The proposed construction of a swimming pool and associated support structures will encroach within this 5.00 foot PUBLIC UTILITY EASEMENT, as reserved by the above referenced Tract. Our company, has no objections to the proposed construction, as proposed by American Pool Construction, or the subsequent encroachment. ' We do request, however, that a three inch (3") PVC conduit, schedule 40 or better, be placed within the easement area. This would facilitate our accessing the -area in the future, should the need to replace our facilities arise.
