This agreement is made and entered into between the City of La Quinta and Trilogy Emergency Preparedness
Committee, here after referred to as Trilogy.
PURPOSE:
To provide emergency communications during a disaster event between the Trilogy and the City of La
Quinta.
TERM:
The length of this agreement shall be five (5) years from the date of signing or until at which time it is
cancelled in writing by either party, which cancellation becomes effective 30 days upon delivery to the
other party.
III. RESPONSIBILITIES:
1. The City of La Quinta will be responsible to:
a. Program the radio or at the expense of Trilogy direct Trilogy to where the radio can be
programmed by an authorized radio shop.
b. Provide training on the proper use of the radio on the city radio system;
c. Communicate when able with Trilogy to facilitate damage assessment and life safety needs
in their community.
d. Allow Trilogy to operate one radio under the City of La Quinta's FCC license by this
agreement for the purposes described above in "c".
2. Trilogy will be responsible to:
a. Purchase of the radio meeting the City of La Quinta requirements.
b. Maintain and repair the radio at Trilogy's expense.
c. Not allow un-authorized communications by others.
d. Use the radio on City of La Quinta frequencies only for official disaster related reports or to
facilitate exercise communications.
e. Follow FCC rules and regulations at all times.
f. Not sell or dispose of the radio until it has been re-programmed to remove all City of La
Quinta frequencies.
g. Not disclose any information heard or monitored to third parties that do not pertain to
Trilogy directly.
h. Make official written report of the theft or loss of the radio with City of La Quinta frequencies
to local law enforcement, (La Quinta Police) within 24 hours of known incident and notify
the City of La Quinta's Emergency Services Division.
IV. CONDITIONS:
1. The City of La Quinta reserves the right to limit communications by Trilogy at their own discretion
due to other immediate needs. There is no warrantee all calls for assistance will be heard and acted
upon. The emergency Vhf radio is another tool to be used when other forms of communications fail.
