REQUEST: Grant up to an additional 10% height increase (to 30', 9.6"), based on the RL zone limit of 28 feet, to allow a 14' x 14' three-story tower element at 30'-9" in height. DECISION: Approval is granted for the requested adjustment based on the following findings and subject.to the conditions of approval listed below: 1. Minor Adjustment 2015-0008 is consistent with the La Quinta General Plan and Specific Plan 99-035, Amendment #1, in that the proposal does not alter the approved land use for the property, or affect land use on surrounding similar properties. 2. Minor Adjustment 2015-0008 is consistent with the intent of the La Quinta Zoning Code, and the subject Specific Plan, in that the requested adjustment will be conditioned to comply with all other development standards as required under said Zoning Code and Specific Plan. Staff has determined that a pre-existing Specific Plan modification, approved on April 12, 2010 (enclosed) is applicable to this request. This modification allows third -story elements not exceeding 10% of the principle residence to be established. 3. Minor Adjustment 2015-0008 is in compliance with the California Environmental Quality Act. A building permit shall be obtained prior to construction. 2. The proposed construction shall comply with the approved plans as submitted and on file for MA 2015-0008.
