CC Resolution 2008-059RESOLUTION NO. 2008-059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING AND ADOPTING A SECOND AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LA QUINTA AND THE LA QUINTA CITY EMPLOYEES' ASSOCIATION (LQCEA), COMMENCING ON JANUARY 1, 2009 WHEREAS, the City of La Quinta, hereinafter referred to as "City," and the La Quinta City Employees' Association, the recognized organization representing its members, hereinafter referred to as "Association," have met and conferred over wages, hours, terms, and conditions of employment pursuant to Government Code Section 3500, as amended; and WHEREAS, the City and the Association have negotiated a Second Amendment to the Memorandum of Understanding commencing on January 1, 2009 to raise the benefits contribution cap to $1,252.00 per month. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: Section 1. The City does hereby approve, ratify, and authorize implementation of each economic and non -economic benefit and right set forth in the Second Amendment to the Memorandum of Understanding between the City and Association, attached hereto and executed on October 7, 2008, and incorporated herein as Exhibit "A." OtHERIKE JENS City Attorney City of La Quinta, California EXHIBIT "A" SECOND AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LA QUINTA AND THE LA QUINTA CITY EMPLOYEES' ASSOCIATION/LABORER INTERNATIONAL UNION OF NORTH AMERICA (LIUNA) LOCAL 777 This SECOND AMENDMENT TO MEMORANDUM OF UNDERSTANDING (Second Amendment) is entered into by and between the CITY OF LA QUINTA (City) and the LA QUINTA CITY EMPLOYEES' ASSOCIATION/LIUNA/LOCAL 777 (Association) as of October 7, 2008. RECITALS WHEREAS, City and Association entered into a Memorandum of Understanding (MOU) concerning labor relations and terms and conditions of employment for the period of July 1, 2006 through June 30, 2009, and a First Amendment concerning the salary survey conducted pursuant to the terms of the MOU, entered into on February 6, 2007; and WHEREAS, Section 3(A) of the MOU requires City and Association to reopen negotiations each year to meet and confer on the amount paid by City for insurance coverage after Ca1PERS announces its rate increase or decrease for the upcoming calendar year; and WHEREAS, City and Association have met and conferred in good faith as required and have reached tentative agreement on an increase to the City's contribution to insurance coverage subject to ratification by the Association membership and approval of the City Council. NOW THEREFORE, it is agreed by and between the parties as follows: 1. Section 3(A) is hereby amended effective January 1, 2009 so that the amount of the City contribution towards insurance coverage will increase from up to $1,215 per month to up to $1,252 per month for calendar year 2009. 2. Except as specifically amended by this Second Amendment, the MOU and First Amendment remain in full force and effect.
