Swift Lockard 75-275 Painted Desert Drive Indian Wells, CA 92210 e SUBJECT: MINOR ADJUSTMENT 96-436 LOCATION: 54-775 AVENIDA ALVARADO Dear Mr. Lockard: The Community Development Department has reviewed your request to convert the existing carport into a garage pursuant to Section 9.210.040 (Minor Adjustments) of the Zoning Ordinance. We find that we can approve the request provided the following Conditions are met: 1. The garage .door shall be located 18-feet from the property line and the inside dimension of the new garage shall be 20' by 20'. To accomplish this interior depth dimension, the existing partition wall creating the storage area at the back of the existing carport shall be modified unless determined by the Building and Safety Department to be a structural element of the house. 2. A sectional, roll -up garage door shall be installed. 3. The Community Development Department shall approve the final construction plans prior to building permit issuance. 4. Obtain a building permit from the Building & Safety Department for this project by February 14, 1997. Otherwise, this approval shall expire and be of no use unless extended by this Department. After review it was determined that: 1. No impact to the City's General Plar. will occur with this adjustment request because the Land Use Element designates the site for residential purposes. This minor adjustment is consistent with the intent and purpose of the RC District to enclose the carport and provide a two -car garage for the existing house. 2. The project is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15303(e) which allows the conversion of small accessory structures into carports or garages. This minor adjustment will not be detrimental to the health, safety, and general welfare of this area of the City because there are other. existing structures in the La Quinta Cove which the County of Riverside approved that are similar in nature to this request. The proposed garage structure will lessen the visual blight that occurs with open carport structures which are adjacent to public streets because stored materials (i.e., vehicles, storage, etc.) will now be concealed behind the new garage door.
