Your request for encroachments for Lots 4,8,19, and 21(as per the attached exhibit) in order to make legal the setback requirements has been- approved based on the following Findings: FINDINGS: 1 . The Minor Adjustments are consistent with :the La Quinta General Plan, in that the request does not alter the approved land use for the property, or affect land uses on surrounding properties. The Adjustment allows the property owner to save build the approved units. 2. The Minor Adjustment is consistent with the intent of the La Quinta Zoning Code, in. that the. request is for a deviation of no more., than 10% of a development standard. As very clearly observed on the tract map, we had 3 cul-de-sac type easement scenarios, and the front entrance Lot # 1 and #24's side to front set backs scenarios. More specifically because the way the radius requirements on the roads encroached on my building envelopes, we agreed that the small amount of "garage corner" encroaching in the front 20 foot easements was VERY ACCEPTABLE! As you can clearly see, these 3 model homes fit on all the lots except for a very small amount of the garage corner on the radius lots of this development. I know Martin also was aware of my knowledge to 10% of encroaching on an easement is staff approvable, and Martin adamantly agreed this was an easy case for that "staff approval." In a nut shell, this has become a problem because of Martin Magana's putrid professional handling, or better yet NON handling of this prestigious community. In fact Choice Enterprise has documented almost 4 weeks of NON returned calls from Martin Magana with the final outcome being, he was leaving the city. This was back in December of 2004 when I was just finishing dotting my "I's" and crossing my "T's" on this project. Myself and Company since has made a lot of compromises to accommodate a very apparent disorganized planning department. I do see great improvement in the past months and at this point very adamantly request these small encroachments be approved so myself, family and building company may continue to make our living, building homes!
