"Premises"); WHEREAS, Homeowner is the owner of certain. real property located immediately adjacent to the Citrus Course in the City of La Quinta, California, commonly known. as 50-$ZU Nectareo Street, La Quinta, 'CA 92253 ("Homeowner Property") and ttmore particularly described on Exhibit A, attached hereto and by this .reference made a part hereof, and desires to build a pool on the Homeowner Property (the "Project").; WHEREAS, the City of La Quinta Municipal Code §9.156.170 requires a minimum setback of five feet to any property line except with the approval of .the adjacent property .owner and Homeowner desires to build the pool within the five foot setback adjacent to the Citrus Course property line; WHEREAS, subject to the terms, covenants and conditions of this Agreement, KSL is willing to grant Homeowner permission to install the pool within the: five foot setback adjacent to the Citrus Course property line, in consideration of certain undertakings with respect to the Project by Homeowner; NOW THRREPORE, in consideration of the Recitals, the mutual promises contained herein and other good and valuable consideration the receipt and sufficiency • of which are hereby acknowledged, the parties agree as follows: 1. (a) Except as herein otherwise provided, no amendment, alteration, modification of or addition to this Agreement shall be valid or binding. unless expressed in writing and signed by the party or parties to be bound thereby.
