Request: Allow a 10% adjustment to encroach two feet into the rear yard setback for the purpose of locating an accessory second residential unit as. shown on the attached site plan. Conditions: 1. The existing guesthouse/casita on the subject property must be attached to the primary residential unit and have interior access. 2. Building plans to construct the second unit and for the existing gueshouse/casita to be converted as part of the residential unit shall be submitted concurrently to the Building & Safety Department. 3. The Building & Safety Department shall issue a building final for the conversion of the guesthouse/casita before issuing a building final for the second residential unit. 4. Prior to issuance of occupancy approval of the second unit, the property owner shall enter into a restrictive covenant with the City regarding such owner -occupancy requirement on a form prepared by the City, which shall be recorded against the property. Such covenant shall further provide that the second unit shall not be sold, or title thereto transferred separate from that of the property. :0 a Decision: Approval is granted for the requested adjustment subject to the above listed four conditions and based on the following findings: • Minor Adjustment 2008-607 is consistent with the La Quinta General Plan, in that the setback proposed does not alter the approved land use for the property, or affect land use on surrounding similar properties. • Minor Adjustment 2008-607 is consistent with the intent of the La Quinta Zoning Code, in that the requested adjustment will be conditioned to retain adequate side yard separations as required under said Zoning Code. • Processing and approval of Minor Adjustment 2008-607 is in compliance with the California Environmental Quality Act. The adjustment requested falls under CEQA Guidelines Section 15305(a), which includes minor setback and parcel adjustments as Categorically Exempt under this Section. • Approval of Minor Adjustment 2008-607 is not detrimental to the public health, safety and general welfare, nor injurious or incompatible with other properties and land use in the vicinity. The adjustment has no impact on health or safety issues, and will not affect physical land use characteristics in the vicinity. - Please be advised that the City only approves one Minor Adjustment per lot.
