Request: A request has been made to decrease the front yard setback for a side -entry carport from fifteen (15) feet to thirteen and a half (13' 6") feet to allow the addition of a one -car, side -entry carport at 51-422 Calle Ilollo. Decision: Approval is granted for the requested decrease in the front yard setback, based on the following Findings: • Minor Adjustment 2010-620 is consistent with the La Quinta General Plan, in that the decreased front yard setback proposed does not alter the approved land use for the property, or affect land use on surrounding similar properties. • Minor Adjustment 2010-620 is consistent with the intent of the La Quinta Zoning Code, in that the requested adjustments will retain adequate yard separations as required under said Zoning Code. • Processing and approval of Minor Adjustment 2010-620 is in ,compliance with the California Environmental Quality Act: The adjustments requested fall under .CEQA Guidelines Section 15305, which includes minor alterations in land use limitations as Categorically Exempt under this Section. • Approval of Minor Adjustment 2010-620 is not detrimental to the health'; safetyand public general welfare, nor injurious or incompatible with other properties and land use in the vicinity. The adjustment has no impact on health or safety issues, and will not affect physical land use characteristics in the vicinity. Based on the noted findings, your Minor Adjustment application is subject to the following Conditions: 1. A building permit shall be obtained from. the Building &Safety Department prior to construction of the side -entry carport or any building additions. 2. You are limited to one minor adjustment per lot; therefore, future request for .minor adjustments cannot be approved for this property. Please be advised that this approval relates only to allowance of the decrease as stated above, and does not imply any entitlement or approval of a building permit for any structures shown on the plans on file. All other setback provisions and development standards of the La Quinta Zoning Code are applicable and shall be adhered to in preparing plans for building plan check. If you have any additional questions, please contact me at (760) 777-7126. Respectfully yours, ERIC CEJA Assistant PI nner C: Building & Safety Department N Y 4 t Page 1 of 1 Eric Ceja " { From: Eric Ceja . Sent: 'Tuesday, February 02, 2010 2:35 PM To: 'karpinski@adelphia.net' Subject: 51-422 Calle Iloilo - La Quinta` `- Attachments: Minor Adjustment.doc u _ Hi Gabriel, ' 51422 Calle Iloilo ` The Planning Department has reviewed the submitted plans for a one -car, side -loaded, carport for this property. In review of the plans we have determined that the carport is permitted and is subject to the setback regulations of the La Quinta Municipal Code. Per the code, a side -load carport requires a 15' setback from the front, property , line. As shown, the carport would be located 13'6" from the front property line. The 13'6" is permissible subject to the property owner filing an application for a Minor Adjustment (Attached). The Minor Adjustment (MA) permits a one-time deviation in any development standard"up to a,maximum of 10%. If approved, the MA would permit the carport to be located at'13'6" (15' x 0.10 = :1.5' or 13'6"). The Planning Department would like to see the carport match;the architecture for the existing home. Therefore_ , we encourage the carport improvements to,match the architecture and design of the existing unit to ensure • compatibility. , - Desert Club Drive The property located on the northwest corner of Desert Club Driv6and Calle Cadiz is located within the City of La Quinta's Village Commercial District (VC). This district permits a number of uses and architectural variety. Development standards are set in Section 9.64 and 9.65 of the Municipal Code (http://gcode.us/codes/laquinta/). _ Maximum height in this district is limited to 2-stories or 35': ; Retail parking requirements are set at 1 space per 200 square feet: Office parking requirements are set at 1 space per 250 square feet. The code also mandates that 30% of office parking be covered. I hope this information is useful. Please let me know if you have any other questions._ Thanks, Eric Ceja, Asst.
