This adjustment is consistent with the intent and purpose of the zoning ordinance, in that the four foot encroachment affects only a small area and still allows an average 7-1/2 foot rear yard setback. 2. There are special circumstances applicable to the property, including such factors as size, shape, and location that justify approval of the adjustment, primarily in that the garage cannot be located so as to access Washington Street and is therefore limited to its given location so as to comply with all other related requirements. 3. This adjustment will not be detrimental to the health, safety, and general welfare of the Community, nor will it be detrimental to property in the vicinity of the subject parcel, in that an adequate setback is still maintained.
