The current awning design proposed for the outdoor seating area at your restaurant on Washington identifies encroachment of posts and footings onto the adjacent westerly parcel. Unfortunately, State and local provisions prevent the placement of structures on two parcels. In addition, City code requires a setback of 20 feet from Washington Street (per LQMC 9.90.040). As was discussed, there appears to be two options available for your consideration. First, redesign the awning to eliminate the posts and footings from being placed on the adjacent parcel. Second, perform -a lot line adjustment and relocate the.lot.line to the west allowing for the posts -and footings,to-be located on the same parcel as the restaurant. You stated during our phone conversation that. redesigning the proposed awning is not an option available to you. As a result, please note the following: A copy of the lot line adjustment application is'attached. The application fee isL$250�Though recommended, you are not required to retain a land surveyor in order to complete this process: Please note that the attached application and. La Quinta Municipal Code Section 13.32 identify the information necessary to submit a lot line adjustment. This application process is administered by the Public Works Department. For additional information or questions regarding a lot line adjustment, please contact Ed Wimmer, Principal Engineer, at 760-777-7088. In addition, as I noted during our conversation, one of the primary functions of the adjacent property is for stormwater retention (as noted on the submitted awning plan).
