Box 722 LOCATION: 77-205 Calle Durango La Quinta, CA 92253 Dear Mr. Miller: This letter is to report approval of your recent application for a setback adjustment, pursuant to Chapter 9.188 of the City of La Quinta Planning & Zoning Regulations. The following setback adjustment has been approved subject to conditions and in accordance with attached Exhibit A. SETBACK ADJUSTMENT: Reduction of rear yard setback from 5-feet to 3-feet of property line. FOR: Swimming Pool CONDITIONS: 1. Obtain a building permit from the Building Department. 2. The fencing requirements for S-R Zone shall be met. 3. A three inch (3) PVC conduit, schedule 40 or better, be placed within the easement area. This would facilitate our accessing the area in the future, should the need to replace our facilities arise. This conduit 'is to be capped off within five feet (5) of the side property lines, and should be placed at a maximum of thirty inches (30) . 4. Pool equipment shall comply with required setbacks and. maintain a minimum of five feet from property line. After review it was determined that: 1. This adjustment is consistent .with the intent and purpose of the Zoning Ordinance. 2. There are special circumstances applicable to the property, including such factors as size, shape, topography, location or surroundings that justify approval of the adjustment. These special circumstances are: small rear yard. 3.
