 26, 1995. The La Quinta Arts Festival has been held in La Quinta for 13 years. Municipal Code Provisions In late 1994, the City Council approved an amendment to the Municipal Code transferring their approval powers for special advertising to the Planning Commission. Chapter 5.64 (Special Advertising): provides for a permit to be issued by the Planning Commission for advertising devices other than the usual and customary permanent identification signs. This includes directional signs as requested in this application. Section 5.64.020 provides, in part, that permits are to be issued for special purposes, "...and not on a continuing basis for permanent advertising or identification purposes", and further, "each permit shall be issued for a specific period of time subject to renewal for good cause shown." PCGT.107 •. • Staff Comments In prior years, the City Council has approved the special off -site advertising for this event to ensure that the event is successful and patrons are able to find the art festival in a timely fashion. This application request is consistent and/or' the same as last year's approval. TEMPORARY PORTATANEL We are requesting approval from the City of La Quinta to place a portable billboard on the southeast corner of the intersection of Highway 111 and Washington Street for approximately two weeks prior to and during the event weekend --March 16, 17, 18, 19, 1995. The billboard will be used to advertise this special event and to direct people traveling on Highway 111 to turn south on Washington toward the City of La Quinta. Please see attached map for requested sign placement. This portable sign, to be provided by Fairway Outdoor Advertising Company, is of high quality with professional artwork and lettering similar in quality to those signs used to promote the Bob Hope Classic. It was not only market conditions that forced Pomona First Federal to reassess its intended use of our parcel. The rather significant takings of our property for the. desired.widening of Washington Street. have made the site unsuitable for a branch office. Taking that in stride, we agreed to sell the property to the 3 S Partnership so it could proceed with its development plans.. However, both we and the City seem to have been hearing representations for years now about how the Simon Plaza was going to come together soon. We agreed to several extensions of our sale escrow, until finally the 3S Partnership and Pomona First Federal were no longer able to stay in agreement as to a proposed sale. Taking that in stride also, we looked for and have found another willing buyer for our parcel, even though the parcel is becoming subject to even further takings so that the other side of Washington Blvd. can be widened to create a left -turn lane for the shopping center to. the northwest. If our current buyer is prevented from proceeding with his proposed development, we will have to reevaluate whether any reasonable use remains for our site in light of the nearly 40% being taken by the City. We wish to strongly encourage the City to approve the proposed car. wash use. We and our buyer are confident. that the CC&R's permit this use and - we can litigate the issue if need be. More importantly, we believe that our buyer's plans for this site provide a fitting entrance to the. City. They include extensive beautification at the northerly corner of the site that will be done at the expense of. the developer. Mr. Selzer isaccurate in predicting that we would characterize his protest as an attempt to hold our parcel hostage, for we believe that is exactly the source of his motivation.
